Such payments shall be made in an amount calculated by multiplying (i) the diversion payment rate by (ii) the agricultural program payment yield for the crop, by (iii) the additional area diverted pursuant to this paragraph. The diversion payment rate shall be set by the Secretary at a minimum of $3.00 per bushel, except that the rate may be reduced by up to 10 percent if the Secretary determines that the program objective could be achieved at a lower rate. The Secretary shall make to producers of the 1983 crop at least 50 percent of all payments under this paragraph as soon as practicable after the producer enters into a land diversion agreement with the Secretary and before any performance determination is made. , but in no case before October 1, 1982.
