Premarital Pregnancy For PrEfectional Teens Law and Psychology

Abstract: The phenomenon of pregnancy out of wedlock often occurs among teenagers; this happens due to many factors which, if generalized, are a combination of the consequences of promiscuity and the lack of parental observation of their child's association. so that without strict supervision, adolescents will do whatever is considered suitable by themselves without thinking about the consequences that will arise from their behavior. This research is a literature study with a qualitative type of research, namely observing premarital pregnant marriages and reviewing community legal compliance with applicable laws in Indonesia, especially regarding how pregnant marriage is legal and the impact on pregnant marriage actors. The results of this study are premarital pregnancy has a more dominant effect on women. Women often get legal injustice, so there is a need for clear and detailed special regulations regarding premarital pregnancy.

Abstrak: Fenomena hamil di luar nikah kerap terjadi di kalanga remaja, hal ini terjadi disebabkan oleh banyak faktor yang apabila digeneralisasi merupakan gabungan dari akibat pergaulan bebas serta kurangnya pengamatan orang tua terhadap pergaulan anaknya. sehingga tanpa adanya pengawasan yang ketat, remaja akan melakukan apapun yang dianggap benar oleh dirinya tanpa memikirkan akibat yang akan timbul dari perilakunya. Hal ini terjadi karena banyak pengaruh, baik dari pergaulan, sosial media yang begitu bebas sperti facebook, instagram, televisi dan beberapa media lainnya, yang apabila lengah dalam kontrol terutama bagi orang tua maka seringkali mengakibatkan kegagalan yang merusak masa depan anak itu sendiri terlebih bagi kalangan perempuan. Penelitian ini merupakan penelitian pustaka dengan jenis penelitian kualitatif yaitu mengamati kasus-kasus perkawinan hamil pra nikah dan juga meninjau kepatuhan hukum masyarakat terhadap hukum yang berlaku di Indonesia, khususnya tentang bagaimana hukumnya perkawinan dalam keadaan hamil serta

A. INTRODUCTION
Today's society seems to be experiencing a lot of problems in life. The reduction of public order has become a common thing because the law itself is considered unable to accommodate the needs of the community, in addition to the development of information technology that is increasing and used for interests in various aspects, including economic elements to promote its trade, education during pandemics that are indeed very dependent on media, as well as socio-cultural useful to explore community activities, So that it makes humans freer to express opinions, not even thinking about the consequences of the use of information technology. Social media has become a trend and will be considered a"kudet" (lack of updates) if someone does not have social media.
Social media has become a particular need for its users, ranging from teenagers, adults, even parents and babies also have personal accounts in various applications with various purposes. The function of social media in daily activities is very diverse, capturing crucial moments, making old friends, showing current activities, and using it for the benefit of various businesses. Social media is indeed had a lot of positive impact on its users. But not infrequently also cause an adverse effect and even drag users into the realm of law just because of a word or sentence that makes a person or group offended by these words.1
The development of information technology that can no longer be controlled brings a massive role in everyday life so that humans seem unable to live without coexisting with technology; for example, the use of social media is very rife among adolescents, online learning that occurred in this pandemic era forced school-age children to always use mobile phones, in addition to being used for education, It seems that the media is more widely used to open social media, if without intense supervision from parents in teenagers when exploring social media and finding new friends, is a pleasure in itself that makes teenagers forget the bad things that will happen to themselves and their families, to be willing to give up the crown of womanhood.2
An online association that is widely practiced by teenagers today will cause consequences for the perpetrator, for example, courtship behavior that entered the

dampak bagi pelaku perkawinan hamil. Adapun hasil penelitian ini adalah perkawinan hamil pra nikah memberikan dampak yang lebih dominan pada perempuan. Perempuan seringkali mendapatkan ketidakadilan hukum, sehingga perlu adanya peraturan khusus yang jelas dan rinci tentang perkawinan hamil pra nikah.

