. Kedua Pihak Jang Berdjandji akan memelihara perdamaian , hubungan persahabatan dan hubungan persaudaraan jang kekal antara

Pemerintah Irak dan Pemerintah Indonesia serta berusaha memperluas

dan mempererat hubtingan itu antara kedua bangsa mereka •

PASAL II

Kedua Pihak Jang Berdjandji menjetudjui akan memperluas

hubungan diplomatik dan konsuler antara kedua negara mereka selaras

dengan dasar-dasar dan kebiasaan-kebiasaan internasional dan

me-njetudjui bahwa wakil-wakil kedua belah pihak, berdasarkan azas timbal-balik, akan memperoleh hak-hak, hak-hak istimewa, kebebasan tuntutan hakim dan kekebalan jang lazim diberikan berdasarkan

kebiasaan internasional •

PASAL I I I

Kedu~ Pihak Jang Berdjandji menjetudjui diadakannja

persetudjuan-persetudjuan chusus, berdasarkan azas timbal-balik ,

untuk mengatur hubungan-hubungan perdagangan, konsuler, kebudajaan ,

serta hal-hal navigasi, perlajaran dagang, penerbangan, penjerahan

.pendjahat-pendjahat, tempat kediaman warga-negara masing-masing dalam wilajah pihak lain serta segenap hal lain jang bermanf aat bagi

kedua belah pihak •

PASAL IV

Kedua Pihak Jang Berdjandji menjetudjui bahwa perselisihan dan persengketaan antara mereka harus diselesaikan setjara damai

dalam semangat persaudaraan dengan melalui saluran2 diplomatik biasa

dan bilamana tidak dapat diselesaikan dalam djangka waktu jang lajak ,

mereka akan mengemukakan ini kehadapan wasit menurut tjara jang

disetudjui oleh kedua belah pihak, selaras dengan peraturan-peraturan

-PASAL V

Perdjandjian ini akan disahkan oleh Kedua Pihak Jang Berdjandji

menurut tjara jang ditetapkan dalam Undang-Undang Dasar masing-masing

dan akan mulai berlaku pada tanggal pertukaran pengesahan di Baghdad

dalam waktu sesingkat-singkatnja •

Untuk menjaksikannja, maka Wakil-\'Iakil Berkuasa telah

menanda-tangani Perdjandjian ini dalam bahasa Arab, Indonesia dan Inggeris

dan ketiga naskah tersebut mempunjai kekuatan jang sama; ketjuali

dalam hal keraguan, maka bahasa Ingerislah jang akan diutamakan •

Dibuat di Djakarta, pada hari sernbilan belas Ramadhan tahun

seribu tiga ratus tudjuh puluh lima Hidjri sesuai dengan tanggal

tiga puluh bulan April tahun seribu sembilan ratus lima puluh enam •

INDONESIA

In the name of GOD, the Most Merciful , the Dispenser of Mercy •

His Excellency the President of the Republic of Indonesia ,

His Majesty the King of Iraq ,

being desirous of strengthening and perpetuating the bonds of brotherhood and friendship and widening the scope of Co

operation existing between their countries, have with consi -deration of the Charter of the United Nations decided to conclude a Traaty of Friendship, and for that purpose have appointed as th·eir Plenipotentiaries :

of The Republic of Indonesia , and

His Majesty the King of Iraq :

His Excellency ABDUL MUTTALIB AMIN AL-HASHIMI Envoy Extraordinary and Minister Plenipotentiary

of The Kingdom of Iraq to The Republic of Indonesia ,

who, after communicating to each other their respective full powers found them in good and due form have agreed upon the following :

2 -ARTICLE I

The High Contracting Parties shall maintain Peace, friendship,

and permanent brotherhood between the government of Iraq and the government

of Indonesia and endeavour to promote and strengthen those relations between their respective nations •

ARTICLE II

The High Contracting Parties agree to promote between their two countries diplowatic and consular relations in conformity with inter -national principles and practices and agree that the representatives

either party shall enjoy, on a reciprocal basis, rights, exemptions,

privileges and immunities accorded by international practice •

ARTICLE III

The High Contracting Parties agree to conclude special agreements,

on a reciprocal basis, to regulate commercial, consular, cultural relations,

and also matters relating to Navigation, merchants shipping, aviation, extradition of criminals, the residence of their respective nationals in the territory of the other party and all other matters of intereot to both

parties •

ARTICLE IV

The High Contracting Parties agree that disagreements and disputes, between the~ shall be settled peacefully in a spirit of brotherliness

through the usual diplomatic channels, failing to arrive at a settlement within a reasonable period, they shall resort to arbitration by a method agreed upon by both parties, in accordance with the rules and provisions of the Charter of the United Nations •

ARTICLE V

This Treaty shall be ratified by the High Contracting Parties in

accordance with their respective constitutional procedures and shall enter into force on the date of the exchange of retifications at Baghdad as soon as possible •

-IN WITNESS whereof, the Plenipotentiaries have signed the present

Treaty in the Arabic, Indonesia and English languages, all three texts

being equally authentic except in the case of doubt, the English text

shall prevail •

DONE at Djakarta this nineteenth of Ramadhan in the year one

thousand three hundred and seventy five of Hijri corresponding to the

thirdtieth day of April in the year one thousand nine hundred and fifty six.
