The Dutch DPA may ask for a copy of the customs declaration and accompanying documents to check whether the exemption was correctly requested at the time of import. If the correct ITAR exemption was not claimed on the customs declaration, the CBP will detain the export shipment.

AES and the FTR (Foreign Trade Regulations)

Did you know that it is against the regulation (15 CFR 30.60) if you share the AES information with foreign entities. Here we read that in a routed export, the USPPI has the right to request a copy of the written authorization given by the FPPI to the U.

Best Practices: Routed Exports Transactions

The government requires the USPPI to act with due diligence, reasonable care and supervision and control of the export process. Ask the freight forwarder for a copy of the written authorization or power of attorney given to them by the FPPI authorizing them to file the AES on their behalf.