category as an act of adultery that resulted in extramarital pregnancy. This case has happened a lot in the community, and it is no longer taboo if the daughter is pregnant out of wedlock. Although actually in extramarital pregnancy, many consequences will be borne by the woman's family, among others: the status of the child conceived, the guardian of marriage when the child is born is a woman, serial marriage because it has not reached the age determined by law number 16 of 2019 on changes to law number 1 of 1974 on marriage, a divorce that can be done unilaterally because of the absence of marriage certificate as valid proof of marriage and There is also no right to demand a living iddah or gono gini property resulting from the wedding.
Forced marriage will significantly affect the mentality of both brides-to-be because the marriage is not based on sincerity between the two. Still, the union that occurs is the result of the deeds that have been done and only aimed to meet their biological needs. So it is not uncommon for a divorce to occur after the marriage agreement is completed because marriage is done only to find the status of women in society as well as the status of children in the view of society3. People's view of the negative things that occur due to extramarital pregnancy will undoubtedly put a very influential pressure on life, such as stress, excessive anxiety, disappointment in the couple, regret for his actions, etc. In contrast, pregnant and giving birth to adolescents in the view of health is still very vulnerable and at high risk because the reproductive space is not ready to be fertilized and is prone to miscarriage. 4In addition, the birthing process tends to be surgery because the mother's pelvis is still a narrow teenager, so there is an imbalance between the exit and the baby's head. It can also provide a deep sense of trauma due to the pain of childbirth with cesarean section.
In terms of psychology, pregnant adolescents out of wedlock, ready or not, have to carry out marriage or even do not carry out because there is no responsibility on the part of men. Unions carried out by teenagers will be very heavy because, at a young age where adolescence is the age of transition from children to adults, teenagers are considered not to have maturity in thinking. At the same time, women are required to do homework, take care of husbands and children. This is undoubtedly hefty morning women. 5 Being a housewife is not an easy thing for teenagers. She needs to adjust to new conditions in her life. In terms of physical, teenagers will feel tired and saturated because the routine will be much different from before the marriage. At the same time, psychologically, teenagers will also feel tired of preparing all household needs and can no longer socialize or play with their peers.
According to Basri in his work entitled caring for love that physically teenage boys and women have been able to have children. Still, from a psychological aspect, they are considered unable to sail the sea of household arks. Often young marriages due to

pregnancy do not last long and are also supported by the established social and economic order, even though the survival of a family needs such support. This is where teenage couples will experience depressed neuritis, a condition in which human feelings begin to be disturbed by sad symptoms accompanied by irregular eating and sleeping patterns, fatigue, restlessness, despair, helplessness, and even suicidal thoughts. To overcome many problems arising from extramarital pregnancy, the role of parents in adolescent supervision is crucial. In addition, parental control must also be a figure that can be used as an example by their children. 67In terms of psychology, early marriage is essential to be considered legally, but also crucial to discuss rather than the psychological aspect, where marriage is also not a few that cause trauma in adolescents because of various kinds of very severe impacts to bear.
The legal impact that can arise due to premarital pregnant marriage as an example of the age of the bride-to-be who has not reached the provisions of law number 16 of 2019 concerning changes to law number 1 of 1974 concerning marriage, this resulted in the teenage perpetrator of the pregnant marriage to perform a serial marriage, which Siri marriage is also not regulated definitively in the laws and regulations. In serial marriages performed by teenagers, the majority of losses will be borne by women. Women cannot claim any rights to the husband because the wedding cannot be authentically proven. So to get authentic evidence in the form of marriage certificates, serial marriage actors must file marriage confirmation at the Religious.8Court, because the marriage carried out by both brides-to-be has not reached the age specified by law.
Of the many problems that arise due to pregnant marriage, marriage is a legal action that will cause causation. So that the rise of the phenomenon of pregnant marriage in today's society is exciting to be used as a study material. So based on the background above, the research focuses on premarital pregnant marriage in law and psychology. With the study of pregnant marriage, it is expected that there is a legal development that can accommodate the case explicitly and can foster awareness for adolescents not to do things that violate the law and for parents to more intensively monitoring the development of children who have grown into teenagers with Wise, without applying pressure, because with good communication in the family will significantly minimize negative behaviors that are rife by teenagers.
B. RESEARCH METHODS
This research is a literature study(Library Research)which is a study through various data related to research topics that include primary data in the form of religious court decision data, books, books, and supporting data in the form of online news, magazines, newspapers and so on that have a direct relationship or not with the object of

