6.2 Rekomendasi dan Implikasi Kebijakan

Penentuan produk yang akan diretaliasi dapat mengacu pada hasil perhitungan Indeks Komposit Produk Prioritas Retaliasi dengan memprioritaskan pada produk yang memiliki nilai indeks komposit tertinggi. Pemilihan produk retaliasi menggunakan metode indeksasi masih dalam tahapan awal (proses screening) sehingga perlu telaah lebih lanjut yang melibatkan seluruh stakeholder terkait, baik dari pengusaha maupun pemerintah. Masukan dari para stakeholder sangat penting untuk mengetahui kondisi riil industri penghasil maupun industri pengguna produk yang akan diretaliasi dan faktor-faktor lain yang tidak tertangkap dalam indeks. Selain itu, masukan stakeholder dapat digunakan untuk menyempurnakan pembentukan indeks komposit, misalnya expert judgment dalam pemberian bobot pada masing-masing komponen indeks (indeks komposit dengan bobot tertimbang).

Hal lain yang tidak kalah penting adalah Pemerintah Indonesia harus segera mempersiapkan peraturan pelaksana/pendukung agar tindakan retaliasi dapat dengan mudah diimplementasiakan secara kelembagaan. Undang-Undang Kepabeanan Republik Indonesia telah mengatur ketentuan pengenaan Bea Masuk Pembalasan (BMP), namun demikian belum ada peraturan turunannya (Peraturan Pemerintah) yang mengatur mekanisme dan prosedurnya lebih lanjut serta apabila tindakan pengenaannya bukan berupa BMP. Negara-negara anggota WTO yang lain telah mengadopsi ketentuan

tindakan retaliasi WTO ke dalam peraturan domestiknya secara komperhensif. Bahkan, Amerika Serikat menerapkan carrousel retaliation yang mungkinkan melakukan perubahan daftar produk yang menjadi target retaliasi secara berkala untuk meningkatkan efektivitas tindakan retaliasi.

Sehubungan dengan hal tersebut, Direktorat Jenderal Perdagangan Luar Negeri, Kementerian Perdagangan diharapkan dapat menginisiasi pembentukan peraturan pelaksana tindakan retaliasi dalam bentuk Peraturan Pemerintah (PP). Selain itu, metode penentuan produk impor yang akan dikenakan tindakan retaliasi menggunakan indeks komposit, dapat dijadikan sebagai acuan atau template apabila pemerintah akan mengambil kebijakan pengenaan tindakan retaliasi.
