I, the undersigned

SIFISO KHUMALO

do hereby make an oath and say:

I am a Senior State Advocate employed by the National Prosecuting Authority at the Gauteng Local Division, Johannesburg.

The facts contained herein are within my personal knowledge and are both true and correct.

The Respondent’s Heads of Argument were not filed timeously because the Legal Aid offices were closed earlier on Friday the 2nd and I was informed by the Appeals manager of my office that the Constitutional Court will not

accept the documents for filing unless same had first been served on the opponents.

4.

As a result the documents were served and filed on Monday the 5th June 2017. I humbly apologize for the delay in filing the said documents.