research, namely pregnant marriage outside marriage.9This type of research is case research by collecting data and information in an incentive, holistic and systematic about an event in an individual or group. 10In the study of premarital pregnancy, marriage is indeed rife in Indonesia, especially in the pandemic period. Where teenagers are more often communicated through the media so that parents do not know it. So this can be the cause of the occurrence of premarital pregnant marriage.
The store used in this study is qualitative, which seeks a deep understanding of a symptom, problem, fact, or reality that includes actions and consequences in community life relationships. This is by observing cases of premarital pregnant marriage. 11In Indonesia and also reviewing the compliance of community law to applicable laws in Indonesia, especially about how the law of premarital pregnancy marriage and the psychological impact for pregnant marriage actors.
The data used in this study are primary and secondary data, namely data obtained from documentation, photos, and so forth, which are further carried out data analysis with data reduction measures, presentation or display data, and conclusions or verification. 12 It is namely selecting and presenting data related to research related to premarital pregnant marriage both in the form of cases from various media, books, and scientific papers, then analyzing legal and psychological perspectives, then making conclusions about premarital pregnancy in legal and psychological perspectives.
C. DISCUSSION
Factors that cause premarital pregnancy in adolescents
The definition of adolescent, according to poerwati, is a time when the occurrence of changes in adolescents aged 9-15 years, both male and female, adolescents will experience changes in their body shape, and fertilization will likely happen occur in the reproductive space. Adolescent development occurs not only in the body but also in emotions, behaviors, interests, and roles. Because at this time, teenagers enter the phase of finding identity, so it is not uncommon for adolescence when various problems begin to arise.1314
One of the problems that arise is when a woman begins to know the opposite sex, so there is an attraction between two people who love and love each other so that sometimes because of the sense of taste that is so deep, women are willing to give their pride to men who capitalize on sweet words. The result is an unexpected pregnancy because the pregnancy occurs before the marriage.
Premarital marriage is a phenomenon that is very difficult for society to accept because it violates the norms that apply in the community and is a disgrace that will tarnish the good name of the family forever. Internal and external factors cause premarital

marriage in adolescents—internal factors such as knowledge, attitude, and personality.
External factors are the environment in which teenagers live.
In general, the factors that cause extramarital agreements include:

Speaking of love, it seems that it will be difficult to define it because love is a feeling that arises from the heart and will make someone who is beset by love forget themselves and make whatever becomes his, including surrendering himself to someone he loves. So that this love factor becomes the most common factor for pregnancy outside of marriage.
Channeling biological desire
The age of teenagers who have experienced changes in the body and changes in hormones that encourage teenagers to channel their desires to the opposite sex. So if there are no limits in terms of directing his desires will pose a risk to his life. Especially in women, adolescent girls who have sexual intercourse are most likely to get pregnant, so this becomes one of the factors in the occurrence of pregnancy outside of marriage.
We are not getting the blessing of parents.
The blessing of parents is the essential thing to have a relationship with the opposite sex. Teenagers whose emotions are still up and down are sometimes less good at communicating and put their feelings first. So teenagers prefer a shortcut that impregnates their partners before marriage—because of the final compulsion of parents approved because there has been an accident that is pregnancy in his daughter where the child in the womb needs status in the community environment. Whether you want to or not, like it or not, parents should marry off their children to people who have impregnated them.
Environmental and Media Factors
The environment has a significant influence on the development of children, and children will imitate the good and bad behavior of people around so that families, especially parents, have an essential role in maintaining and shaping children's behavior. In addition to the current environment, western films often witness indecent scenes where the spectacle makes teenagers see sexual scenes. Such locations are considered so enjoyable that teenagers desire to do what is done in the media. Practice in real life without thinking about the consequences.
Economics
Poverty makes it difficult for people to get an excellent education, so the lack of education (sex education) and sexual education from an early age is significant to learners to avoid sexual harassment. In addition, the knowledge of sex will also reduce the association of free sex because economic factors will make some people perform sexual support to get material.15
The above factors make the high number of premarital pregnant marriages in the community. In addition, it also causes high rates of domestic violence that impact the high number of divorces in premarital pregnant marriages. The high number of divorces will cause problems, namely young widows who sell themselves because of economic factors.

