Lembaga Administrasi Negara, Republik Indonesia (yan g selanjutnya disebut sebagai LAN) da n Lal Bahadur Shastri Nati onal Academ y of Administration (yang se lanjutnya disebut sebagai LBSNAA), kedua nya selanjutnya disebut secara satu persatu sebagai "Pihak" dan secara bersamaan disebut sebagai "p ara Pihak";

BERKEING INAN untuk me mperkuat pemahaman dan persahabatan dengan

memajuka n pertukaran dan kerja sama dal am bid ang penge mb angan kapasitas aparatur sipil n egara;

BERMAKSU D untuk memperku at kerjasama te kn is antara para Pihak melalui pertukaran pengalaman, praktek terbaik dan pengeta huan agar sa ma-sam a meningkatkan administrasi publik di negara masi ng-masing;

an untuk berbagi manfaat kerja ama int

MEMPERTIMBANGKAN hubungan yang kuat, solid dan berkembang antara Republik In donesia dan Republik India;

SESUAI dengan hukum dan peraturan peru ndang-undangan yan g berlaku di negara masi ng-masing;

TELAH MENCAPAI KESEPAHAMAN sebagai berikut:

Pasal 1 Tujuan

Tujuan dari Me morandum Saling Pengertian ini yang sela njutnya disebut sebagai "MSP" adal ah untuk mem bentuk kerangka ke rja bagi hubungan kerja sa m a

kelembagaan untuk mendorong dan mend ukung kerjasama di bidang

pengembangan kapasitas aparatur sipil negara.

Pasal 2

Ruang Lingkup Kerjasama

Para Pihak akan berusaha untu k melaksanaka n kegiata n pertukaran da n kerj asam a dari MSP be rikut ini yang terdiri dari:

1. Pertukaran kunjungan kerja atau studi untuk berbagi pengalaman dan ide;

2. Penyelenggaraan program-progra m penge m bangan kapasitas sesuai kebutuhan

dalam bidang tata ke lola pemerintaha n publik dan kepemimpina n, administrasi publik, dan pengembangan pelayanan publik bagi aparatur si pil negara Republik Indonesia dan Repub lik India;

3. Penyelenggaraan kursus-kursus bersama, lokakarya-lokakarya, forum-forum,

seminar-seminar dalam bidang yang diminati oleh ke dua belah Pihak;

4. Partisipasi bersama dalam kegiatan -kegiatan penelitian yang diminati bersama

5. Pe rtukaran praktek t erbaik dalam bidang pelatihan dan pengembangan pe layanan publik; dan

6. Pertukaran dan kerja sama lainnya yang dapat diputuskan bersama oleh para

Pihak.

Pasal 3

Pelaksanaan

1. Untuk pelaksanaan MSP ini, para Pih ak wajib menyelenggarakan ko nsultasi

berkala apabila dianggap perlu.

2. Rincian spesifik dari prosedur-prosedur dan program-program untuk

kegiatan-kegiatan pertukaran dan kerjasama akan diputuskan secara te rpi sah atas persetujuan para Pih ak.

Pasal 4

Pengaturan Keuangan

1. Pengaturan ke uangan dari program -program y ang disebutkan di atas dan

program-program lainnya yang disepakati bersama yang dibuat di bawah MoU ini wajib ditentukan oleh para Pihak pada kasus-per-kasus tergantung dari keterse di aan dana.

2. Dalam kasus-kasus tertentu, dan sesuai dengan sifat dari kerjasama yang

di laksanakan, tindakan-tindakan keu angan lainnya dapat dilakukan untuk memastikan pelaksanaan yang semestinya, tergantun g dari ke sepakatan para Pi hak.

Pasal 5

Hak Kekayaan lntelektual

1. Masing-masing Pihak w ajib melindungi, dalam wilayahnya, hak kekaya an

2. Para Pih ak wajib memastikan perlindunga n yang memadai dan efisien te rhadap hak kekayaan intelektual yan g dihasilkan atas dasar MSP ini, sesuai de ngan undan g- undang dan peraturan perundang-undangan yang berlaku di

masing-masing Negara da n sesuai dengan perjanjia n internasional diman a

mereka sebagai pihak.

Pasal 6

Pembatasan Aktivitas Person il

Mas ing-masing Pihak wajib mengambil tindakan-tindakan yang memadai guna memastikan bahwa para personilnya yang terlibat dalam kegiatan-kegiatan di bawah MSP ini menghormati kebebasan politik, kedaulatan, dan integritas kewilayahan dari Negara tuan rumah da n akan bertindak sesu ai da lam lin gkup dari MSP ini.

Pasal 7

Penyelesaian Perbedaan

Perbedaan apa pun yang muncul dari pemahama n, aplika si dan pel aksanaan dari MSP ini akan diselesaikan secara damai melalu i ko nsultasi dan negosiasi.

Pasal 8

Perubahan

MSP ini dapat dikaji ulang atau diubah kapan pun atas persetuju an tertulis para Pihak. Pengkajian atau perubah an tersebut akan berlaku pada tanggal yang ditentukan oleh para Piha k melalui j alur diplomatik dan akan menjadi bagian yang tidak terpisahkan dari MSP ini.

Pasal9

Pemberlakuan, Masa Berlaku, dan Pengakhiran

2. MSP ini akan tetap berlaku untuk jangka waktu 3 (tiga) tahun . Setelah itu MSP akan diperbaharu i denga n persetujuan bersama secara tertulis o leh para Pihak.

