THE STIPULATION OF THE EXPORT CHECK PRICE (HPE) OF SEA SAND
THE MINISTER OF INDUSTRY AND TRADE
Considering :
That in the framework of utilizing natural resources maximally for the sake of people's prosperity and welfare as well as controlling the dredging of sea sand and preventing environmental damage, it is deemed necessary to stipulate a decree of the Minister of Industry and Trade on the stipulation of the export check price of sea sand.
In view of :
1. Government Regulation No. 1/1982 on the implementation of export, import and foreign exchange flow, as already amended by Government Regulation No. 24/1985;
2. Presidential Decree No. 260/1967 on the affirmation of tasks and responsibility of the Minister of Trade in the foreign trade sector ;
3. Presidential Decree No. 228/M/2001 on the establishment of the Mutual Cooperation Cabinet;
4. Presidential Decree No. 102/2001 on the status, tasks, functions, organizational structures and working arrangements of ministrie s;
5. Presidential Decree No. 109/2001 on first-echelon organizational units and tasks of ministries;
6. Presidential Decree No. 33/2002 on control and supervision over exploitation of sea sand;
7. Decree of the Minister of Industry and Trade No. 588/MPP/Kep/12/1998 on export general provisions as already amended several times and the latest by Decree of the Minister of Industry and Trade 575/MPP/Kep/VIII/2002;
8. Decree of the Minister of Industry and Trade No. 86/MPP/Kep/3/2001 on the organization and working arrangement of the Ministry of Industry and Trade;
9. Decree of the Minister of Industry and Trade No. 441/MPP/Kep/5/2002 on sea-sand export provisions.
DECIDES :
To stipulate :
THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE ON THE STIPULATION OF THE EXPORT CHECK PRICE (HPE) OF SEA SAND.
(1) Referred to in this decree as the Export Check Price (HPE) shall be the benchmark price stipulated periodically, which constitutes the benchmark price for exporters in closing contracts with buyers/importers and the basis for calculation of foreign exchange revenue of the state from the taxation sector in export activities ;
(2) Referred to in this decree as sea sand shall be the sea sand as meant in Article 1 point (1) of Presidential Decree No. 33/2002 on control and supervision over exploitation of sea sand.
Article 2
The Export Check Price (HPE) shall be stipulated on the basis of FOB price.
Article 3
(1) The Export Check price (HPE) of sea sand as meant in Article 2 shall be amounting to 3 (three) US dollars per cubic meter (US$ 3/M3).
(2) The Check Price as meant in paragraph (1) shall be effective up to December 31, 2002.
Article 4
This decree shall come into force as from October 1, 2002.
For public cognizance, this decree shall be announced by placing it in State Gazette of the Republic of Indonesia.