These children are displaced due to the lack of affection of both parents, and there are still many problems that will continue.
Legal Analysis of Pre-Nuptial Maternity Marriage for Adolescents
The increasing number of marriage dispensation advocates in religious courts continues to increase. One of the causes is pregnancy out of wedlock, and it dominates because of the high number of early marriage dispensaries. These phenomena can be seen in the data over the last three years, especially during the Covid-19 pandemic. In 2019 in the Surabaya religious court, there is always a marriage dispensation application almost every month because there has been a pregnancy. This was conveyed by ecclesiastical courts Surabaya publicist Agus Suntono to the Jawa pos subaraya reporter.16
In 2020 in the Blitar Religious Court, the application for marriage dispensation had increased relatively high. As many as 408 marriage dispensation cases filed, 20% are cases caused by a pregnancy out of wedlock. The ministry of religious affairs of the Blitar regency said that this happened because of their children's lack of parental supervision during the pandemic. 17 In 2021 in Lamongan Religious Disbursion, 237 teenagers applied for marriage dispensation. Although not all cases are filed due to extramarital pregnancies, most occur due to pregnancy factors. Mazir submitted this data as a young clerk of the Lamongan religious court.18
Some of the above case exposure over the past three years during the covid-19 pandemic proves an increase in extramarital pregnant marriages in adolescents. Cases that have been banyak befall this teenager will certainly cause consequences on him and his family, among others, due to law, psychology, and customs that apply in the community. 19 From the exposure of data during the period 2019-2021, it can be concluded that there is an increase in marriage dispensation applications, the majority of which are caused by pregnancy. In addition to the rise in marriage dispensation cases, there is also an increase

in the number of divorces during the pandemic due to domestic violence (KDRT) due to economic factors. The high rate of pregnant marriages and divorces in the pandemic period has a close relationship. Violence occurs due to a lack of maturity in terms of mental and economical that causes a person's emotions to change. This change will have legal consequences.
Talking about the law indeed leads to regulations made to create a law order because the function of the law is actually as a guard, regulator, and producer of order. Achieving ranking in society does not seem as easy as turning the palm because order means encompassing and accepting complex communities. This implies that this complexity becomes the basis for law order. The phenomenon of pregnant marriage that often occurs among the public becomes one problem that violates public order, so the law must regulate the problem. 2021to create order. 22The technique of regulating order in the community will vary according to the regulations set by local environmental officials. For example, it is reporting and limiting the arrival of guests who visit more than 24 hours.
When a case occurs, it will be identified immediately.
Related to extramarital marriage in the law that applies in Indonesia is not explicitly regulated in Law No. 1 of 1974 on marriage, in the marriage law article 2 paragraph 1 which reads "marriage is legal if done according to the law of each religion and its beliefs"
from the sentence of article 2 paragraph 1 of this marriage law it can be concluded that premarital pregnant marriages performed by teenagers can be said to be valid during the marriage. The wedding is performed by religion and has fulfilled the legal requirements of marriage.23
In addition, the agreement on pregnant marriage has also been regulated in the Compilation of Islamic law article 53, which reads, "paragraph (1) A pregnant woman out of wedlock, can be mated with the man who impregnated her. Verse (2) Marriage with a pregnant woman referred to in paragraph (1) can be performed without waiting for the birth of her child. (3) With the marriage taking place at the time of the pregnant woman, no reparation is required after the child is born. 24 The law governing pregnant marriage is the Compilation of Islamic Law. However, although the law has only been regulated as one solution to the problems caused by premarital pregnant marriage to get justice and create order to solve the many issues that arise, it takes other sciences that can accommodate the problem, such as sociology, anthropology, and psychology.25
The development of various disciplines has a relatively real impact on the law. Other fields help understand the presence and workings of law in society. A phenomenon that occurs in a community such as teenage premarital marriage is one case that can create a rule. The law does not come from humans and humanity, so discussing the law is always

