NOTICE OF APPLICATION FOR LEAVE TO APPEAL

TAKE NOTICE THAT the above-mentioned applicants for leave to appeal (“the applicants”) intend to apply to this Court for an order in the following terms:

1 Granting leave to appeal against the whole of the judgment and order of the North Gauteng High Court delivered in the above matter on 6 December 2012 (under case number NGHC 22645/2011);

2 Directing that the costs of this application be costs in the appeal.

TAKE NOTICE FURTHER that the accompanying founding affidavit of Dario Milo and confirmatory affidavits of Nicholas Adrian Michael Dawes, Janet Seeber (neè Smith) and Tim du Plessis are annexed in support of the application.

TAKE NOTICE FURTHER that within ten (10) days from the date upon which this application is served on them, the respondents may respond thereto by affidavit, indicating whether or not they consent to leave to appeal being given and, if the application is opposed, the grounds for such opposition.

TAKE NOTICE FURTHER that the applicants have appointed the offices of their attorneys of record set out below as the address at which they will accept notice and service of all documents in these proceedings.
