1-AGREEMENT

BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA

AND

THE GOVERNMENT OF THE PEOPLE'S REPUBLIC OF CHINA

ON THE SETTLEMENT OF INDONESIA'S DEBT OBLIGATIONS TO THE

PEOPLE'S REPUBLIC OF CHINA

The Government of the Republic of Indonesia (Indonesia)

and the Government of the Peop 1 e' s Repub 1 i c of China ( PRC)

desirous of resolving the outstanding debt of Indonesia to

PRC, have agreed on the following:

Article 1

(a ) . The subject of this Agreement is the consolidation and

settlement of Indonesia ' s debt obligations to PRC, in the

amounts and currencies set forth in Exhibit A.

(b). PRC side's record shows that Indonesia owed to PRC 6

debts with principal and interest totalling Swiss Francs

(CHF) 124,217,299.61 and Pounds Sterling (GBP) 8,126,829.34

while the Indonesia side's record shows the principal and

interest of the debts totalling Swiss Francs (CHF)

98,847,151.37 and Pounds Sterling (GBP) 8,126,829.34.

(c). PRC agrees that the record of the Indonesia side

(d). PRC agrees to the Indonesia's proposal of calculating

the debt interest and rearranging the debt repayment schedule

according to the Paris Formula.

Article 2

The total principal amount of the debts specified in

Exhibit A is Swiss Francs (CHF) 96,228,329.59 and Pounds

Sterling (GBP) 7,982,829.34. Such principal amount shall be

repaid by Indonesia in thirty equal annual installments,

commencing on December 31, 1970 as further specified in

Exhibit B, Schedules 1, 2, 3, 4 and 5 attached hereto.

Notwithstanding the foregoing, the aggregate principal

payments scheduled for the period beginning December 31, 1970

and ending December

shall be payable in a single instalment by no later than

December 31, 1990.

Article 3

The tota 1 interest amount of the debts is Swiss Francs

(CHF) 2,618,821.78 and Pounds Sterling (GBP) 144,000.00.

Such interest amount shall be repaid by Indonesia in fifteen

equal annual instalments, commencing on December 31, 1985 as

further specified in Exhibit B, Schedules 2 and 5 attached

hereto. Notwithstanding the foregoing, the aggregate interest

payments scheduled for the period beginning December 31, 1985

and ending December 31, 1989, equalling Swiss Francs

(CHF) 872,940.60 and Pounds Sterling (GBP) 48,000.00 shall be

payable in a single instalment by no later than December 31,

No moratorium or any other interest shall be charged on

the repayment schedule specified in Articles 2 and 3 hereof.

Article 4

Both sides decided through discussions that repayment of

the debts by Indonesia sha 11 be made by convert i b 1 e

currencies or Indonesia's export commodities, with details as follows :

(a). The commodity payment shall not exceed 50% of the

amounts due on any payment date.

(b). Payment in convertible currencies shall be effected in

the original currencies (Swiss Francs and Pounds Sterling) as stipulated in Exhibit A.

(c) . The specific commodities for the payment of the debts are crude oil, natural

fertilizer (urea) and

rubber, timber,

other commodities

The Ministry of Finance of the Republic of Indonesia and

the Ministry of Foreign Economic Relations and Trade of the

People's Republic of China shall represent their respective

government in the implementation of this agreement. The Bank

of China and Bank Indonesia shall arrange technical details

Article 6

(a). With the coming into force of this Agreement, all

provisions of the original agreements governing the loans shall be null and void.

(b). This Agreement shall come into force on the date of its

signing and shall remain in force until all obligations of

this Agreement are met by both sides.
