Bulacan State University assumes no responsibility whatsoever to compensate or indemnify bidders for any expenses incurred in the preparation of the bid. Government-owned or controlled corporations (GOCCs) may only be eligible to participate if they can establish that they (a) are legally and financially autonomous, (b) operate under commercial law, and (c) are not affiliated agencies under BULACAN STATE UNIVERSITY . a) The Bidder shall have experience of having executed a Single Largest Completed Contract (SLCC) corresponding to this project, corresponding to at least fifty percent (50%) of the ABC, if necessary adjusted by the Bidder to current prices using Philippine Statistics Authority (PSA) consumer price index.

Bidder’s Responsibilities

Failure to fulfill any of the above responsibilities will be at the risk of the relevant Bidder. The BULACAN STATE UNIVERSITY shall not assume any responsibility regarding erroneous interpretations or conclusions drawn by the prospective or eligible bidder from the data provided by the BULACAN STATE UNIVERSITY.

Origin of Goods and Services

Bidders shall be deemed to have familiarized themselves with all applicable laws, decrees, ordinances, acts and regulations of the Philippines which may in any way affect the contract before submitting bids. The Bidder shall bear all costs associated with the preparation and submission of its bid, and BULACAN STATE UNIVERSITY shall in no event be liable for such costs, regardless of the course or outcome of the bidding process.

Subcontracts

However, BULACAN STATE UNIVERSITY will ensure that all information in the tender documents, including supplementary/tender bulletins issued, are correct and consistent. The Bidder must note that BULACAN STATE UNIVERSITY will only accept bids from those who have paid the applicable tender documentation fee at the office specified in the invitation to bid.

Supplementary/bid bulletins may also be issued at the BULACAN STATE UNIVERSITY's initiative for purposes of clarifying or amending any provision of the bid documents not later than seven (7) calendar days before the deadline for the submission and receipt of bids. Submission and Opening of Bids 21. Deadline for Submission of Bids

Late Bids

Bid envelopes that are not properly sealed and marked as required in the bidding documents shall not be rejected, but the bidder or his duly authorized representative shall acknowledge such condition of the bid as submitted. BAC or BULACAN STATE UNIVERSITY assumes no responsibility for misplacing the contents of the improperly sealed or marked bid, or for its premature opening.

Modification and Withdrawal of Bids

No bid may be withdrawn in the interval between the deadline for submission of bids and the expiration of the bid validity period specified by the Bidder in the Financial Bid Form. Withdrawal of a bid during this interval shall result in the forfeiture of the Bidder's bid bond, pursuant to Section 18.5 of the ITB, and the imposition of administrative, civil and criminal sanctions as prescribed by RA 9184 and its IRR.

Opening and Preliminary Examination of Bids

The read summary of bids and minutes of bid opening are available to the public upon written request and payment of a specified fee to reimburse the cost of materials. The notice will be issued within seven (7) calendar days from the date of bid opening.

Evaluation and Comparison of Bids 25. Process to be Confidential

Clarification of Bids

Based on the detailed evaluation of the bids, the bids that meet the above requirements will be ranked in ascending order of their total calculated bid prices, as evaluated and corrected for calculation errors, discounts and other changes, to identify the lowest calculated bid. . Post Qualification

Within ten (10) calendar days from receipt of the Notice of Award, the successful Bidder shall post the required performance security, sign and date the contract and return it to the BULACAN STATE UNIVERSITY. Within seven (7) calendar days from the date of approval of the Contract by the appropriate government approval authority, the BULACAN STATE UNIVERSITY shall issue the Notice to Proceed (NTP) together with a copy or copies of the approved contract to the successful Bidder.

Bid Data Sheet

The values ​​of the domestic bidder's current assets and current liabilities must be based on the most recent audited financial statements (AFS) submitted to the BIR. Relevant statement of the bidder's single largest completed contract (SLCC) corresponding to the contract to be tendered.

Interpretation

Communications

Possession of Site

The Contractor shall bear all costs and charges for special or temporary right-of-way required by him in connection with access to the site. The Contractor shall also provide at his own cost any additional off-site facilities required by him for the purposes of the Works.

The Contractor’s Obligations

The contractor submits to BULACAN STATE UNIVERSITY for approval the name and information about the person authorized to receive instructions on behalf of the contractor. BULACAN STATE UNIVERSITY may change the schedule of other contractors and shall notify the contractor of any such change.

