Apa itu wadiah?

Lafadz wadi’ah mengikuti wazan ‘’failah’’,berasal dari madhi ‘’wada’a’’ dan ‘’wadiah’’.secara bahasa berarti barang yang dititipkan .sedangkan menurut syara’ adalah harta yang ditinggalkan pada

penguasaan orang lain dengan tujuan penjagaan tanpa upah.

Dalil Al-qur’an

ّنِا ٖۗهِب ْمُكُظِعَي اّمِعِن َ ااا ّنِا ِۗلْدَعْلاِب ا ْوُمُكْحَت ْنَا ِساّنلا َنْيَب ْمُتْمَكَح اَذِا َو ۙاَهِلْهَا ىٓالِا ِتان امَ ْلا اوّد َؤُت ْنَا ْمُكُرُمْأَي َ ااا ّنِا ا ًرْي ِصَب ۢ اًعْيِمَس َناَك َ ااا

۝٥٨

artinya:Sesungguhnya Allah menyuruh kamu menyampaikan amanah kepada pemiliknya. Apabila kamu menetapkan hukum di antara manusia, hendaklah

kamu tetapkan secara adil. Sesungguhnya Allah memberi pengajaran yang paling baik kepadamu. Sesungguhnya Allah Maha Mendengar lagi Maha Melihat.

(Sesungguhnya Allah menyuruh kamu untuk menyampaikan amanat) artinya kewajiban-kewajiban yang dipercayakan dari seseorang (kepada yang berhak menerimanya) ayat ini turun ketika Ali r.a. hendak mengambil kunci Kakbah dari Usman bin Thalhah Al-Hajabi penjaganya secara paksa yakni ketika Nabi saw. datang ke Mekah pada tahun pembebasan. Usman ketika itu tidak mau memberikannya lalu katanya, "Seandainya saya tahu bahwa ia Rasulullah tentulah saya tidak akan menghalanginya."

Maka Rasulullah saw. pun menyuruh mengembalikan kunci itu padanya seraya bersabda, "Terimalah ini untuk selama-lamanya tiada putus-putusnya!" Usman merasa heran atas hal itu lalu dibacakannya ayat tersebut sehingga Usman pun masuk Islamlah. Ketika akan meninggal kunci itu diserahkan kepada saudaranya Syaibah lalu tinggal pada anaknya.

Tafsir ayat-tafsir jalalain

Ayat ini walaupun datang dengan sebab khusus tetapi umumnya berlaku disebabkan persamaan di antaranya (dan apabila kamu mengadili di antara manusia) maka Allah menitahkanmu (agar menetapkan hukum dengan adil. Sesungguhnya Allah amat baik sekali) pada ni`immaa diidgamkan mim kepada ma, yakni

nakirah maushufah artinya ni`ma syaian atau sesuatu yang amat baik (nasihat yang diberikan-Nya kepadamu) yakni

menyampaikan amanat dan menjatuhkan putusan secara adil.

(Sesungguhnya Allah Maha Mendengar) akan semua perkataan (lagi Maha Melihat) segala perbuatan

Dari kisah diatas walaupun permulaan ayat ini diturunkan disaat Allah memerintahkan

kepada rosul Saw untuk mengembalikan kunci ka’bah kepada utsman bin thalhah,namun

cakupan dari ayat ini mnyeluruh untuk

memberikan semua amanah kepada yang

berhak,dan termasuk dari amanah adalah

barang titipan (wadiah).

،ُةَعيِد َوْلا َكِلَذ ْنِم َو ،ى َوْقّتلا َو ِرِبْللا ىَللَع ِدُعاَسّتلا َو ِدُهاَعّتلاِب َنيِنِم ْؤُمْلا ُهَناَحْبُس َرَمَأ ْيَأ ،ِةَياَقِوْلا َنِم ى َوْقّتلا َو ،ِهِللُك ِرْيَخْلِل ٌعِماَج ٌمْسا ّرَبْلا ِذِإ :ِبَذْعَتْسُمْلا ِمْظّنلا يِف لاَق ) .ِة َرِخْلا يِف ِباَذَعْلا َنِم َو اَيْنّدلا يِف ىَذَْلا َنِم َناَسْنِْللا يِقَي اَم
