Facilities
1. Spesies Ikan hias yang rentan terhadap satu atau lebih
penyakit yang tercantum dalam Directive 2008/53/EC dan merupakan bagian dari closed ornamental facilities hanya dapat diekspor ke Uni Eropa dari negara-negara ketiga, wilayah, zona atau kompartemen yang tercantum dalam Lampiran I.
2. Closed ornamental facilities termasuk diantaranya adalah
dari hasil penangkapan alami dan dalam budidayanya telah dilengkapi dengan sistem pengelolaan limbah yang bertujuan untuk mengurangi risiko transmisi penyakit ke perairan alami.
3. Spesies ikan hias yang tidak rentan terhadap salah satu
penyakit yang tercantum dalam Directive 2008/53/EC, termasuk di dalamnya moluska dan krustasea hias, ditujukan sebagai closed ornamental facilities, hanya dapat diekspor ke Uni Eropa dari negara ketiga atau wilayah:
a. adalah anggota dari Organisasi Dunia untuk
Kesehatan Hewan (OIE), atau
b. tercantum dalam Lampiran I dan memiliki perjanjian
formal dengan OIE untuk secara teratur
menyampaikan informasi mengenai status kesehatan hewan mereka kepada anggota organisasi tersebut.
4. Pengiriman hewan akuatik sebagaimana dimaksud dalam
ayat 1 dan 2 harus:
a. disertai dengan sertifikat kesehatan hewan sesuai dengan model yang ditetapkan dalam Lampiran II butir
B dan penjelasan dalam Lampiran III,dan
b. memenuhi persyaratan kesehatan hewan yang ditetapkan dalam model sertifikat dan penjelasan, sebagaimana dimaksud dalam butir (a).
C. Hewan Akuakultur dan Produk-Produknya ditujukan untuk Konsumsi Manusia
1. Budidaya hewan akuatik dan produk-produknya yang ditujukan untuk konsumsi manusia hanya dapat diekspor ke Uni Eropa dari negara-negara ketiga, wilayah, zona atau kompartemen yang termasuk dalam daftar yang disusun sesuai dengan Pasal 11 (1) Peraturan (EC) No 854/2004 .
2. Kiriman dari hewan dan produk-produk sebagaimana
dimaksud pada ayat 1 harus:
a. disertai dengan sertifikat kesehatan hewan sesuai dengan model yang relevan sebagaimana yang ditetapkan dalam Lampiran VI (EC) No 2074/2005, dan
b. memenuhi persyaratan kesehatan hewan dan catatan
yang ditetapkan dalam model sertifikat serta
persyaratan yang ada, sebagaimana dimaksud dalam butir (a).
Berdasarkan Commision Directive 2008 53 EC, daftar penyakit dan spesies yang rentan dan disyaratkan oleh Uni Eropa dapat dilihat pada tabel 1 berikut.

D. Transportasi Hewan Akuakultur
1. Hewan akuakultur yang akan diekspor ke Uni Eropa tidak diangkut dalam kondisi yang dapat mengubah status kesehatannya. Secara khusus, tidak diangkut dalam air yang sama atau micro-container dari status kesehatan yang lebih rendah, atau yang tidak dimaksudkan untuk ekspor ke Uni Eropa.
2. Selama transportasi ke Uni Eropa, hewan akuakultur tidak dibongkar dari wadah dan air di mana mereka diangkut. 3. Pengiriman hewan akuakultur yang diangkut melalui laut
ke perbatasan Uni Eropa, addendum untuk transportasi hewan akuakultur hidup melalui laut, diselesaikan sesuai dengan model yang ditetapkan dalam Butir D Lampiran IV, dan dilampirkan sertifikat kesehatan hewan yang relevan.
