Masalah-Masalah Hukum (MMH) is an academic journal for Legal Studies published by Faculty of Law, Universitas Diponegoro. It aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning Indonesian laws and legal system.

Masalah-Masalah Hukum (MMH) published periodically (January, April, July and October) in English and Indonesia articles, approved and ready-to-publish manuscripts will also be regularly published in the website (with early view) and the hardcopy version will be circulated at the end of every period.

Nationally Accredited (2017) by the Director General of Strengthening Research and Development, Ministry of Research, Technology, and Higher Education Republic of Indonesia Decision No. 32a/E/KPT/2017, Masalah-Masalah Hukum (MMH) is one of the most reputable legal journals in Indonesia.

As one of the oldest legal journals in Indonesia, Masalah-Masalah Hukum (MMH) is one of the scienti c references in the eld of law. This can be seen in the high number of citations and the impact factor of this journal. In its 50th publication number in 2021, Masalah-Masalah Hukum (MMH) continues to be committed to improving its governance and quality, so that it remains one of the leading legal journals in Indonesia.

Abstract

Gold is a very valuable thing. For centuries, people regarded gold as a precious metal, and chosen as the ultimate investment. Some illegal investment management and investment ventures have targeted people who had high interest in gold as their investment. This paper will analyze on how people could invest in gold and how to protect gold investor from any fraud in gold investment. This is an empirical legal research. The research shown that investor could invest into gold by bought gold jeweler, in the value of 22 carat, 18 carat, 12 carat, gold bullion in the value of 24 carat, gold coin in the value of 22 carat or gold future trading by online system. The fraud in gold investment had been done by the investment ventures that had not delivered the physical form of the gold protection for investors are set up by the OJK (Otoritas Jasa Keuangan / the Financial Services Authorities) by build the Investment Allert Task Force, SiPeka and FCC. Still the enforcement of those authorities are not optimized yet.

Abstrak

Emas, suatu benda yang sangat bernilai. Selama berabad-abad telah diakui sebagai logam mulia, yang mendapatkan tempat tertinggi sebagai pilihan investasi masyarakat. Investor-investor yang tergiur dengan keuntungan maksimal yang ditawarkan dari berinvestasi pada emas inilah yang menjadi sasaran empuk para pengelola investasi emas illegal. Keadaan tersebut memunculkan beberapa masalah dalam naskah ini, antara lain mengenai bentuk investasi emas dan bentuk perlindungan hukum bagi para investor yang terlibat dalam penipuan investasi emas. Metode penelitian dalam penelitian ini adalah yuridis empiris, dengan teknik purposive sampling. Hasil penelitian yang diperoleh adalah investasi emas dapat dilakukan dengan berbagai cara antara lain melalui pembelian emas perhiasan dengan kadar 22 karat. 18 karat dan 12 karat, emas batangan dengan kadar 24 karat, emas koin dengan kadar 22 karat dan berinvestasi emas secara tidak langsung atau berjangka dengan sistem online. Penipuan investasi emas dilakukan oleh para pengelola jasa investasi emas yang tidak menyerahkan emas dalam bentuk fisik kepada para investor dan memakai sistem money game atau skema ponzy untuk menarik minat para calon investor.

A. Pendahuluan

Emas, suatu benda yang sangat bernilai.

Selama berabad-abad telah diakui sebagai logam mulia, yang mendapatkan tempat tertinggi sebagai pilihan investasi masyarakat.

Emas merupakan simbol kemakmuran, melambangkan kekayaan dan kebangsawanan.

Bangsa Lydia mencetak koin-koin emas dengan standarisasi kadar emas yakni campuran 63% emas dan 27% perak, yang kemudian dikenal sebagai electrum. Standar kadar emas inilah yang memastikan koin emas bangsa Lydia diterima secara luas dan memicu digunakannya emas sebagai alat tukar. (Nawaz n.d.) Selama berabad-abad banyak kebudayaan di seluruh dunia mengakui dua hal tentang emas, daya tarik dan nilainya yang tinggi. Emas merupakan satu-satunya logam yang tidak akan beroksidasi dalam suhu ruangan, menjadikannya logam yang tidak akan pernah berkarat dan mudah ditempa.(Richard 2006) Emas juga dikenal akan sifat elastisitasnya yang luar biasa. Tidak ada logam lain yang mampu menandingi daya daktilitas emas. Satu butir emas berukuran 5mm mampu di tempa menjadi lembaran tipis emas berukuran 0.5m persegi atau ditarik hingga membentuk kawat

emas sepanjang 50cm. Dijaman modern, emas telah menemukan peranan baru dalam berbagai bidang industri dan kedokteran.

Emas banyak digunakan sebagai pelapis barang-barang industri karena sifatnya sebagai konduktor dan permukaannya mampu merefleksikan sinar infra merah.(Demidova- menzel, Nadeshda 2007)

Berinvestasi dalam bentuk emas telah dilakukan orang selama berabad-abad. Para raja dan bangsawan pada mulanya menyimpan emas sebagai simbol kekuasaan.

Tetapi kebanyakan dari mereka hanya

menggunakan emas untuk keperluan upacara

dan bahan baku perhiasan. Logam mulia

menjadi komoditas yang bisa diterima oleh

semua suku bangsa dan ras. Emas dan perak

menjadi alasan untuk mulainya perang dan

mengakhiri perang pula. Masyarakat selama

berabad-abad mereka menyadari bahwa emas

bersama perak adalah dua jenis komoditi yang

akan diterima secara luas oleh berbagai

bangsa.(Demidova-menzel, Nadeshda 2007)

Perlahan namun pasti semakin banyak orang

memperoleh akses kepemilikan emas. Melalui

perdagangan misalnya. Pada saat emas

dinyatakan sebagai alat pembayaran yang sah,

Abstract

Ratification of 1949 Geneva Convention with Law No. 59/1958 incurs obligation for Indonesia to implement Red Cross emblem provisions.. The Presidential Decree Number 25/1950, Peperti Number 1/1962, Article 6 paragraph(3b) of Law Number 15/2001 concerning Trademarks, and Article 508-

individuals and institutions. This paper discusses legal politics development in the formation of rules in period of 2010-2018. Analysis shows political factors and normative factors in the form of conflicting legal products are influenced by social-ideological factors that identify the Red Cross emblem with a particular religion. Therefore, legal product must be consistent with each other and adjust socio-political and ideological influences in line with Pancasila and 1945 Constitution.

Abstrak

Ratifikasi Konvensi Jenewa 1949 dengan Undang-Undang Nomor 59 Tahun 1958 mewajibkan Indonesia mengimplementasikan ketentuan tentang lambang Palang Merah. Adanya Keppres RIS Nomor 25 Tahun 1950, Peperti Nomor 1 Tahun 1962, Pasal 6 ayat(3b) Undang-Undang Nomor 15 Tahun 2001 tentang Merek, dan Pasal 508-565 KUHP dianggap tidak memadai mengingat masih terdapat pelanggaran baik oleh perorangan maupun lembaga. Tulisan ini membahas perkembangan politik hukum dalam pembentukan aturan tentang lambang dalam periode 2010-2018. Berdasarkan analisis, faktor politik yang tercermin dalam partai politik dan faktor normatif berupa produk hukum yang saling bertentangan, dipengaruhi faktor sosial- ideologi yang mengidentikkan lambang Palang Merah dengan agama tertentu. Oleh karena itu setiap produk perundang-undangan harus tetap memperhatikan konsistensi dengan perundang- undangan lainnya dan menyesuaikan pengaruh sosial politik dan ideologi sejalan dengan Pancasila dan UUD 1945.
