DIRECTIONS DATED 20 AUGUST 2013
The Chief Justice has issued the following directions:
1. The application for leave to appeal is set down for hearing on Wednesday, 20 November 2013 at 10h00.

2. The parties are directed to submit by Friday 06 September 2013 an agreed statement based on the factual findings of the High Court, setting out the facts that are necessary for this Court to determine the issues before it.
3. Should the parties be unable to agree on a statement of facts as envisaged, they are required to provide –
(i) the draft statement proffered by each party;
(ii) the facts that are common to each statement;
(iii) the factual findings about which they could not agree; and
(iv) the precise portions of the record that relate to the disputed findings.
4. The matter will be heard on the record provided to the Court on 7 August 2013 and the statement/s of fact provided in terms of paragraph 3.
5. Written argument must be lodged by:
(i) the Applicants on or before Friday, 13 September 2013; and (ii) the Respondents on or before Friday, 20 September 2013.
6. Written argument must include argument on the merits of the appeal, and must, specifically, also address the question whether the issue of the cancellation of the agreement could be determined separately from the issue of restitution of past performance under the agreement.
7. Further directions may be issued.