E. Persyaratan untuk Pelepasan Hewan Akuakultur dan Produk-Produknya
1. Hewan Akuakultur dan produk-produknya yang diekspor ke Uni Eropa dan dimaksudkan untuk konsumsi manusia harus ditangani dengan tepat untuk menghindari kontaminasi perairan alami di Uni Eropa
2. Hewan Akuakultur yang diekspor ke Uni Eropa tidak akan dilepaskan ke alam liar, kecuali disahkan oleh pejabat yang berwenang di tempat tujuan .
Pihak berwenang hanya dapat memberikan otorisasi di mana pelepasan tidak membahayakan status kesehatan hewan air di tempat pelepasan dan harus memastikan bahwa langkah-langkah mitigasi risiko yang diambil sudah tepat .
3. Air bekas transportasi dari kiriman barang harus ditangani dengan tepat untuk menghindari kontaminasi perairan alami.
VI. PERSYARATAN UNTUK TRANSIT A. Transit dan penyimpanan
Kiriman hewan hidup Akuakultur dan telur ikan yang ditujukan untuk negara ketiga, baik oleh angkutan atau melalui
Community, atau setelah penyimpanan, harus memenuhi
persyaratan yang ditetapkan dalam Bab IV. Sertifikat yang menyertainya harus menggunakan kata-kata 'untuk transit melalui EC'. Kiriman juga harus disertai dengan sertifikat yang diperlukan oleh tujuan negara ketiga.
Namun, jika kiriman dimaksudkan untuk konsumsi manusia, mereka harus dilengkapi dengan sertifikat kesehatan hewan diselesaikan sesuai dengan model yang ditetapkan dalam Bagian C dari Lampiran II dan penjelasan dalam Lampiran III.
B. Pengurangan untuk Transit melalui Latvia, Lithuania dan Polandia
1. Transit melalui jalan darat atau dengan kereta api antara
pos-pos pemeriksaan perbatasan di Latvia, Lithuania dan Polandia yang tercantum dalam Lampiran Keputusan Komisi 2001/881/EC, kiriman datang dari dan untuk Rusia, secara langsung atau melalui negara ketiga lainnya, harus memenuhi persyaratan sebagai berikut: a. pengiriman tersebut disegel dengan segel yang telah
memiliki serial nomor yang berasal dari dokter hewan resmi di perbatasan pos pemeriksaan masuk;
b. dokumen yang menyertai pengiriman tersebut,
sebagaimana diatur dalam Pasal 7 Directive 97/78/EC, yang dicap dengan kata-kata 'Hanya untuk transit ke Rusia melalui EC' pada setiap halaman oleh inspektur resmi di perbatasan inspeksi pasca masuk;
c. persyaratan prosedural yang diatur dalam Pasal 11 dari Petunjuk 97/78/EC dipatuhi, dan
2. Audit reguler dilakukan oleh pejabat yang berwenang
untuk memastikan bahwa jumlah kiriman, sebagaimana dimaksud dalam ayat 1, dan jumlah produk saat
meninggalkan Community sesuai dengan jumlah dan kuantitas memasuki Community.
VII. KETENTUAN LAINNYA YANG BERHUBUNGAN DENGAN PENGIRIMAN
HC yang akan dikeluarkan oleh pejabat yang berwenang

dalam ketentuan peraturan dalam COMMISION

eksotik, maupun eksotik, dan untuk konsumsi manusia sesuai persyaratan negara tujuan yang telah disepakati,
Health certificate maupun surat keterangan yang
menjelaskan tempat asal dan cara budidaya ikan/ moluska/krustasea yang akan dikirim
Setiap lembar sertifikat maupun surat keterangan lainnya
menggunakn kertas khusus, asli merupakan satu bagian utuh yang tidak terpisah-pisah bernomor halaman, yang diberi stempel, dan ditandatangani inspektur pada setiap lembarannya
Health Certificate maupun surat keterangan menggunakan bahasa resmi yang dimengerti oleh kedua negara, atau bisa menggunakan bahasa negara pengekspor yang diberi terjemahan
Health Certificate harus diselesaikan dan ditandatangani
oleh inspektur resmi tidak lebih dari 72 jam sebelum pemuatan kiriman, atau tidak lebih dari 24 jam untuk ikan
budidaya dan diperiksa dalam waktu 24 sebelum jam loading. Pejabat yang berwenang dari negara asal harus memastikan bahwa prinsip-prinsip sertifikasi setara dengan yang diatur dalam Petunjuk 96/93/EC diikuti
Health Certificate yang dikeluarkan untuk ikan hidup
(budidaya) berlaku selama 10 hari dari tanggal penerbitan. Untuk transportasi dengan kapal laut, waktu validitas diperpanjang pada saat perjalanan di laut. Untuk itu, deklarasi asli dari master kapal dibuat sesuai dengan
addendum, disusun sesuai dengan model yang
ditetapkan, serta dilampirkan dengan health certificate.
