FURTHER DIRECTIONS DATED 31 AUGUST 2009

The Chief Justice has issued the following further directions in this matter:

1. The parties are required to lodge brief written submissions, by no later than Friday 4 September 2009, indicating their position on whether or not an order in the following terms should be made:

a. The application for leave to appeal is removed from the roll of Tuesday 15 September 2009.

b. The application for leave to appeal is set down for hearing on Thursday 5 November 2009 at 10:00.

c. The second, third and fourth respondents are regarded as having been joined in these proceedings as from 28 July 2009.

d. Given the undertaking by the Member of the Executive Council for Local Government and Housing, Gauteng (the MEC), to take a decision on the application to have the Harry Gwala Informal Settlement upgraded, the MEC must notify this Court and the parties of his decision, by no later than Tuesday 22 September 2009.

e. The parties are required to lodge brief written submissions on the effect on the merits of the case, if any, of the decision referred to in paragraph 3 above. These submissions shall be lodged on behalf of:

i. the applicants by 1 October 2009; and

ii. the respondents by 8 October 2009.

2. Further directions may be issued in this matter in due course.
