Government-owned or controlled corporations (GOCCs) may only be eligible to participate if they can establish that they are (a) legally and financially autonomous, (b) operating under commercial law, and (c) not attached agencies of the BULACAN STATE is not. Origin of Goods

Award of Contract 31. Contract Award
Signing of the Contract
Within ten (10) calendar days of receipt of the award notice, the successful bidder shall post the required performance bond, sign and date the contract and return it to BULACAN STATE UNIVERSITY. BULACAN STATE UNIVERSITY will enter into a contract with the successful Bidder within the same ten (10) calendar day period provided that all documentation requirements are met.
Performance Security

Use of Contract Documents and Information
The performance bond posted in favor of BULACAN STATE UNIVERSITY will be forfeited in the event that the winning bidder is found to be in default of any of its obligations under the contract. In the event of a reduction in the value of the contract, BULACAN STATE UNIVERSITY shall permit a pro rata reduction of the original performance bond, provided that any such reduction shall not exceed ten percent (10%) and the aggregate of such reductions shall not exceed fifty percent (50%) of the original performance bond.

BULACAN STATE UNIVERSITY will immediately notify the Supplier in writing of any claims arising under this warranty. Delays in the Supplier’s Performance
In order to ensure that manufacturing defects will be rectified by the Supplier, a warranty from the Supplier will be required for a minimum period specified in the SCC. The obligation for the guarantee will be covered by, at the Supplier's choice, either retention money in an amount equal to at least one percent (1%) of each progress payment, or a special bank guarantee equal to at least one percent (1%) of the total Contract Price or other such amount if so specified in the SCC.

In the event that the BULACAN STATE UNIVERSITY terminates this Contract in whole or in part, for any of the reasons provided in terms of GCC Clauses 23 to 26, the BULACAN STATE UNIVERSITY may, on such terms and in such manner as it deems appropriate , goods or Services similar to those not supplied, and the Supplier shall be liable to the BULACAN STATE UNIVERSITY for any extra costs for such similar Goods or Services. In the event that the delay in the delivery of the Goods and/or performance of the Services exceeds a period of time equal to ten percent (10%) of the specified contract time plus any extension of time duly granted to the Supplier, may terminate the BULACAN STATE UNIVERSITY. this contract, forfeit the supplier's performance security and assign it to a qualified supplier.

If the Supplier incurs losses in the initial performance of the terminated contract, such as the purchase of raw materials for goods specially manufactured for BULACAN STATE UNIVERSITY and which cannot be sold on the open market, it may recover part of this Contract on a quantum meruit basis .
