ANALISIS PERBUATAN YANG BERPOTENSI MERUGIKAN PIHAK LAIN DALAM PEMALSUAN DOKUMEN SURAT PCR (POLYMERASE
CHAIN REACTION) SEBAGAI UNSUR DELIK

ABSTRAK
Perbuatan yang berpotensi merugikan pihak lain di masa pandemi yang menyebabkan kematian akibat virus yang ditularkan dalam kasus pemalsuan dokumen surat PCR hanya mengatur hukuman terkait pemalsuan surat dan tidak ada unsur delik yang mengatur terkait akibat yang ditimbulkan dari perbuatan tersebut sebagai hal yang harus diantisipasi di masa mendatang. Tujuan penelitian ini untuk mengetahui apa saja hal-hal yang mendorong perbuatan yang berpotensi merugikan pihak lain di masa pandemi menjadi unsur delik. Metode penelitian yang digunakan adalah normatif dimana fokus penelitian adalah mengkaji penerapan kaidah-kaidah atau norma-norma hukum positif dengan melakukan pendekatan kasus (case approach). Hasil penelitian adalah penjatuhan hukuman dalam tindak pidana pemalsuan surat hanya dikenakan pada Pasal 263 ayat (1) KUHP tentang Pemalsuan Surat Pokok dengan mengutamakan ancaman hukuman pidana penjara terberat yaitu 6 (enam) tahun, serta akibat yang ditimbulkan dari perbuatan tersebut tidak ada regulasi yang mengaturnya sehingga perlu di dorong menjadi unsur delik dengan memperhatikan hal-hal berikut: perbuatan secara langsung mengganggu keselamatan hidup orang orang banyak, perbuatan tidak disukai masyarakat karena dapat menimbulkan korban, potensi penularan virus di pesawat cukup tinggi yakni berdasarkan riset dalam perjalanan waktu 10 jam terdapat 15 orang terinfeksi virus corona sehingga harus adanya kepastian hukum dalam melindungi seseorang apabila terjadi kerugian akibat perbuatan memalsukan surat PCR. Oleh sebab itu perlu adanya pembaharuan hukum atas aturan yang sudah ada dengan memasukkan akibat dari pemalsuan surat sebagai salah satu unsur delik yang dapat dipidana. Sebagaimana suatu kebijakan haruslah memberikan perlindungan masyarakat (social defence policy), sehingga dalam melindungi masyarakat dan mengatasi kejahatan dapat tercapai.

ABSTRACT
Actions that have the potential to harm other parties during a pandemic that cause death due to viruses transmitted in cases of forgery of PCR letter documents only regulate penalties related to letter falsification and there is no element of offense that regulates the consequences arising from these actions as things that must be anticipated in the future . The purpose of this study is to find out what are the things that encourage actions that have the potential to harm other parties during the pandemic to become elements of offense. The research method used is normative where the focus of the research is to examine the application of positive legal rules or norms by taking a case approach. The result of the research is that the punishment in the criminal act of forgery of letters is only imposed on Article 263 paragraph (1) of the Criminal Code concerning Counterfeiting of Principal Letters by prioritizing the threat of the heaviest prison sentence of 6 (six) years, and the consequences of this act there are no regulations that regulate it. so that it needs to be encouraged to become an element of offense by paying attention to the following things: actions that directly interfere with the safety of the lives of many people, actions that are not liked by the public because they can cause victims, the potential for virus transmission on planes is quite high, based on research in the course of 10 hours there are 15 people are infected with the corona virus, so there must be legal certainty in protecting someone in the event of a loss due to the act of falsifying a PCR letter. Therefore, there is a need for legal reform of the existing rules by including the consequences of letter falsification as one of the elements of the offense that can be punished. As a policy must provide community protection (social defense policy), so that in protecting the community and overcoming crime can be achieved.
