saya telah menerima Nota Yang Mulia tertanggal 26

Sep-tember 1979 mengenai Peng aturan dari proyek kerjasama

teknik "Rural Water Supplies in Central Java" (OTA-JJ)

dalam rangka Persetujuan tanggal 8 April 1971 antara

kedua Pemerintah kita meng enai Kerjasama Teknik.

Selanjutnya saya mendapat kehormatan pu1a untuk

menyetujui usul-usul yang tercantum dalam paragrap 1

s/d 6 dari Nota tersebut di atas, sehingga Nota Yang

Mulia dan Nota ini sebagai balasannya yang menyatakan

persetujuan Pemerintah Republik Indonesia, akan

meru-pakan suatu Pengaturan antara kedua Pemerintah kita.

I have the honour to acknowledge receipt of Your Note of September 26, 1979, concerning the Arrangement

of technical co-operation of the "Rural Water Supplies

in Central Java" (OTA-JJ), within the framework of the

Agreement of April 8, 1971, between our two Governments

regarding Technical Co-operation.

I have further the honour to inform that the

Government of the Republic of Indonesia agrees to the

proposals as cont ained in paragraphs! to 6 of the

above-mentioned Note so tha t Your Note and this Note in

reply thereto expressing the agreement of the Government

of the Republic of Indonesia, shall constitute an Arrangement between our two Governments.

Excellency,

I have the honour to refer to item 10 (3) of the Record of Discussions of 10 June 1977 and to propose on behalf of the Government of the Federal Republic of Germany that, in

pur-suance of the Agreement of 8 April 1971 between our two

Governments regarding Technical Co-operation, the following Arran.gement concerning the Project Rural Water Supplies in

Central Java (OTA 33) be concluded.

1. The Government of the Federal Republic of Germany and

the Government of the Republic of Indonesia shall

co-operate on the preparation of pre-investment/feasibi-l i ty studies on rural water supplies in Central Java.

The project is expected to run for up to 24 months.

2. The Government of the Federal Republic of Germany shall

make the follo·wing contributions:

counter-part institution pursuant to paragraph 5 below on

conclusion of the project work.

( 2 )It is ready to provide

( a ) training in the Federal Republic of Germany for up

to 5 civil engineers (Ing. grad. ), specializing in

water supplies and

2 water chemists (Ing. grad.),

(b) further training in the Federal Republic of Germany for 3 civil engineers specializing in water supplies

and

1 water chemist (Ing. grad .),

(c) training in Bangkok for up to 5 civil engineers

-who shall work on the project on their return and

carry on the tasks of the seconded experts on their o;,·m .

The Government of the Republic of Indonesia shall make the following contributions:

It

(a) shall make available:

1 co-project manager on a part-time basis

1 sanitary engineer as assistant co-project manager for 24 months

2 junior engineers as trainees from e .g. the

Faculty of Engineering of Diponegoro University, as well as the services of a local engineering firm for planning work (personnel requirements depending on the amount of the planning work), as well as the follo wing auxiliary personnel:

drivers for 24 months each

1 secretary for 24 months

and other office and auxiliary personnel depending on project requirements ,

(b) shall make available office accommodation with power,

telephone and water connections ,

( c) shall train up to 20 health controllers and

28 sanitarians, who shall work on the project

on their return and carry on the work o f the

seconded experts on their mv.n,

(d) shall make available all relevant data and information

in accordance with the requirements of the project ｡Ｎｾ､＠

assist the experts in all other matters related to the

project, particularly as regards any necessary permits,

special passes, customs clearance and finding

-(e) shall meet the cost of the contributions referred

to in paragraph 3 (a) to ( c ) above according to the

existing laws and regulations as well as of operation

and maintenance for the 3 vehicles, official domestic

·travel by the personnel referred to in paragraph

3

( a )

above and water and soil analyses as well as local printing, paper and translation costs, postage and

other office expenses,

(f) shall permit any local studies , surveys and other investigations required in connection with the

measures to be carried out .

The experts pursuant to paragraph 2 a bove shall have the following tasks, those referred to in paragraph 2 (1)

above being responsible for technical and organizational

aspects of the measures undertaken:

- preparation of pre-investment feasibility studies in critical areas of Kabupaten selected by the

Indonesian Government- for a projected rural population

of nearly 1 million; before selecting the areas the

Indonesian Government shall consult with the experts

referred to in paragraph 2 above ;

- drawing up wi thin 6 months of the beginning of the

proj ec t of building construction and rehabilitation

programmes ·which can be c arri e d out within a short

time;

- preparation of building plans and tender documents

at intervals of 1 2 , 18 and 24 months after the

be-ginni ng of the proj ect for a limited number of

schemes which i t appears possible to finance within

a short time where possible fro m Indonesia's mm

-preparation of reports by the various experts in the field o:f

hydrogeology, including proposals for a drilling

programme,

financial analysis,

management;

runhing of 5 two to four-week on-the-job training

programmes for provincial a.Yld district engineers ,

technicians, health controllers and sanitarians in the planning, design, maintenance and operation of

rural water supply and sanitation installations ;

- provision throughout the 24 months of the project

of on-the-job training for 2 junior engineers pursuant

to paragraph 3 ( a ),

- running of information campaigns to inform the

people in the selected areas concerning the hygienic

us e of wat er supply and sanitation installations,

drawing attention to the possibilities for them to

help themselves and to undertake the technical

operation and maintenance of the installations etc.

