LEGAL BASIS

Law No. 19 of 2003 regarding State Owned Enterprises (BUMN);

a. Article 2 paragraph (1) letter e: one the aims and objectives of establishing a BUMN is to actively participate in provid- ing guidance and assistance to economi- cally weak entrepreneurs, cooperatives, and the community.

b. Article 88 paragraph (1): BUMN can set aside a portion of its net profit for the need for fostering small businesses / cooperatives as well as fostering the surrounding community BUMN.

Government Regulation Number 83 of 2015 concerning Perum Perumnas;

As part of Corporate Social Responsibility (CSR), then Social & Environmental Responsibility activities (TJSL) / Partnership & Community Development Program (PKBL) in Perumnas also refers to the basis regulations in implementing CSR activities.

Dasar hukum yang menjadi landasan pelaksanaan CSR dan TJSL/PKBL di Perumnas adalah sebagai berikut:

Undang-undang No. 19 Tahun 2003 tentang Badan Usaha Milik Negara (BUMN);

a. Pasal 2 ayat (1) huruf e: salah satu maksud dan tujuan pendirian BUMN adalah turut aktif memberikan bimbingan dan bantuan kepada pengusaha golon- gan ekonomi lemah, koperasi, dan mas- yarakat.

b. Pasal 88 ayat (1): BUMN dapat meny- isihkan Sebagian laba bersihnya untuk keperluan pembinaan usaha kecil/koper- asi serta pembinaan masyarakat sekitar BUMN.

Dalam mengoptimalkan dan kelancaran pelaksa- naan Program Kemitraan dan Program Bina Lingkungan, masing-masing Perum dan Persero yang menjadi BUMN Pembina dapat bekerjasama dengan BUMN lain, Anak Perusahaan BUMN, Peru- sahaan Terafiliasi BUMN dan/atau Badan Hukum yang telah didirikan oleh BUMN untuk tujuan sosial dan kemanusiaan untuk penyaluran Program Kemi- traan dan Program Bina Lingkungan.

Kerja sama tersebut harus dituangkan dalam perjan- jian yang memuat hak dan kewajiban masing-mas- ing pihak. Untuk memastikan tercapainya tujuan pelaksanaan program yang direncanakan, BUMN Pembina harus tetap memonitor pelaksanaan Program Kemitraan dan Program BL yang dilak- sanakan oleh penyalur.

Dalam Permen tersebut diatur pula tentang Dana Program Kemitraan yang disalurkan dalam bentuk:

Terkait dengan Beban Pembinaan, pada peraturan tersebut ditetapkan bahwa beban pembinaan dapat digunakan untuk membiayai pendidikan, pelatihan, pemagangan, pemasaran, promosi, dan hal-hal lain pinjaman untuk membiayai modal kerja dan/atau pembelian aset tetap dalam rangka meningkatkan produksi dan penjualan;

Hal lain lagi yang diatur oleh Permen tersebut adalah bahwa Dana Program Bina Lingkungan disalurkan dalam bentuk:

bantuan bencana alam dan bencana non alam, termasuk yang disebabkan oleh wabah;

bantuan pendidikan, dapat berupa pelati- han, prasarana dan sarana pendidikan;

b.

bantuan peningkatan kesehatan;

c.

bantuan pengembangan prasarana dan/atau sarana umum;

d.

bantuan sarana ibadah;

e.

bantuan pelestarian alam; atau f.

bantuan sosial kemasyarakatan untuk pengentasan kemiskinan, termasuk untuk: elektrifikasi; penyediaan sarana air bersih; penyediaan sarana sanitasi;

bantuan pendidikan, pelatihan, pemagangan; promosi, dan bentuk bantuan lain yang terkait dengan upaya peningkatan kemandirian ekonomi usaha kecil selain Mitra Binaan Program Kemitraan; perbaikan rumah untuk masyarakat tidak mampu; bantuan pembibitan untuk pertanian, peternakan dan perikanan; atau bantuan peralatan usaha.

In accordance with the SOE Ministerial Regulation PER-02 / M BU / 04/2020 dated 02 APRIL 2020, Perumnas prepares and implements a Social &

Environmental Responsibility Program in the form of a Partnership and Community Development Program. PKBL activities that are carried out in the company in Perumnas are divided into 2 main programs, namely the Partnership Program and the Community Development Program.

The program is implemented by the Company consistently and with full commitment as Perumnas manages the Company and continues to strive to encourage business growth.

In addition to these obligations and compliance, Perumnas believes that business continuity is great- ly supported by non-financial investments built through contributions to community development.

Aspects of CSR activities referred to are the fields of education, health, and environmental management as well as matters that are responsive to natural disasters and other major calamities that occur in the community.

Thus, in the future there will be a constructive and reciprocal response among stakeholders to the Company, as well as having an impact on added value for all stakeholders and providing benefits to the wider community for the Company's existence.
