INTRODUCTION AND OVERVIEW OF THE STUDY

BACKGROUND OF THE STUDY

The theory of good governance is not practiced in Kwazulu-Natal Provincial Government. The broader objective of this study is to review and discuss the state of governance in the Kwazulu-Natal Provincial Authority.

FRAMEWORK OF CHAPTERS

Some public officials did not fully understand the concept of governance as practiced in this province. This enables the maximum degree of participation of citizens in the management and administration of the country.

THE CONCEPT OF GOVERNANCE

The other main application of the concept of governance is within international institutions and regimes. The fourth use of the concept of governance concerns the growth of new public management strategies since the early 1980s.

The concept of governance is an innovation of the new South Africa (Van Niekerk et al. Government mass support: it is an important element of a government's capacity.

ROLES AND RATIONALE OF GOVERNANCE

The debate about the role of the state in society and in governance has been driven by several different developments (Pierre.

New public management is the theory of the latest paradigm shift in how the public sector should be governed (Lane, 2000:3). Autonomy from connection with the state is reflected in the self-organizing nature of the networks and in the capacity of the state to direct and manage. The diagram below, Figure 2.1, presents some of the main themes of the new governance framework in relation to the 'New Public Management' perspective.

New public management is the most visible sign of the rapid changes in perspectives on how government should manage the public sector.

One of the most important constitutional provisions in the central area of ​​governance is public access to and involvement in the National Assembly. In relation to the White Paper section 31, openness and transparency are the hallmarks of democratic governments and are fundamental to the public service transformation process. Pursuant to Section 192 of the Basic Law, an independent authority must be established to regulate broadcasts in the public interest. This commission is empowered under Article 185 of the Constitution to monitor, investigate, research, advise and report on matters relating to the rights of cultural, religious and linguistic communities.

If the members of the Commission find any violation, they can report it to the Human Rights Commission.

GOVERNANCE AND ITS CONTEXT IN AFRICA

Freedom of expression and association were also enshrined in the constitutions of most African countries at independence, but were not respected in most countries. In some countries, coalitions of civil society organizations have continued to play an active role in nurturing democratic political culture. The active role that these organizations play in social, political and economic areas has significant consequences for the functioning of governance systems and structures.

Legitimacy is the acceptance by the people of the government:-Jt's authority to exercise power.

NATURE AND CHARACTERISTICS OF GOOD GOVERNANCE

Definitions of good governance

The AAPAM conference report highlighted that there have been several attempts to define the concept of good governance. Good governance is defined as the exercise of political, economic and administrative authority in the management of a country's affairs at all levels (AAPAM, 2000: 24). Good governance and sound public sector management form the most important mechanisms of social transformation and the cornerstones of successful economies (ECA Report, 1999: 1).

Gildenhuys and Knipe say that good governance means that the government achieves its ultimate goal.

According to Adamolekun, the reshuffle of government has four main features, namely (a) a reduction in the role of the state in national economic governance. b) a strengthened role for subnational governments; c) a new public-private balance in the production and supply of goods and services; and (d) efforts to achieve improved performance in public management. A goal of improved performance in public management is often associated with the reduced role of the state in controlling everything. The questions about the role and scope of the state in good governance seem to be very critical in most countries for three reasons.

The second reason relates to the nature of the environment within which the state in Africa rules.

PRINCIPLES OF GOOD GOVERNANCE

The quality of the physical environment within which the individual lives, works, does business and relaxes is satisfactory and not fraught with all kinds of dangers that threaten his or her life. If the government cannot meet these requirements, a good quality of life for all citizens will never be achieved. There are basic principles, maintain Gildenhuys and Knipe (2000:91), which the government must adhere to in order to meet these requirements.

The following economic principles that the government should adhere to in order to achieve good governance (Gildenhuys and Knipe.

  • Effectiveness and efficiency
  • Accountability

All citizens must be equal in the eyes of the law and subject to the law. Good governance requires that institutions and processes strive to serve all stakeholders within a reasonable time frame. Good governance means that processes and institutions deliver results that meet the needs of society while making optimal use of the resources at their disposal.

The concept of efficiency in the context of good governance also covers the sustainable use of natural resources and the protection of the environment.

INDICATORS OF GOOD GOVERNANCE

They help reflect the preferences of the public as citizens and consumers in the public domain. Public accountability underlines the superiority of public will over private interests for those engaged in providing and delivering services to the general public. Third, accountability is one of the five standards for good or better governance; the others are efficiency, transparency, predictability or the rule of law and legitimacy.

Financial accountability, which deals with control and monitoring resources that feed on government administrative machinery.

UNDERSTANDING GOOD GOVERNANCE

Nothing breeds contempt and distrust of public representatives, political office holders and civil servants more than the belief among citizens that public officials act to enrich themselves rather than to advance the interests of the public (Haque cited in Sing, 1999: 94). . One of the central aspects of good governance is the acceptance, promotion and application of democratic principles. Good governance assumes that the implementation of public services is the implementation of public policies aimed at providing concrete services to citizens.

The fifth change is from a closed bureaucratic-dominated work environment in the public service to a more transparent, accountable and participatory public policy process.

MEASURES TO ENHANCE GOOD GOVERNANCE

According to Molomo and Somolekae (in Hope & Somolekae) the advancement of good governance and service delivery in the world in general, and in Africa in particular, is an issue that has been on the agenda of bilateral aid programs of Western democracies since the early 1980. Efforts to facilitate good governance and improve service delivery have also been complimented by international non-governmental organizations (Molomo & Somolekae. Accountability is an ethical concept that must be treated seriously in any discussion of good governance and service delivery.

Service delivery – Government must be engaged in efforts to improve the delivery of basic services such as education, roads and telecommunications.

BATHO PELE PRINCIPLES AND GOOD GOVERNANCE

Citizens should be consulted about the level and quality of the public services they receive and, whenever possible, should be given the opportunity to choose the services offered. Citizens should be told how national and provincial departments are run, how much they cost and who is responsible. Public services should be provided economically and efficiently to give citizens the best possible value for money.

National and provincial departments should specify the standards for the way customers should be treated.

DEVELOPING INSTITUTIONS FOR ENHANCING GOOD GOVERNANCE

A relatively new trend in the field of governance, and more specifically in services, is the role of the private sector as a partner in the public sector. The purpose of the King 11 Report is to promote the highest standards of corporate governance in South Africa. Raise awareness of the Protected Disclosures Act (more commonly referred to in South Africa as the whistleblowing legislation) (Business Report, 2 October 2003:4).

Although the seriousness of the problem is acknowledged, according to the PSC report it is virtually impossible to give an accurate assessment of the state of ethics in South Africa. Much has already been done in this regard, especially through the implementation of the Public Financial Management Act, Act No 1 of 1999 (PFMA). Some of the bodies, such as the Auditor General, have managed to achieve good performance levels.

The creation of the Annual Award for Public Sector Reporting by the Southern African Institute of Government Auditors is a welcome initiative supported by the PSC.

This chapter has attempted to assess progress towards good governance in South Africa and Africa as a whole. 34. Good governance and effective sustainable development require visionary and responsible leaders, effective and accountable public servants, a responsive NGO community, understanding of international partners and also a vibrant private sector.” Development policies need to be encouraged and strengthened so that a good governance agenda can be adopted.

On the issue of good governance, traditional patterns of public service delivery in South Africa will have to change.