- working-out of technical solutions to special problems

connected with individual sanitation installations

- reviewing present design practices for rural water s upply and developing a simple and low-cost water

(1) The Government of the Federal Republic of Germany shall designate the Deutsche Gesellschaft flir Tech-nische Zusammenarbeit (GTZ) GmbH (German Agency for Technical Co-operation), 6236 Eschborn , \·.ri th the

implementation of its contributions . The GTZ shall make use of the WHO as executive agency. In special

cases the GTZ may also directly second short-term advisers.

(2)(a) The Government of the Republic of Indonesia

shall designate the Ministry of Health with

the implementation of the project . The Province

Health Office shall be responsible for all

co-ordination work in the project area .

Provision shall be made to ensure that

- there exist close co-ordination and co-operation

among all Indonesian institutions concerned with

the planning, financing, implementation and

operation of the schemes,

- experience and results obtained from similar

pro-jects in East and West Java are made available, and

the interim and final results of the project are taken into account by the Indonesian Government

in preparing the national, provincial and regency

financing and implementation programmes •

(b) The comp etent institutions shall at the beginning

of the project select as locations for the schemes

pursuant to paragraph

above regencies (Kabup aten), sub-regencies (Kecematan) and villages ( Desa ), the

-The final choice of locations shall be made by the

Steering Committee pursuant to paragraph

(3)(b)

below, after undertaking a joint tour of the area,

·within the first month of the begi:ri..ning of the

pro-ject , and shall be governed by considerations of

logistic feasibility as well as the need for sanitation installations.

(3)(a) The executing agencies pursuant to sub-paragraphs

1 and 2 above may jointly agree on details of the implementation of the project in a plan of

operations or in some other appropriate form,

adapting them as necessary in line with the

pro-gress of the project.

(b) The executing agencies pursuant to sub-paragraphs 1 and 2 above shall set up a project Steering

Committee which shall meet 3 to 4 times in the

course of the project to discuss the interim re-sults and direct the implementation of the project.

In all other respects the provisions of the aforementioned Agreement of 8 April 1971, including the Berlin clause

(A rticle 8) , shall apply to the present Arrangement.

If the Government of the Republj_c of Indonesia agrees to the

proposals contained in paragraphs 1 to 6 above, this No te

and Your Excellency1_{s Note in reply thereto expressing your}

Government ' s agreement shall constitute an Arrangement

ich beehre mich Ihnen im Namen der Regierung der Bundesrepublik Deutschland und unter Bezugna.h.me auf den Record of Discussions vom 10 . Juni 1977 Nr. 10 (3) so·wie ·in Ausfi..ihrung des Abkom..rnens vom 08. April 1971 zwischen unseren beiden Regierungen Uber Technische Zusam..rnenarbeit folgende Vereinbarung Uber das Vor-haben Landliche Was serversorgung in Zentraljava (OTA 33) vorzu-schlagen:

1. Die Regierung der Bunde srepublik Deutschland und die Regierung der Republik Indonesien arbeiten bei der Erstellung von Pre-investment-Studien/Feasibility-Studien flir die landliche Wasser-versorgung von Zentraljava zusammen . Die Projektlaufzeit wird bis zu 24 Monaten v eranschlagt .

2. Leistungen der Regierung der Bundesrepublik Deutschland

(1) a) Sie Ubernimmt die Kosten flir den Einsatz von:

a) bis zu 5 Bauingenieure ( grad .), Fachbereich Wasserver-sorgung,

2 Wasserchemiker (grad.), in der Bundesrepublik auszubilden ,

3 Bauingenieure, Fachrichtung Wasserversorgur1g,

1 Wasserchemiker (grad.), in der Bundesrepublik fortzubilden ,

c) bis zu 5 Bauingenieure am Asian Institute of Technology in Bangkok auszubilden, die nach ihrer Rlickkehr in dem Vorhaben eingesetzt we rden und die Auf gaben der ent-sandten Fachkrafte selbstandig fortflihren.

