EXECUTIVE SUMMARY
This report recommends that the draft Master Plan for Kellyville Park be adopted as exhibited and the Expression of Interest (EOI) received from Parramatta National Rugby League (PNRL) be accepted.
The draft Master Plan and EOI were each placed on public exhibition for the period of 25 June 2019 until 26 July 2019. One submission was received for the draft Master Plan, and one EOI was received from PNRL.
The draft Master Plan identifies the proposed vision for Kellyville Park as Council’s Premier facility for rugby league. An initial proposal and subsequent EOI submission by PNRL compliments the intent of the draft Master Plan.
BACKGROUND
At its meeting on 11 June 2019, Council resolved the following:
1. The Mayor and General Manager be authorised to sign the Memorandum of Understanding on Council’s behalf with Parramatta National Rugby League; and 2. The Draft Amended Landscape Master Plan with Statement of Intent that Kellyville
Park be the site of Council’s elite rugby league facility, be placed on public exhibition for 28 days; and
3. Noting Council’s intention to partner with Parramatta National Rugby League by way of licence/lease under the Plan of Management, Council call for expressions of interest for a period of 28 days to identify any other potential partner capable of

delivering on Council’s intent for Kellyville Park as an elite rugby league facility for the Community; and
4. A further report to Council be prepared following the completion of the exhibition period and the assessment of submissions or any alternative expressions of interest.
The draft Master Plan and invitation for EOI were each subsequently placed on public exhibition.
REPORT
Council’s draft Recreation Strategy, also recently placed on public exhibition as part of the Local Strategic Planning Statement, identifies the provision of premier facilities for each major sporting code within the Shire. This provides local athletes opportunities to progress in their chosen sporting discipline beyond the grassroots level into representative and/or elite levels whilst remaining in The Hills.
The draft Master Plan for Kellyville Park compliments the objectives identified in the draft Recreation Strategy in providing a premier facility for rugby league in the Shire. The Plan proposes up to five full size playing fields for rugby league, together with enhanced amenities and infrastructure, as well as a Centre of Excellence for the code. Although Kellyville Park is proposed to cater for higher level competition, it will continue serving local community sport including current tenants the Kellyville Bushrangers, as well as the Polecats Rugby League, Renegades Rugby Union and Kellyville Baseball Club.
The draft Master Plan was placed on public exhibition from 25 June 2019 to 26 July 2019, and was advertised in the local newspapers, and exhibited in the Council foyer, Castle Hill Library and on Council’s website. Notifications were also forwarded to sporting groups utilising Council’s facilities. During this period, one submission was received. A summary of the submission is shown below:

Council has subsequently invited Expressions of Interests (EOI 20-01) from any prospective partners that can demonstrate similar support for these pathways and facilities for our community, including the engagement with local clubs. The EOI was exhibited between 25 June 2019 and 26 July 2019, and was advertised in the local newspapers, and exhibited in the Council foyer, Castle Hill Library, Council’s website and on Tenderlink.
One on time EOI submission was received from PNRL, and one late submission was received from Hutchinson Builders. The late submission from Hutchinson Builders has not been considered.
Evaluation Process
An evaluation panel was established consisting of four members, including a Procurement Officer. The panel assessed the PNRL submission against compliance, and against the determined criteria.
The evaluation panel met to discuss their individual evaluation, with individual scores being collated and average scores calculated.
The scores were calculated using the weightings identified in the Evaluation Plan. The weighted scores for all criteria areas were then totalled. Despite there being only one conforming submission, the panel determined the submission met the criteria, and recommend the EOI from PNRL be accepted.

Parramatta Junior Rugby League has the second largest catchment across Australia with 6,000 junior participants extending from grassroots level to junior representative programs for males and females, 2nd grade competition and the NRL.
Ability to work with Council Propose to establish a Kellyville Park Centre of Excellence and Community Facility Steering Committee as the basis for its co-operative relationship to achieve Council’s visions of a premier rugby league facility at Kellyville Park.
Proposed Business Plan PNRL propose to establish the largest community rugby league facility in Australia at Kellyville Park to house grassroots rugby league and the Centre of Excellence and Community Facility.

It is recommended that the attached draft Master Plan be adopted as exhibited. It is also recommended that the EOI received by PNRL be accepted and a formal partnership be pursued through a licence/ lease agreement under the current Generic Plan of Management.
CONCLUSION
The adoption of the Master Plan for Kellyville Park will enable the objectives identified in the draft Recreation Strategy to be implemented by delivering a premier facility for rugby league.
The formation of a partnership through a licence/ lease arrangement will assist in providing these high level facilities. The provision of these facilities above a grassroots level will be funded by PNRL as part of this partnership.

Council’s future contributions to the re-development of Kellyville Park will continue to deliver elements of the Master Plan including amenities buildings, spectator seating, further floodlighting, fencing, pathways, playground and landscaping across the site. These items will be dealt with as part of normal budgeting processes.
It is intended the provision of facilities and infrastructure beyond those identified in the Master Plan be funded through other means including State and Federal governments, PNRL (as proposed partner) and other potential investors, and be inclusive of both capital and recurrent costs including renewals.
Strategic Plan - Hills Future
The recommendation of this report demonstrates Council’s aim of achieving improved public recreation facilities for residents.

2. The Expression of Interest submission by Parramatta National Rugby League be accepted and a formal licence/ lease agreement be entered into.

REPORT
The purpose of this report is to seek endorsement of the following property dealing relating to a development matter. The legal documents associated with the matter require execution under Council seal in order to be lodged with Land Registry Services in accordance with the requirements of the Real Property Act 1900.
1. The release of a restriction on the use of land from the title of Lot 231 DP 1207855 (4-16 Saltwater Crescent, North Kellyville).
The restriction was created on the title of this residue lot to ensure it was not developed until it has been further subdivided with the adjoining property to the south east under Development Consent 1314/2018/ZB. A Subdivision Certificate application has been lodged under Development Consent 1272/2019/ZB relating to both the subject site and land to the south east under Development Consent 1314/2018/ZB which renders the restriction redundant. A subsequent restriction for the same purpose is proposed over residue lot 205 as required by Development Consent 1272/2019/ZB.
The subdivision works associated with Development Consent 1272/2019/ZB are nearing completion and the restriction is expected to be released via a dealing accompanying the final plan of subdivision relating to Development Consent 1272/2019/ZB.
Council is the authority having the right to release the restriction.

This matter has no direct financial impact upon Council's adopted budget or forward estimates.
The Hills Future Community Strategic Plan
This matter is consistent with the planning principles, vision and objectives outlined within
“Hills 2026 – Looking Towards the Future” as the proposed development to which it relates provides for satisfactory urban growth without adverse environmental or social amenity impacts and ensures a consistent built form is provided with respect to the streetscape and general locality.
RECOMMENDATION
Council consent to the release of a restriction on the use of land from the title of Lot 231 DP 1207855 (4-16 Saltwater Crescent, North Kellyville) and the associated dealing accompanying the final plan of subdivision of Development Consent 1272/2019/ZB be authorised for execution under Council seal.
