DIRECTIONS DATED 21 JUNE 2004

The Chief Justice has given the following directions concerning the above matter:

1. The appeal against the decision of the Honourable Mr Justice Bozalek given in the above matter in the Cape of Good Hope Provincial Division of the High Court on 31 May 2004 is set down for hearing before the Constitutional Court at 10 a.m.

on 7 September 2004. If argument is not concluded on 7 September, it will continue on 8 September 2004.

2. The appeal record must be prepared in accordance with the requirements of rule 19 and lodged by the Appellant’s attorneys by not later than 30 June 2004.

3. The question whether or not the order made by the Honourable Mr Justice Bozalek should be confirmed, as required by section 167(5) of the Constitution, will be dealt with at the same time as the appeal.

4. Written argument shall be lodged as follows:

On behalf of the appellants and parties opposing the confirmation of the order of constitutional invalidity, by not later than 15 July 2004.

On behalf of the respondents, and parties supporting the confirmation of the order of constitutional invalidity, by not later than 29 July 2004.