preceded by discussing society. 26 This means that the regulation on pregnant marriage is caused by cases in the community, and various factors that cause the occurrence of pregnant marriage to be a consideration for creating laws and regulations.
This proves that it does not mean after discussing humans and humanity and then turning to legal discussions without looking at the problems in humans. But humanity always flows through the dynamics of the law so that the law does not apply to itself, but more than that, the law can serve and preserve humanity. So that the unification of the law with humans and society is expected to be a goal in the dynamics of life, namely justice. 27The regulations that have been created are expected to provide justice to the litigable party.
In fact, in the case of pregnant women often do not get justice, marriage is carried out sirri because the age has not reached the limits set by law if it does not apply for marriage dispensation to the Religious Court. In other cases, women must experience domestic violence that leads to divorce or even bullying because of the unexpected tenancy because they are not mentally prepared, even though the law in Indonesia has regulated domestic violence. However, in practice, there are still many who are not aware of the regulation. These facts show clearly that women never get injustice in the case of pregnant marriage out of wedlock. So that future legal developments should regulate strictly pregnant marriage with very detailed requirements and criteria to create justice and order for all levels of society.2829
Premarital Pregnancy in Professional Psychology
The law has governed premarital pregnancy marriages. So that with clear rules, women and their children will not experience physical and psychological disorders in their lives. Because pregnant women out of wedlock can cause stress on themselves, this happens because they feel guilty about the things that have been done, namely sex that causes unexpected pregnancies, then also a feeling of fear to convey the case that happened to her parents. These problems then make psychological disorders in pregnant women who are in 30Fact is underage or immature.
Teenagers who are pregnant out of wedlock have indeed had sexual intercourse before marriage. This case occurred not only because of mutual love but also because of violent and economic factors. However, it is not uncommon for women who experience violence during courtship to maintain their relationships because of sexual intercourse and love. This means that women today are willing to give the crown of womanhood because of love even though they have experienced physical violence. In addition, teenagers who are pregnant premaritally will have good times with their peers because of the shame of what has occurred their lives and have to care for their children. Indeed, pregnant teenagers out of wedlock will experience regret after knowing how busy it is to be a wife

and mother, even though she still wants to continue her studies. This is where the role of parents is very influential on the behavior of children who have been teenagers, namely to maintain good communication to avoid the impact that will occur in the life of teenagers.
D. CONCLUSION
Premarital pregnancy has happened a lot from time to time, but the development of the times and technology today makes the case increasing every year. Several factors cause the issue of premarital pregnancy: love, channeling natural desires, not getting the blessing of parents, the environment, media, economy, and so on. Adolescence is indeed a period of transition from children to adults. This is when it begins to develop both in terms of physical, emotional, and social. So that in this phase, teenagers want to show their identity and often do not realize the legal consequences that will occur due to their actions.
In the case of premarital pregnancy, marriage is a disgrace to the family, and it will be difficult for the public to forget the event. As a result, the pressure on the psychic aspect is alarming for teenagers who have been pregnant before marriage, while men often blame women. This fact shows clearly that women never get injustice in the case of marriage pregnant out of wedlock. So that future legal developments should regulate strictly pregnant marriage with very detailed requirements and criteria to create justice and order for all levels of society. Women are not always victims of what they do together.
