Instruksi - Pilih satu perusahan berbasis teknologi.

- Dengan menggunakan konsep tata Kelola kekayaan intelektual dan manajemen inovasi, usulkan rancangan pengembangan produk selanjutnya dari perusahaan tersebut.

LUARAN Laporan disusun dalam argumentative paragraphs dengan memiliki informasi berikut (setidaknya) :

a. Deskripsi tentang perusahan tersebut.

b. Portfolio kekayaan intelektual serta manjemen inovasi.

c. Usulan rancangan kedepan.

Case study

A&M Records, Inc. v. Napster, Inc (2001)

• Napster provided a platform for users to access and download compressed digital music files, specifically MP3s, from other users' machines.

• Napster included a central server that indexed connected users and files available on their machines, creating a searchable list of music available across Napster's network.

• The district court preliminarily enjoined Napster

"from engaging in, or facilitating others in copying, downloading, uploading, transmitting, or distributing plaintiffs' copyrighted musical compositions and sound recordings, protected by either federal or state law, without express permission of the rights own.

• Sept-2001, Napster settled with songwriters and music publishers, agreeing to pay $26 million.

• May-2002. Napster files for bankruptcy

Apple Inc v. Creative Technology (2006)

• Apple infringed Creative's patent for the menuing structures on an MP3 player. Creative claimed it began using its menuing method on its Nomad players in September 2000, approximately a year prior to Apple's first iPod release in October 2001

• Apple agreed to settle their legal dispute over music player patents for $100 million.

• The $100 million, to be paid by Apple, grants Apple a license to a Creative patent for the hierarchical user interface used in that company's Zen music players

• As part of the agreement, Creative will also enter Apple's Made for iPod program as an authorized seller of iPod accessories. Creative will be able to affix the "Made for iPod" logo to its speakers, headphones and other related products.

Twitter v. Twittad (2009)

• 2009, Twitter tried to register the word “Tweet” as a trademark.

• Several other online companies had submitted applications that incorporated the same word. One company in particular stood out: Twittad. Twittad owned the rights to the phrase, “Let Your Ad Meet Tweets.”

• Twittad’s registered phrase and Twitter’s application both contained the word “Tweet,” the USPTO turned down Twitter’s mark on the grounds that it was “confusingly similar.”

• September 2011, both parties entered into a settlement agreement. Twittad agreed to transfer the rights of its phrase “Let Your Ad Meet Tweets”

to Twitter. This, in turn, allowed Twitter to continue with its application to register the term “Tweet.”
