Die Vorschriften vom bemessenen Strafmaß für die mehrere Delikte

Im geltenden Strafrecht gibt es nicht nur diejenige Strafmaßtatbestandsvorschriften, die das Strafmaß für das einzige Delikt bemessen, sondern auch diejenige Strafmaßtatbestandsvorschriften, die das Strafmaß für die mehrere Delikte bemessen.

Zu den Strafmaßtatbestandsvorschriften, die das Strafmaß für die mehrere Delikte bemessen, gehören eben die Vorschriften über die sog. Realkonkurrenz bzw. die Irrealkonkurrenz die sog. zusammengesetzte Delikte, die erfolgsqualifizierte Delikte, den räubrischen Diebstahl.

Die Vorschriften über die sog. zusammengesetzte Delikte, die erfolgsqualifizierte Delikte, den räubrischen Diebstahl regeln eigentlich über die umfassende Bemessung des Sstrafmasses für die mehrere Delikte, nicht aber über den Unrechtstatbestand desjenige einzigen Delikts, das durch mehrere einzelne Delikte gemischt besteht.

Mehrere Delikte werden nach der Handlungszahl zwischen den unter der Realkonkurrenz stehenden Delikten und den unter der Irrealkonkurrenz stehenden Delikten unterschieden. Das Maßstab für die Entscheidung der Handlungszahl, durch die zwischen der die Realkonkurrenz und der Irrealkonkurrenz unterschieden wird, ist die Zahl des unabhängigen Ansetzens.

Wenn die mehrere einzelne Delikte im Verhältnis von der Realkonkurrenz oder der Irrealkonkurrenz stehen und sich aufeinander zeitlich und räumlich beziehen, wird statt des Stafmasses für die Realkonkurrenz oder die Irrealkonkurrenz das Strafmaß angewendet, das die Vorschriften über die sog. zusammengesetzte Delikte, die erfolgsqualifizierte Delikte, den räubrischen Diebstahl bestimmen.