Leistungen der Regierung der Republik Indonesien

Sie

a) stellt folgende Fachkrafte:

sowie folgende Hilfskrafte:

Die Fachkrafte gemaB Nummer 2 haben folgende Aufgaben, wobei die fachliche und organisatorische Verantwortung filr die Durch-flihrung der MaBnahmen bei den in Nummer 2, Absatz 1, genannten Fachkraften liegt:

Erstellung von Preinvestment/Feasibility-Studien in besonders gefahrdeten und von der indonesischen ｒ･ｧｩ･ｲｵｮｾ＠ 0 ｡ｵｳｾ･ｷ｡Ｎｨｬｴ･ｮ＠ 0

Gebieten des Kabupaten (Regierungsbezirk) filr eine vorgesehene Landbevolkerux1g von nahezu einer Million, ·wobei vor der Aus-wahl die indonesische Regierung die unter Nummer 2 genannten Fach.Krafte anhort

Ausarbeitung von SofortmaBnahm.en filr kurzfristig durchfilhrbare Bau- und SanierungsmaBnahmen, innerhalb von 6 Monaten nach Projektbeginn,

- Erstellung von Bauplanen und Ausschreibungsunterlagen in Zwi-schenraumen von 12, 18 und 24 Monaten nach Projektbeginn filr eine begrenzte Anzahl von Vorhaben, deren kurzfristige Finan-zierung gegebenenfalls aus Eigenmitteln moglich erscheint,

- Erstellung von Fachberichten durch die verschiedenen Sonder-fachleute zu den Gebieten

Hydrogeologie einschlieBlich Vorschlage filr ein Bohrprogram.m, Betriebswirtschaft,

Betriebsfilhrung,

- Durchfilhrung von 5 zwei- bis vie:nvochigen Trainingsprogram.men am Arbeitsplatz filr Provinz- und Distriktingenieure, Techniker, Gesundheitskontrolleure, Sanitartechniker in Planung, ｅｮｴｾｶｵｲｦＬ＠

- Uberprlifung derzeitiger Planungspraktiken fur die landliche Wasserversorgung und zur Entwicklung eines einfachen und b illigen Wasserversorgungssystems , wobei jeder Plan v orzugs-weise f u r nicht mehr als 15.000 Menschen bestimmt sein sollte.

(1) Die Regierung der Bundesrepublik Deutschland beauftragt mit der Durchflihrung ihrer Leistung die Deu tsche Gesellschaft fur Technische Zusamrnenarbeit ( GTZ ) GmbH , 6236 Eschborn . Die GTZ bedient sich der VnIO als ausflihrende Ins ti tu ti on (Executive Agency ). Im Sonderfall kann die GTZ auch unmittelbar Kurz-zeitberater entsenden .

( 2 ) a ) Die Regierung der Republik Indonesien beauftragt mi t der Du rchflihrung des Vorhabens das Ministry of Health . Das Prov ince Health Office ubernimmt alle KoordinationsmaB-nahmen im Projektgebiet .

Es wird sichergestellt,

- daB eine enge Koordination und Kooperation zwischen allen Institutionen des Landes , die f u r Planung , Finan-zierung , Durchfuhrung und Betrieb v on Projekten zustan-dig sind , stattfindet ,

- daB dariib er h inaus die Erfahrungen und Ergebni sse aus den v ergleichbaren Proje kten in Os t - U..Yld Westj ava zur

b) Die zustandigen Institutionen wahlen bei Projektbegi:nn die Distrikte (Kabupaten), Subdistrikte (Kecemata:n) u:nd Dorfer

(Desa) aus, in denen die Vorhaben nach Nummer

durchgefilhrt ·werde:n , wobei die Begrenzung pro Distrikt bei etwa 1, O Mio Ei:nwohner liege:n sollte.

Die· e:ndgiil tige Festlegu:ng erfolgt durch die Steueru:ngsgruppe gemaB Nummer

Absatz 3 Buchstabe b i:nnerhalb des erste:n Mo:nats nach Projektbegi:nn anhand ei:ner gemei:nsame:n Bereisu:ng, ·wob ei · neben der hygienischen Bedlirftigkei t die logistischen Gesichtspun_"k.te der Projektdur·chflihru:ng als Entscheidu:ngsmaB-stab dienen.

( 3 )a) Die nach Absatz 1 u:nd 2 beauftragten Stellen kon:nen Einzel-heiten der Durchflihrung und des Vorhabens gemeinsam in einem Operationsplan oder in anderer geeigneter Weise festlegen u:nd, falls notig, der Entwicklung des Vorhabens anpassen .

b) Die nach Absatz 1 und 2 beauftragten Stellen bilden eine Pro-jektsteuerungsgruppe, di e e twa 3 bis 4 mal im Projektverlauf zur Diskussion der Zwische:nergebnisse u_n.d Steuerung der Pro-jektdurchflihrung zusammentritt.

6. Im librigen gel ten die Bestimmu:ngen des eingangs erv1ahnten Abkommens vom 08. April 1 971 einschli e Blich der Berlin-Klausel (Artikel 8) auch flir diese Vereinbaru:ng.

Falls sich die Regierung der Republik Indonesien mit den in Nummer 1

bis 6 enthaltenen Vo rschlagen einverstanden erklart, werden diese Not e und die das Einverstandni s Ihrer Regierung zum. Ausdruck brin-gende Antwortnote Eurer Exzellenz eine Vereinbar ung zwischen unseren beiden Regieru_n.gen bilden, die mit dem Datum Ihrer Ant wortnote in Kraft tritt.