Performance Security

Should anything of historical or other interest or of significant value be unexpectedly discovered on the site, it shall be the property of BULACAN STATE UNIVERSITY. The Contractor shall notify the BULACAN STATE UNIVERSITY representative of such discoveries and carry out the instructions of the BULACAN STATE UNIVERSITY representative in dealing with them.

Subcontracting

The Contractor will extend the validity period of the performance security to cover approved contract time extensions. Unless otherwise indicated in the SCC, the Contractor, by entering into the Contract with the BULACAN STATE UNIVERSITY, acknowledges the right of the BULACAN STATE UNIVERSITY to bring action pursuant to Act 3688 against any subcontractor, whether an individual, firm, partnership , corporation, or association that provides the Contractor with labor, materials and/or equipment for the performance of this Contract.

Liquidated Damages

The total amount of damages may not exceed ten percent (10%) of the contract amount. If the target completion date is extended after payment of damages, the BULACAN STATE UNIVERSITY Engineer will correct any overpayment of damages by the Contractor by adjusting the next payment certificate.

Site Investigation Reports

The Contractor shall pay liquidated damages to BULACAN STATE UNIVERSITY for each day that the completion date is later than the intended completion date. Once the cumulative amount of liquidated damages reaches ten percent (10%) of the amount of this Contract, BULACAN STATE UNIVERSITY may cancel or terminate this Contract, without prejudice to other remedies and remedies available under the circumstances.

The Procuring Entity, Licenses and Permits

The applicable damages shall be at least one-tenth (1/10) percent of the cost of the unexecuted portion for each day of delay.

Contractor’s Risk and Warranty Security

All liabilities of the State Government in his favor shall be set off against reimbursement of expenses. The warranty for structural defects/defects other than those caused by force majeure shall cover the period specified in the SCC from the date of issuance of the Certificate of Final Acceptance by BULACAN STATE UNIVERSITY.

BULACAN STATE UNIVERSITY if this Contract is revoked due to the Contractor's non-payment. thereafter accrues to the BULACAN STATE UNIVERSITY and/or the Contractor. In the event of the Contractor's insolvency, any Contractor's Equipment that the BULACAN STATE UNIVERSITY instructs in the notice must be used until the completion of the Works;.

Procedures for Termination of Contracts

It shall give written notice to the Contractor of its decision and, unless otherwise provided in said notice, this contract shall be deemed terminated upon receipt of notice of the decision by the Contractor. All decisions recommended by the DRC will be subject to the approval of the President of BULACAN STATE UNIVERSITY.

Force Majeure, Release From Performance

In the absence of the CPES evaluation sheet, the existing performance monitoring system of the procuring entity will be applied. The net balance of the obligation will be paid or settled within a reasonable period of time from the time of notice of termination.

Resolution of Disputes

If the event continues for a period of eighty-four (84) days, either party may then give notice of termination, which will be effective twenty-eight (28) days after the notice. After termination, the contractor is entitled to payment of the unpaid balance of the value of the works performed and of the materials and plant reasonably delivered to the site, adjusted by the following:. a) any amount to which the contractor is entitled under GCC clause 28;.

If the Contractor incurs costs as a result of any of the events under clause 13 of the GCC, the Contractor shall be entitled to the amount of such costs. If as a result of any of the events mentioned, it is necessary to vary the Works, this will be treated as a variation.

Early Warning

Program of Work

The approval of the work program by the representative of BULACAN STATE UNIVERSITY shall not alter the contractor's obligations. When the work program is updated, the contractor will provide the BULACAN STATE UNIVERSITY representative with an updated cash flow forecast.

Management Conferences

The Contractor shall submit an updated work program to the BULACAN STATE UNIVERSITY representative for approval at intervals not exceeding the period specified in the SCC. The contractor may change the work program at any time and resubmit it to the BULACAN STATE UNIVERSITY representative.

Bill of Quantities

If the Contractor does not submit an updated Work Program within this period, the representative of BULACAN STATE UNIVERSITY may withhold the amount specified in the SCC from the next proof of payment and continue to withhold this amount until the next payment after the date the due Work Program is submitted. If requested by the BULACAN STATE UNIVERSITY Representative, the Contractor shall provide the BULACAN STATE UNIVERSITY Representative with a detailed cost breakdown of any rate in the Bill of Quantities.

Instructions, Inspections and Audits

If the final quantity of work performed differs from the quantity in the BOM for the specific item and does not exceed twenty-five percent (25%) of the original quantity, provided that the total changes for all items do not exceed ten percent (10%) of the contract price, the BULACAN STATE UNIVERSITY representative will make the necessary adjustments to accommodate the changes, subject to applicable laws, rules and regulations.

