4.6 BRABHAM SECOND STAGE LOCAL STRUCTURE PLAN (SWAN- SP/2020/1)

RECOMMENDATION That the Council resolve to:
1) Advise the Western Australian Planning Commission that, subject to the prior approval of a Local Water Management Strategy for the land, the City would support the proposed Brabham Second Stage Local Structure Plan subject to the following modifications:
a. The Structure Plan Map is to be amended so that the Local Centre is zoned as ‘General Commercial (Local Centre)’.
b. Section 6.4 ‘Special Use Zone (Local Centre)’ of Part One is to be modified to state the ‘General Commercial (Local Centre)’ zone.
c. Table 3: Special Use Zone (Local Centre) - Land Use Permissibility’ is to be removed from Part One.
d. A provision be added to Section 6.4 of Part One to state:
i. The Local Centre site is to have a maximum Net Lettable Area of 520m².
e. The Structure Plan map and supporting documents are to be revised to provide a minimum 30m separation distance to St Leonards Creek from the edge of the waterway excluding any drainage infrastructure, recreation infrastructure, public roads, fire management zones or the incursion of residential lots.
f. The Structure Plan map and supporting documents are to be revised to provide a minimum 50m separation distance to Wetland 104 excluding any drainage infrastructure, recreation infrastructure, public roads, fire
i. A requirement to submit a Fauna Management Plan to be approved by the City of Swan in consultation with the Department of Biodiversity, Conservation and Attractions is to be included under Section 8.1 'Conditions of Subdivision Approval' of Part One. The Fauna Management Plan must include:
i. The requirement for a fauna spotter to be present during clearing;
ii. Kangaroo management and relocation; and
iii. Commitment to check hollows prior to vegetation clearing.
j. The Public Open Space tables in both Part One and Part Two are to be revised to reflect the new reserve areas as a result of the increased separation distance widths.
k. A requirement to submit a Safety Management Study, in accordance with 'Australian Standard 2885 for Pipelines – Gas and Liquid Petroleum' is to be included under Section 8.1 'Conditions of Subdivision Approval' of Part One.
l. The Traffic Impact Assessment is to be updated to include SIDRA intersection analysis to assume ultimate development at 2041 rather than 2031.
m. The Traffic Impact Assessment is recommended to be modified to include more information to highlight proposed pedestrian connectivity.
n. The Traffic Impact Assessment is to be revised to show all Local Access Road widths at a minimum of 15m as per draft Liveable Neighbourhoods 2015.
o. The Bushfire Management Plan is to be revised to reflect the new Public Open Space areas and the new Landscape Master Plan.
p. Section 7.1 of Part One to be expanded to include the preparation of a Local Development Plan for the Local Centre and will include details of:
i. Built form guidelines;
ii. Ancillary features and landscaping eg. Seating, lighting, bike parking;
iii. Integration with community facilities (either public or private); and iv. Car parking and traffic management; and
q. Section 7.1 of Part One be expanded to include the preparation of a Local
MOTION that the Council resolve to:
1) Adopt the officer recommendation with the addition of the following Parts:
2) Request the CEO to write to the Minister of Education requesting the construction of a second primary school noted in the plan to be built immediately, and a high school within Brabham to be built within the next three (3) years.
3) Request the CEO to write to the Minister of Planning demonstrating the City of Swan’s disappointment with the lack of "active" Public Open Spaces in the Second Stage Area Plan, given the high density development proposals within the Urban Growth Corridor and request the Department of Planning review its current open space provisions within the Planning and Development Act.
2) Record the reason for the change to the officer recommendation is that that due to the significant growth of Brabham, in particular with young families in the local area, a second Primary School is required to be built immediately, more Parks and Playgrounds for the children to play in, and a high school to be built to ensure that the Local Community has a Local High School for the children who reside in Brabham.

MOTION that the Council resolve to:
1) Recommend that the Western Australian Planning Commission (WAPC) refuse to endorse the proposed Brabham Second Stage Local Structure Plan and for the application to be resubmitted when the following have occured:
A. Until such time as discussions with staff and the WAPC can determine if the alignment of a future Henley Brook Avenue can be moved further away from Pannage Wetlands - which would have implications for the proposed subdivision layout.
B. Provide for an ecological and water flow corridor, including setbacks (buffer),
3) Write to the Minister of Planning demonstrating the City of Swan’s disappointment with the lack of "active" Public Open Spaces in the Second Stage Area Plan, given the high density development proposals within the Urban Growth Corridor and request the Department of Planning review its current open space provisions within the Planning and Development Act.

RESOLVED (8/5) TO:
1) Recommend that the Western Australian Planning Commission (WAPC) refuse to endorse the proposed Brabham Second Stage Local Structure Plan and for the application to be resubmitted when the following have occured:
A. Until such time as discussions with staff and the WAPC can determine if the alignment of a future Henley Brook Avenue can be moved further away from Pannage Wetlands - which would have implications for the proposed
subdivision layout.
B. Provide for an ecological and water flow corridor, including setbacks (buffer), following the natural path of water from Pannage Wetlands through to St Leonard’s Creek.
C. Reduce the R zoning spectrum to R20 to R40 - with the exception for an area that is set aside for Aged Care (to remain up to R60).