3. M asin g-masing Pih ak dapat men gakhiri MSP ini setiap saat denga n

memberikan pemb erit ahuan secara tertulis sekuran g-kuran gnya tiga bulan sebelum tanggal pengakhiran yang diinginkan.

4. Pengakhiran MSP ini wajib tidak mempengaruh i keabsahan dan masa berlaku

program-program atau aktivitas-aktivitas apa pun yang sedang berlangsung yang telah dil akukan sebelum pengakhiran MSP ini hingga program -program atau kegiatan-kegiatan tersebut selesai.

SEBAGAI BUKTI, yang bertandangan dibawah ini, yang diberikan kuasa, telah menandatangani MSP ini.

Ditan datangani rangkap dua di Jakarta pada tanggal 11 Oktober 2013 dalam d u a naskah asli, m asing-m asing da la m Bahasa Indonesia, Bah asa Hindi dan Bahasa lnggris, semua naskah memiliki keku atan hukum yang sama . Da lam hal terja di perbedaan penafsiran, maka naskah Bahasa lnggris yang berlaku.

NAT,IONAL INSTITUTE OF PUBLIC AD MIN ISTRATIO N

OF THE REPUBLIC OF INDON ESIA

AND

LAL BAH ADUR SHASTRI NATIONAL ACADEMY OF ADMINISTRATION

OF THE REPUBLIC OF INDIA

CONCERN ING

TECHNICAL COOPERATION IN THE AREA OF

CAPACITY BUILDING O F PUBLIC OFFICIALS

(hereinafter referred to as LAN) and The Lal Bahadur Shastri National Academy of Administration of the Republic of India (hereinafter referred to as LBSNAA), both of them hereinafter singularly referred to as "the Party" and collectively referred to as "the Parties";

RECOGNIZING the need to share value of intern ation al cooperation and have agreed to further continue their common interests in promoting th e mutual cooperation in the area of capacity building of public officials;

CONSIDERING the stron g, soli d and progressing rel ation s betwee n the Republi c of Indonesia and the Republic of In dia;

PURSUANT to th e prevailin g laws and regulations in their respective cou ntries;

HAVE REACHED the following understanding:

Article 1

Objective

The objective of this Memorandum of Understanding hereinafter referred to as the "MoU" is to establish framework for cooperative in stitutional relations to encourage and promote cooperation in the area of the ca pacity building of the public officials.

Arti cle 2

Areas of Cooperat ion

The Parties will end ea vor to ca rry out the follo w ing exchanges and cooperative activities of this Mou which consist of:

1. The exchange of workin g or study visits to share experiences and ideas;

2. The orga nizat ion of customized capacity building programmes in the area of

public governance and leadership, pub lic administratio n, and public service development for public officials of the t he Republic of Indonesia and Re public of India;

3. The organization of joint courses, workshops, forums, seminars in areas of

interest to both Parties;

4. Joint participat ion in researc h activities of common interest in the field of

6. Any other exchan ges and cooperative act ivities t hat maybe jointly decided

upon by the Parties.

Article 3

Implementation

1. The Parties shall hold periodical con sultations as deemed necessary in

implementing this MoU.

2. Specific details of procedures and programm es for exchange and cooperative

activities shall be decided in a manner to be separately agreed upon by the Parties.

Articl e 4

Financial Arrangements

1. The fin an cial arrangem ents of th e above menti one d progra m mes and other mut ually agreed programmes made under this MoU shall be determ in ed by the Part ies on a case-by-case basis subject to the availa bility of fun ds.

2. In specific cases, and according to the nature of the cooperation to be ca rri e d on, other financial measures can be im pleme nted to en sure proper implementation subject to the agreement of the Parties.

Article 5

Intellectual Property Rights

2. The Parties shall en sure appropriate and efficie nt protection of intellectual property rights obtained o n the basis of t his MoU, in accordance with laws and reg ulation s in force in the ir respective countrie s and in accordance with the international agreements to which they are party.

A rticle 6

Limitation of Personnel Activities

Each Party shall take reasonable measures to make sure that its personnel engages in the activities under this MoU respecting po litical independence, sovereignty, and territorial integrity of the host country and shall act within the scope of this MoU.

Article 7

Settlement of Differences

Any differences arising out of the interp retati on, application and implementation of this MoU shall be settled amicably through co nsultati ons and negotiation s.

Article 8 Amendment

This MoU can be reviewed or amended at any time by m utual written consent by the Parties. Such reviews or amendments shall enter into force on such date as may be determined by th e Pa rties through diplomati c channels and shall form an integral part of this MoU.

Article 9

Entry into Force, Duration, and Termination

2. This MoU shall re main in force for a period of 3 (three ) years. Thereafter it will be re newable w ith mutual written consent of the Parties.

3. Either Party may termina te this MoU at any tim e by gi vin g writte n notification at least 3 (three) months prior to the inte nd ed date of termination .

4. The termination of this MoU shall not affect the validity and duration of any on -going programmes or activities made prior to the termination of this MoU until the completion of such programmes or activities.

IN WITNESS WHEREOF, the undersigned being duly auth orized thereto, have signed this MoU.

DONE in duplicate at Jakarta on 11 October 2013 in two origin als, each in In donesian, Hindi and English languages, all texts being eq ually authe ntic. In case of any divergence in interpretation, the English text shall prevail.
