This is page 1 of the minutes of the Hills Shire Council ordinary meeting held on MOVED BY COUNCILOR DE MASI AND SECOND BY COUNCILOR COLLINS OAM THAT the minutes of the ordinary meeting of Council held on 9 July 2019 be confirmed. The planning proposal sought to facilitate approximately 408 dwellings on the portion of land owned by Aqualand.

This land no longer forms part of the site subject to the planning proposal or VPA offer;.

AMENDMENT TO EXECUTED VPA

The purpose of this report is to provide an overview and assessment of the EPS offer. Draft amendments to the existing VPA applicable to the land - these amendments relate to the drainage outcome on the Public Reserve land; and. Amend the application of the VPA to relate only to the Public Reserve/Drainage Reserve (shown in Figure 6 below), on the basis that all other obligations under the VPA have been met, with the exception of those relating to the Drainage Land; .

The proposed changes to the drainage output on Public Reserve land are illustrated in Figure 7 below.

NEW VOLUNTARY PLANNING AGREEMENT – PLANNING PROPOSAL

In conjunction with the removal of the existing requirement for the developer to beautify lot 214 (public reserve) for the purpose of a drainage reserve (including bioretention basin), proposed beautification works to lot 214 (public reserve) for the purpose of a local park are included as a commitment through changes to existing VPA (Appendix 1); and. The parties agree that this document is a planning agreement under Subdivision 2, Division 6, Part 4 of the Act. This document has been prepared with regard to the proposed developments and applies to the Land.

Council's obligations are fulfilled when Council provides the developer with a signed request for registration form for release of registration of this document. The date of issue of the subdivision certificate for the part of the land in the development phase. Identification of how the proposed planning agreement promotes elements of the council's charter under the Local Government Act 1993.

BOUNDARY ROAD DETAILED CONCEPT DESIGN EXTRACT

ITEM-4 AFTER EXHIBITION - KELLYVILLE PARK - PROPOSED PREMIER RUGBY LEAGUE FACILITY AND CENTER OF EXCELLENCE FOR PARRAMATTA RUGBY LEAGUE. This report recommends that the draft master plan for Kellyville Park be adopted as set out and that the Expression of Interest (EOI) received from the Parramatta National Rugby League (PNRL) be accepted. The draft master plan sets out the proposed vision for Kellyville Park as the Council's flagship facility for Rugby League.

The park to be the site of the Council's elite rugby league facility, to be placed on public display for 28 days; and. The draft Masterplan for Kellyville Park meets the objectives identified in the draft Recreation Strategy in providing a premier facility for rugby league in the Shire. Council is funding improvements to Kellyville Park at a baseline level as identified in the previously approved Master Plan.

Experience in the development and operation of a major rugby league facility, including the delivery and maintenance of a Center of Excellence. Ability to work with Council Propose the establishment of a Kellyville Park Center of Excellence and Community Facilities Steering Committee as the basis for its collaborative relationship to achieve Council's visions for a premier rugby league facility at Kellyville Park. The proposed PNRL business plan proposes the creation of Australia's largest rugby league community facility at Kellyville Park to house the grassroots rugby league and Center of Excellence and Community facility.

The adoption of the Master Plan for Kellyville Park will enable the objectives identified in the draft Recreation Strategy to be implemented by delivering a premier facility for rugby league. Council's future contributions to the redevelopment of Kellyville Park will continue to deliver elements of the Masterplan, including amenity buildings, spectator seating, further floodlights, fencing, pathways, playgrounds and landscaping across the site.

The proposals will introduce exempt development criteria for advertising at stops, seats, street signs and bridges. This form of advertising was previously treated as 'road-related infrastructure' under the Infrastructure SEPP, as advertising is an integral part of the delivery and maintenance model for such infrastructure. However, following a recent review of the Federal Government's SEPP 64 - Advertising and Signage and LEP 2012, it is unclear how this form of advertising is regulated under current legislation.

For the avoidance of doubt, the planning proposal will address the ambiguity and clarify the permission and approval route for this form of advertising through Council's LEP. Advertising provided in association with small-scale structures such as bus stops, seating and street signs is unlikely to have an environmental impact and could be appropriately regulated through exempted development criteria that control the location, scale and form of signs. The proposed exempted development criteria for bridges will include a requirement to ensure compliance with the provisions of the State Government's Guidelines for Outdoor Transport Corridors.

The purpose of this report is to detail the outcome of a recent review of advertising on Council-owned public infrastructure such as bus shelters, seats, road signs and bridges. The example below shows this signaling form which was completed on behalf of NSW Roads and Maritime Services. However, following a recent State Government review of SEPP 64 – Advertising and Signage and the LEP 2012, there is a conflict between the provisions of the current legislation and how these types of signage are regulated.

It is noted that historically it was only necessary for service providers to provide structural certification of the shelter or sign plus sight distance evaluation for pedestrian and traffic safety. Below is a summary of the main legislation governing the supply and approval of billboards.

Advertising and Signage

For the avoidance of doubt and to avoid delays or uncertainty in the provision of road-related infrastructure, administrative changes may apply to the Council's LEP and SEPP of the Growth Centers related to North Kellyville and Box Hill. The proposed criteria will ensure that the proposed signage meets the requirements of the state government's Transport Corridor Outdoor Advertising Signage Guidelines in terms of design, safety and public benefits. The planning proposals are reported to the Local Planning Panel for advice, in accordance with Section 2.19 of the Environmental Planning and Assessment Act 1979.

After receiving the Local Planning Panel's advice and subject to this advice not requiring any revision of the planning proposals as set out in this report, the planning proposals are sent to the Department of Planning, Industry and Environment for a gateway assessment. April/May 2020 - Report to Council to consider the adoption of the Draft Hills Shire Plan for public exhibition. The purpose of the plan is to identify the community's main priorities and expectations for the future and plan strategies to meet these expectations.

The Resource Strategy is where the Council assists the community by determining who is responsible for what, in relation to the issues identified in the Community Strategic Plan. The Resources Strategy focuses in detail on issues that are the responsibility of the Council. The operational plan will focus on the implementation details of each year of the Delivery Program and should not deviate significantly from the direction and budgets set out in the Program.

The strategic planning process will respond to the implementation of The Hills Future Community Strategic Direction by identifying and prioritizing initiatives and services that will support community outcomes over the Council's four-year term. Referral of the work to Endeavor Energy resulted in a requirement for WCC to build a new Padmount substation on the school's property.