Correction of Defects

Period which is one (1) year from the end of the project to the final acceptance by the representative of BULACAN STATE UNIVERSITY. If BULACAN STATE UNIVERSITY accepts the offer, the corresponding change in SCC is a variation.

Uncorrected Defects

Each time a notice of defect is given, the contractor shall correct the notified defect within the time specified in the notice to the representative of BULACAN STATE UNIVERSITY. If BULACAN STATE UNIVERSITY deems that the correction of the defect is not essential, it may request the contractor to submit an offer for an appropriate reduction in the contract price.

Advance Payment

The contractor may reduce its stand-by letter of credit or guarantee instrument by the amounts reimbursed by the monthly receipts in advance. BULACAN STATE UNIVERSITY will provide an advance payment for the contract price as specified in the contract conditions, subject to the maximum amount specified in Article 39.1 of the SCC.

Progress Payments

Payment Certificates

BULACAN STATE UNIVERSITY will provide an advance payment for the contract price as specified in the contract conditions, subject to the maximum amount specified in Article 39.1 of the SCC. The Contractor shall submit to the BULACAN STATE UNIVERSITY representative monthly statements of the estimated value of the work performed less the cumulative amount previously approved. Retention

The Contractor shall submit monthly statements of the estimated value of the work performed minus the cumulative amount previously certified to the BULACAN STATE UNIVERSITY's Representative. Upon completion of the entire Works, the Contractor may replace retention money with an "on demand" Bank Guarantee in a form acceptable to the BULACAN STATE UNIVERSITY.

Variation Orders

Failure to provide any such notice within the time specified shall constitute a waiver by the contractor of any claim. The time frame for processing variation orders from preparation to approval by the concerned BULACAN STATE UNIVERSITY shall not exceed thirty (30) calendar days.

Contract Completion

Once the project reaches a performance of ninety-five (95%) of the total contract amount, BULACAN STATE UNIVERSITY may establish an inspection team to conduct a preliminary inspection and submit a punch list to the contractor in preparation for the final turnover of the project . However, this does not exclude BULACAN STATE UNIVERSITY's claim for damages.

Suspension of Work

An authorized representative of the UNIVERSITY that the documents are complete, unless there are excusable reasons for this, which he communicates to the contractor in writing. Completion

Except for extraordinary circumstances as determined by NEDA and approved by the GPPB, price escalation is not permitted. GENERAL CONDITIONS PART 1.0 GENERAL

It consists of furnishing all materials, labor, equipment, transportation, incidentals, facilities, and supervision necessary to complete the project in accordance with the true intent of these specifications and contract drawings. In the event of any ambiguity or discrepancy in the plans and specifications, the Contractor shall refer the matter to the Project Management Office of Bulacan State University for proper explanation or necessary correction before any adjustment is made.

MATERIALS

The Contractor shall, for the approval of the Architect and Owner, provide all samples when instructed to do so. These must be submitted within twenty-five (25) days of the contract award. Any failure by Contractor to conform or use materials not specified herein will be subsequently disclaimed.

WORKMANSHIP

Specifications, or when required by the Architect, the Contractor shall provide, for approval, full information and satisfactory evidence of the type and quality of the materials or articles which he will include in the work. Any change or revision in the use of material without the approval of the Architect shall make the Contractor responsible and liable in terms of warranty, workmanship and defects.

SUPERVISION AND INSPECTION

The method and all materials and equipment used therein are subject to inspection, testing and approval by the Owner. Three sets of “As-Built Plans” of the project in question, duly signed and sealed by the Engineer-in-Charge of Construction, shall be submitted as a requirement for final acceptance of the work.

The contractor ensures that the project will be under the constant supervision of a competent supervisor who will be present at the construction site at all times during working hours. The existing state of the work site is documented and photographs are taken before the start of work to ensure such a state, and any damage to surfaces due to ongoing work is repaired at the contractor's expense.

GENERAL

Except as otherwise provided in this contract, all disputes regarding questions of fact arising under this contract shall be decided by the Architect, whose decisions shall be final and conclusive as to the parties with respect to questions of fact. The Contractor shall place and maintain the concrete forms to ensure that after the forms are removed and before repair and finishing, no part of the concrete work will exceed any of the specified tolerances.

GENERAL 1.1 Description

EXECUTION
