Auction Notice

Sealed quotations are invited from interested individuals/firms for Auction of condemned items like laboratory equipments, farm equipments/implements/motor parts/furniture/electrical items etc. (as per list attached) of the centre.

Particulars of dates for tender procedure:

a. Last date 11^th June 2018, Upto 13.00 hrs.

b. Date of opening quotations. 11^th June 2018, At 15.00 hrs.

Terms and conditions

1. The envelope containing quotations along with the documents should be super scribed as

"Quotation for Auction of condemned articles" and addressed to the Joint Director, ICAR Research Complex for NEH Region, Manipur Centre, Lamphelpat, lmphal-795004.

2. This office shall not be responsible for any delay in postal transit. No bid shall be accepted after the due date and time fixed. If the due date is declared as Central Government Holiday, the bid due date will be next working day at the same time noticed as above.

3. Earnest Money Deposit (EMD) of Rs. 5000/- (Five Thousand) only and Tender fee of Rs. 500/- (Five Hundred) only separately should be deposited to this office in the form of Banker cheque/demand draft drawn in favour of Joint Director, ICAR Manipur Centre, Imphal.

4. Bid should be signed by bidder /himself/ themselves or a person duly authorized in this behalf.

A copy of such authority should be enclosed along with the offer.

5. Bid forms are not transferable.

6. Bid will be opened on the same day i.e. on 11^th June 2018, At 15.00 hrs. If the date of opening of bids happen to be holiday, then the bids shall be opened on the next working day on the same time.

7. Overwriting or alternation will also disqualify the bid unless these are legibly attested by bidder /bidders.

8. The GST and other levy if any will have to paid by the successful bidder.

9. It will be presumed that the bidders before submitting the offer have read carefully all the terms and conditions and accepted the same in full. Deviations from the terms and conditions as given in this are not permitted. Any such conditional bid and /or telegraphic bid is liable to be rejected and no alternations shall be allowed after the bid is submitted. No counter terms and condition shall be accepted.

10. Right to include any other conditions or modify or alter any of bid conditions already stipulated and the right to accept or reject any quotation without assigning any reasons thereof are reserved by the Joint Director.

11. Bidder will be deemed to have been on the clear understanding then they have satisfied themselves full in regard to the conditions, quality and quantity of unserviceable stores proposed to be disposed off.

12. The successful bidders will be required to make full payment of bid by bank draft/ pay order drawn on any nationalized bank in favour of Joint Director, ICAR Manipur Centre, Imphal within two days thereafter. Earnest Money Deposit shall be forfeited if payment in full is not made or the offer is withdrawn during the validity period.

13. The successful bidder will have to lift the unserviceable stores items within seven (7) days after depositing the full bid amount as per terms and conditions of the bid. Deliveries shall be affected against receipt of payment. Any purchaser failing to lift the material within the above stipulated period, shall have to pay ground rant @ 10% of tendered value per week. The Institute will not be responsible for any loss or damage of the unserviceable items.

14. Earnest Money Deposited shall forfeited if any purchaser fails to lift the items after making full payment and expiry of period as mentioned above. Thereafter ICAR Manipur Centre shall be entitled to resell these items. No notice shall be issued to the bidder in this regard.

15. The purchaser will not be entitled to resell any or all-unserviceable items while.

16. They are still within the premises of ICAR Manipur Centre and no delivery would be affected by ICAR Manipur Centre to any person or persons other than the purchaser / purchasers whose name /names are mentioned in the delivery order.

17. The successful bidder before actually collecting purchased unserviceable items should contact the Joint Director, ICAR Manipur Centre to get the gate pass and delivery of unserviceable materials.

18. Loading, handling, labour and transportation shall be sole responsibility of the purchaser at his own cost, and arrangement.

19. Loading and lifting of the auctioned goods shall be done by the purchaser only during the prescribed working hours of the Institute No deliveries shall be affected during Sunday or Holiday.

20. The Joint Director, ICAR Manipur Centre reserve the right to accept or reject any or all offer/bids either in full or in part without assigning any reason whatsoever.

21. If, sufficient bids are not received, the Joint Director, ICAR Manipur Centre reserve the right to call for fresh bids. In such an event Earnest Money Deposited by the bidder shall be refunded.

22. The Earnest Money Deposited by the successful bidder shall be refunded in full without any interest.

23. The successful bidder shall be responsible for any damage that may be done to the premises while removing the goods by him. The Joint Director, ICAR Manipur Centre may be at his own options ask to repair such damages and buyer shall have to pay for the same on demand.

24. Disputes arising, if any on the contract will be settled by mutual consultation and in case of failure of settlement dispute shall be referred to the sole arbitrator to be appointed by the Director, ICAR Research Complex for NEH Region, Umiam, Meghalaya or Joint Director, ICAR Research Complex for NEH Region, Manipur Centre, Imphal. The decision of the sole arbitrator so appointed shall be final and binding on both the parties. Arbitration proceedings shall be governed by the Arbitration & Constitution Act, 1996. Otherwise, all dispute arising related to this contract will be settled in the Court of Law at Imphal, Manipur.
