Masalah-Masalah Hukum (MMH) is an academic journal for Legal Studies published by Faculty of Law, Universitas Diponegoro. It aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning Indonesian laws and legal system.
Masalah-Masalah Hukum (MMH) published periodically (January, April, July and October) in English and Indonesia articles, approved and ready-to-publish manuscripts will also be regularly published in the website (with early view) and the hardcopy version will be circulated at the end of every period.
Nationally Accredited (2017) by the Director General of Strengthening Research and Development, Ministry of Research, Technology, and Higher Education Republic of Indonesia Decision No. 32a/E/KPT/2017, Masalah-Masalah Hukum (MMH) is one of the most reputable legal journals in Indonesia.
As one of the oldest legal journals in Indonesia, Masalah-Masalah Hukum (MMH) is one of the scienti c references in the eld of law. This can be seen in the high number of citations and the impact factor of this journal. In its 50th publication number in 2021, Masalah-Masalah Hukum (MMH) continues to be committed to improving its governance and quality, so that it remains one of the leading legal journals in Indonesia.

Abstract
UNHCR is the United Nations specialized organs formed for the purpose of protecting and guaranteeing human rights and international efforts to humanise refugees, as a result of a war or a prolonged armed conflict, internal strife and other domestic issues. Handling refugee who came from Indochina Peninsula, the ethnic Rohingya refugees, East Timor's refugees, at least is clear evidence of the contribution of UNHCR in the handling of international refugee issues in Indonesia.

UNHCR merupakan organ khusus PBB yang dibentuk untuk tujuan melindungi dan menjamin HAM serta upaya memanusiawikan para pengungsi internasional, sebagai akibat dari suatu peperangan ataupun konflik bersenjata yang berkepanjangan, pertikaian internal dan berbagai persoalan dalam negeri lainnya. Penanganan pengungsian yang berasal dari Semenanjung Indochina, pengungsi etnis Rohingya, pengungsi eks Timor Timur, setidaknya merupakan bukti nyata adanya kontribusi UNHCR dalam penanganan permasalahan pengungsi internasional di Indonesia.

A. Pendahuluan
Berbagai persoalan internasional menunjukan kecenderungan yang semakin kompleks dalam bidang kehidupan, sehingga m e m e r l u k a n s t r a t e g i p e n a n g a n a n k o m p r e h e n s h i f d a r i m a s y a r a k a t internasional. Negara sebagai salah satu subyek Hukum Internasional (Thontowi &
Iskandar, 2006) merupakan change of agency yang berperan aktif dalam pengembangan dan pentransformasian eksistensi Hukum Internasional guna mengatasi berbagai persoalan didalamnya. Seiring dengan perkembangan waktu, eksistensi negara sebagai aktor tunggal dalam percaturan internasional mengalami pergeseran, dikarenakan munculnya berbagai subjek Hukum Internasional selain negara, yang dalam konteks ini adalah munculnya berbagai organisasi internasional, satu d i a n t a r a n y a U n i t e d N a t i o n s H i g h

Kemunculan organisasi internasional diperlukan dalam kerangka kerja sama menyesuaikan dan mencari kompromi untuk m e n e n t u k a n k e s e j a h t e r a a n s e r t a memecahkan berbagai persoalan bersama serta mengurangi pertikaian yang timbul.
Organisasi Internasional beserta alat p e r l e n g k a p a n n y a m e m p u n y a i h a k , kewajiban dan kekuasaan, sebagaimana dimiliki alat perlengkapan negara modern yang juga diatur oleh hukum konstitusi i n t e r n a s i o n a l ( M a u n a , 2 0 0 0 ) . P a t u t d i k e m u k a k a n , w a l a u p u n o r g a n i s a s i internasional baru muncul abad ke-19, akan tetapi perkembangannya yang sangat cepat setelah berakhirnya Perang Dunia II, antara lain memiliki ciri sebagai persekutuan antara negara-negara yang secara permanen, dengan tujuan yang sesuai dengan hukum, dilengkapi 275

Abstract
Royalty The Copyright Bill as a right of the license agreement which is the utilization of economic rights in return for a creation that is usually paid as compensation from the granting of permission or license from the copyright holder or owner to another party. The formula of the problem is how the Characteristics of Royalty of Copyright as Fiduciary Guarantee, and how the execution of Royalty of Copyright if the debtor defaults.The more successful the book, will the larger percentage of money acceptance also by the author of the book, and vice versa.So obvious that Royalty have economic value, so that includes the characteristics of an object that can be used as collateral for debt that is object if the object has an economic value and transferability hand over in terms of a time when the debtor cannot pay off the loan, these objects can be sold by the bank.

Abstrak
Royalti Hak Cipta sebagai hak tagihan dari perjanjian Lisensi yang merupakan imbalan atas pemanfaatan hak ekonomi suatu ciptaan yang dibayarkan sebagai kompensasi dari pemberian ijin atau lisensi dari pemilik atau pemegang hak cipta kepada pihak lain. Rumusan masalahnya adalah bagaimana Karakteristik Royalti Hak Cipta sebagai Jaminan Fidusia, dan bagaimana eksekusi Royalti Hak Cipta apabila debitor wanprestasi.Pembahasannya, bahwa semakin laku bukunya, akan semakin besar juga prosentase penerimaan uang oleh penulis buku, demikian juga sebaliknya.
Royalti memiliki nilai ekonomis tersebut, sehingga termasuk karakteristik suatu benda yang dapat digunakan sebagai obyek jaminan utang yaitu apabila benda tersebut mempunyai nilai ekonomis dan dapat dipindah tangankan dalam artian suatu saat apabila debitor tidak dapat melunasi utangnya, benda tersebut dapat dijual oleh bank.
Kata Kunci: Royalti, Hak Cipta, Fidusia.
A. Pendahuluan
1. Latar Belakang Permasalahan Perkembangan ekonomi kreatif telah mendorong seseorang yang mempunyai produktifitas untuk menghasilkan suatu karya cipta yang memberikan manfaat ekonomi atas ciptaannya. Atas hasil kreasi tersebut, masyarakat beradab mengakui bahwa yang menciptakan boleh menguasai untuk tujuan yang menguntungkan (Kholis Roisah,2015).
Ide, pikiran yang diwujudkan salah satunya berupa tulisan mempunyai hak cipta secara otomatis lahir saat diciptakan. Hak Cipta tidak melindungi ide, tetapi melindungi
ekspresi dari ide ( Mas Rahmah, Sinar Ayu Wulandari dan Fifi Junita, 2001 ).
H a l - h a l y a n g m e n c a k u p i l m u pengetahuan, seni dan sastra (art and literary) yang didalamnya mencakup pula program computer merupakan Hak Cipta. Pasal 1 ayat (1) Undang Undang Nomor 28 Tahun 2014 Tentang Undang – Undang Hak Cipta :
