THE LAW RESEARCH INSTITUTE. 초대의 글 우리나라 기업들의 해외투자가 꾸준하게 증가하면서 현지에서의 노동분쟁 도 늘어나고 있습니다. 이에 따라 현지경영에서 효율적이고 안정적인 노무 관리가 갈수록 중요해지고 있습니다. 그러나 아무리 노무관리를 잘 한다고 하더라도 노동분쟁의 발생은 어쩔 수 없습니다. 최근 중남미지역에서 발생 하는 노동분쟁은 정신적 폭력(moral harassment), 아웃소싱, 재택업무 등 그 원인도 다양합니다. 노동분쟁 해결제도의 연구는 이제 현실적으로 중요한 당면과제가 되었습니다. 중남미국가들은 노동법원과 노동 검찰을 두는 등 우리와는 상당히 다른 노동분쟁해결제도를 갖고 있습니다. 이에 우리나라의 투자진출이 활발한 브라질, 아르헨티나, 멕시코, 페루 등 4 개국의 법무실무가들을 모시고 “중남미의 노동법제 현황과 노동 분쟁해결 제도”라는 큰 공통주제를 놓고 우리나라 법제와 비교연구를 통해 상호 공통 점과 차이점을 파악하고자 하는 자리를 마련했습니다. 아무쪼록 이번 학술 대회가 중남미 국가들의 노동분쟁 해결제도를 연구하는데 초석이 되고 실 무적으로도 도움이 될 수 있는 자리가 될 수 있도록 모든 분들의 참여와 성 원을 부탁 드립니다.. 계경문 소장 (한국외대 법학연구소) 김유환 원장 (한국법제연구원). INVITATION As Korean companies’ overseas investment increases steadily, there should be increasing local labor disputes also. Accordingly, efficient and reliable labor management is found to be important factor for successful investment. However, no matter how efficient is labor management, labor disputes are inevitable. Labor disputes can happen for a variety of reasons which include recently moral harassment, outsourcing, home office, etc. in Latin America. Here is the reason why we should study labor dispute settlement system. By studying the different ways of settlement system, we can learn better ways for labor management. Many Latin American countries have been established labor courts, including Argentina, Brazil and Mexico. Judicial labor intervention in the region shows the idea that the State should assist in labor conflict resolution. Labor dispute settlement system of these countries shows significant difference to our system. To share knowledge, we invite scholar-practitioners from four countries, Argentina, Brazil, Mexico and Peru. The “Labor Law and Labor Dispute Resolution System in Latin America” co-organized by the Korea Legislation Research Institute and the Law Research Institute of Law School, will be a important event that provides opportunities for experts to share knowledge by understanding and discussing differences and commonalities of dispute resolution systems.
