MEMORANDUM OF UNDERSTANDING ON CONSULTATION
BETWEEN
THE DEPARTMENT OF FOREIGN AFFAIRS OF THE REPUBLIC OF INDONESIA
AND
THE MINISTRY OF FOREIGN AFFAIRS OF THE REPUBLIC OF BELARUS
REGARDING THE ESTABLISHMENT OF THE INTERGOVERNMENTAL INDONESIAN-BELARUSIAN JOINT COMMISSION ON TRADE,
ECONOMIC AND TECHNICAL COOPERATION
The Department of Foreign Affairs of the Republic of Indonesia and the Ministry of Foreign Affairs of the Republic of Belarus (hereinafter referred to as "the Parties"); DESIRING TO guarantee the effective work of the Intergovernmental Indonesian-Belarusian Joint Commission on Trade, Economic and Technical Cooperation; PURSUANT TO Article 5 of the Agreement between the Government of the Republic of Indonesia and the Government of the Republic of Belarus on Economic and Technical Cooperation signed in Jakarta on 12 May 2000;
PURSUANT TO the prevailing laws and regulations in their respective countries; HAVE AGREED as follows:
ARTICLE l
The Parties will inform each other through diplomatic channels about completion of internal procedures on creation of the Intergovernmental Indonesian-Belarusian Joint Commission on Trade, Economic and Technical Cooperation (hereinafter referred to as "the Commission"). The Commission will be considered established after receiving of last such notification.
ARTICLE2
The Commission will undertake the following functions:
a. Assist and review the implementation of the Agreement on Economic and Technical Cooperation signed in Jakarta on 12 May 2000;
b. Evaluate the economic and technical cooperation between the two countries and make recommendations and propositions on all possible measures to be taken to enhance the said cooperation;
c. Assist and review the realization of the programs and projects on economic and technical cooperation between the two countries;
of the trade and economic collaboration; and coordinate settlements to these questions;
e. Process the suggestions, inquires and appeals of the state bodies Enterprises and business representatives of both countries concerning trade, economic and technical cooperation;
f. Identify other forms of cooperation as mutually agreed upon by the Parties.
ARTICLE3
1. At the meeting of the Commission, both delegations shall be headed by respective Co-Chairmen of the National delegation at the senior official level. The composition of the Commission shall be determined by the Co-Chairmen of the National Parts and shall consist of relevant representatives of governmental institutions.
2. The secretariat of the National delegation of the Commission shall be responsible for the organizational work of the Commission, preparation of the documents for the sessions of the Commission, and execute other duties, which are associated with the activity of the Commission.
3. Both Secretariats shall notify each other of the composition of their delegations prior to each session.
4. If deemed necessary, the Commission may designate permanent and temporary working groups to consider specific issues and may invite advisers and experts in the work of the Commission and shall submit their reports to the plenary sessions for consideration.
ARTICLE4
1. The Commission shall meet any time alternately in Indonesia or in Belarus on the date mutually agreed by the Parties. The Chairman of the hosting Party, authorized by the Government of its state shall preside on the sessions. The hosting Party of the meeting shall be responsible to provide a venue and secretariat services;
2. The Parties agree, prior to the date of the convening of the sessions, to exchange the drafts of the agenda with a view to its approval and prepare the drafts of the session Protocol;
3. Decisions taken by the Commission on its session shall be formulated in Protocols of the Commission sessions.
4. The results of the meeting of the Commission which are agreed by Co-Chairmen shall be in the form of Protocol and to be signed by the Co-Chairmen of the respective National delegations. Protocol of the Commission shall be done in the English language.
