I, the undersigned,
PAUL MICHAEL JENKINS
state under oath as follows:
1 I am an adult male and the Chairman of Caxton and CTP Publishers and Printers Limited (“Caxton”), the third applicant.
2 The facts contained in this affidavit fall within my personal knowledge and are both true and correct.
3 I have the requisite authority to depose to this affidavit on behalf of Caxton.
Caxton was an appellant before the Competition Appeal Court (“CAC”) under the above case number.
4 This affidavit is filed in support of the founding affidavit deposed by Mr William Bird on behalf of Media Monitoring Africa (“MMA”).
5 I have read Mr Bird's founding affidavit and confirm the contents thereof insofar as they relate to Caxton.
6 I support MMA's application for leave to appeal. I also share Mr Bird's view that this matter raises constitutional issues of considerable public importance as it is imperative that the Competition Commission be empowered to conduct a full investigation into the agreement entered into between the first and second respondents.