VIII. Persyaratan Pelabelan
A. Pelabelan dan Persyaratan Kemasan untuk Live Bivalve Moluska
Semua paket pengiriman moluska hidup harus diberi label sehingga pusat pengiriman asli/asal dapat diidentifikasi setiap saat selama transportasi dan distribusi hingga penjualan eceran . Informasi berikut harus ditampilkan secara permanen dan dibaca :
• negara pengirim,
• spesies kerang moluska (nama umum dan nama ilmiah), • nomor registrasi,
• tanggal packing, terdiri dari setidaknya hari dan bulan. Label harus mencakup informasi lain yang berlaku untuk semua produk ikan. Informasi ini dapat dicetak pada bahan pembungkus atau diletakkan pada label yang terpisah yang
kemudian ditempelkan ke bahan pembungkus atau dimasukkan ke dalam pembungkus. Label perekat diri tidak boleh digunakan, kecuali mereka tidak dilepas. Semua jenis label hanya untuk sekali penggunaan dan tidak dapat dialihkan.
Label harus tahan lama, tahan air, serta informasi yang disajikan harus dapat dibaca dalam karakter yang mudah dipahami dan tidak dapat dihapus. Moluska hidup harus dibungkus dalam kondisi yang telah memenuhi persyaratan kebersihan.
Bahan pembungkus atau wadah harus:
tidak merusak karakteristik organoleptik dari moluska
hidup,
tidak menularkan zat berbahaya bagi kesehatan manusia
melalui moluska hidup,
cukup kuat untuk memberikan perlindungan yang
memadai terhadap molluska hidup,
Tiram harus dibungkus dengan shell cekung ke bawah. Semua pembungkus dari moluska hidup harus disegel, dan tetap disegel dari pusat pengiriman sampai diterima oleh konsumen atau pengecer. Semua produk tersebut harus diberi label yang jelas dengan pernyataan: moluska live untuk konsumsi manusia langsung, tidak akan dilepaskan di perairan
Community. Semua produk tersebut harus dikemas dalam
kemasan dengan ukuran yang cocok untuk penjualan eceran ke restoran atau langsung ke konsumen.
Negara-negara anggota lain mungkin memiliki persyaratan tambahan. Eksportir harus menghubungi pembeli mereka untuk menentukan apakah ada persyaratan tambahan khusus dari negara tujuan yang diterapkan untuk moluska, echinodermata, tunicates atau gastropoda laut hidup.
B. Pelabelan dan Persyaratan Kemasan untuk Ikan dan Produk Lainnya
Paket dan kontainer untuk semua produk perikanan yang diekspor ke Uni Eropa harus diberi label.
Informasi ini harus berada dalam jarak dekat, mudah dipahami dan ditandai di tempat yang mencolok sedemikian rupa agar mudah terlihat, terbaca jelas dan tidak dapat idihapus, serta informasinya harus jelas. Untuk semua produk yang akan diekspor ke Uni Eropa, bahan yang digunakan untuk menampung dan melindungi produk harus disertai dengan nomor dan nama negara tujuan.
