SPECIFIC AGREEMENT BETWEEN

THE GOVERNMENT OF THE KINGDOM OF BELGIUM AND

THE GOVERNMENT OF THE REPUBLIC OF INDONESIA CONCERNING

THE

INDUSTRIAL RESTRUCTURING PROGRAMME (l.R.P.)

The Government of the Kingdom of Belgium llnd the Government of the Republlc of lndonesill; W1thin the framework ot the General Agreement on I echnical cooperation of June 16, 1969 ; Desiring to cooperllte in the Development of the Industry of lnoonesia ;

HAVE AGREED AS FOLLOWS :

Artfcle 1. THE PROJECT

The Government of the Kingdom of Belgium and the Government of the Republic of Indonesia decide to cooperate in the implementation of the" INDUSTRIAL RESTRUCTURING PROGRAMME" hereafter referred to as "the Project"

The aim of the Project is further described in the Technical File, attached to this Specific Agreement and forming an integral part of it.

EXECUTING AGENCIES

The Belgian Government designates the Belgian Administration for Development Cooperation (hereafter referred to as "BADC") as the Agency responsible for the implementation of its obligations under this Specific Agreement.

The BADC Is represented in Indonesia by the Development Cooperation Section of the Belgian Embassy in Jaki:rta.

The BADC will entrust (an) experienced subcontractor(s) to implement part of its contribution.

The Government of Indonesia designates the Agency for Industrial Research and Development. M lnistry of Industry, as the Agency responsible for the implementation of its contribution and operational matters of the project.

OBLIGATIONS AND CONTRIBUTIONS Of THE BELGIAN

GOVERNMENT

4.1. The Government of the Kingdom of Belgium plOO;Jes to take an active part in the realization of the different parts of the ProJect for which 1t Is responsible and to take all required administrative and budgetary measures to this end.

4.2. The Government of the Kingdom of Belgium shall provide the following experts: EN61NEERIN6 T.S.6.

I . One senior expert, Core team TSG 2. Two long term experts

inplant technical services to enterprises

3. Several short term experts

7. Several short term experts

Including their travel expenses once a year (long term experts) from and to Belgium and

their lodging.

The qualifications and job descriptions of these experts are further 005Cribed in the

Technical Fi le.

4.3. Within the limits of the annual quota of scholarships and fellowships allocated to Indonesia,

the Government of the Kingdom of Belgium shall grant 25 fellowships for a practical

training ln Belgium, each for a period of 6 months.

All trainings will be in the field of the engineering standards programme.

The selection of the beneficiaries has to be approved by both Governments.

4.4.

The Government of the Kingdom of Belgium

will pruville a contribution Of

credited to a start-up fund, to be created by the Ministry of Industry.

Details concerning the start-up fund wlll be specified by exchange of letters.

Before terminating the project, the Belgian and Indonesian Governments will consult each

other on the future destination of the vehicles and start-up fund and on the modalities of

transfer of ownership to the lnoonesian Government.

Art1clo 5.

OBLIGATIONS AND CONTR IB UTI ONS OF TH E IN DONES !AN

GOVERNMENT.

5.1. The Government of the Republ ic of Indonesia, in accordance with the prevalling laws and

regulations, shall contribute:

a) offices, laboratory spaces, furnitures, domestic telecommunication facilHfes and

secretarial fac111tles as required for the implementation of the project.

b) by allowing tax free purchasing of the five project vehicles in Indonesia.

d) travel expenses and hotel accomooation for the Belglan experts during authorized missions

within or outside Indonesia with the exclusion of the yearly travel expenses from and to

Belgium.

e) the appointment of the counterparts, Including the travel expenses and means related to

their duty.

S.2. The Government of the Republic of lnoonesia, in accordance with the prevailing laws and

regulations, shall :

a) assure that the lnoonesian counterparts will be in a position to fully devote themselves to

the project for its duration.

b) provide the Belgian experts with the exemptions and privileges mentioned in the General

Agreement on Technical Cooperation of June 16, 1969;

Art1cle 6.

CONTROL AND EVALUATI ON.

6.1 At any time, both Governments may supervise and/or control on the spot, the state of progress

of the Project.

6.2 Both Governments may review the aims and objectives of the Project and

necessary discuss

the main problems occuring during the implementation of the Project and where necessary

may evaluate the Project or part of its implementation aspects.

6.3 The Government of the Republic of lnoonesia reserves the right to request the Belgian

Government to recall any of the consultant's personnel in lnoonesia whose services and/or

activities are found unsatisfactory or for reasons of misconduct or misbehaviour .

Art1cle 8.

ENTRY INTO FORCE AHO VALIDITY

This Specific Agreement and the attached Technical File shall enter into force on the date of signini and remain into force until the completion of the Project.

Amendments to the Specific Agreement, not resulting in any increased cost to ony of the two contracting parties, may be made at any time wlth the mutual consent of the two Governments by exchange of letters.

This Specific Agreement can be terminated by either Government on condition that prior notice of six months is given.
