FLINDERS UNIVERSITY OF SOUTH AUSTRALIA AND THE UNIVERSITY OF SOUTH AUSTRALIA FOR A JOINT FACULTY OF ENGINEERING
Preamble
1 This Agreement 1s made between The Fhnders Un1vers1ty of South Australia and the Un1vers1ty of South Australia to set out the arrangements for the conduct of a Joint Faculty of Eng1neenng to undertake teaching and research 1n Eng1neenng It supersedes the previous agreement made 1n September 1991 to establish the Joint Faculty
Definitions
2 In this Agreement unless the contrary 1s 1nd1cated
Councils means the Council of The Flinders Un1vers1ty of South Australia and the Councd of the Un1vers1ty of South Australia,
Dean means the academic head of the Joint Faculty of Eng1neenng
Un1vers1hes' means The Flinders Un1vers1ty of South Australia and the University of South Australia
Vice Chancellors means Vice Chancellors of The Flinders Un1vers1ty of South Australia and the University of South Australia
Members of the Joint Faculty
3 The members of the Joint Faculty shall be (a) the Vice Chancellors of The Flinders
Un1vers1ty of South Australia and the University of South Austraha ex officio (b) the academic general technical and
research staff of the School of Eng1neenng w1th1n the Faculty of Science and Eng1neenng at The Flinders Un1ver s1ty of South Australia and the Schools and D1sc1phnes of Eng1neenng w1th1n the Faculty of Eng1neenng at the Un1vers1ty of South Australia
(c) students enrolled 1n engineenng courses at The Flinders University of South Australia and the Un1vers1ty of South Australia
(d) such other persons as the Councils of the Un1vers1t1es may determine

4 There shall be a Dean of the Joint Faculty who shall be appointed by the Councils of the Un1vers1hes on the advice of the Vice Chancellors and who shall report to both Vice Chancellors, or their nominees
5 The Dean shall normally be appointed from the academic staff of the Schools and D1sc1phnes of Engineering w1th1n the Faculty of Engineering at the Un1vers1ty of South Australia and the School of Eng1neenng w1th1n the Faculty of Science and Engineering at The Fhnders Un1vers1ty of South Australia 6 The Dean shall be appointed for an 1n1tlal term
of three years and on such terms and conditions as may be determined by the Un1vers1hes, and shall be eligible for re appointment for further terms
7 The Dean shall be recommended for appoint ment by a selection committee established for the purpose by the Counctls
8 The Dean shall be responsible for
(a) coord1nat1on of the 101nt eng1neenng act1v1ttes between the two Un1vers1hes (b) coord1natton of the accreditation of the
Joint Faculty s courses by the Institution of Engineers Australia or other pro fess1onal bodies
(c) chamng the )omt Faculty Board (d) ha1son with
• the Head of the Faculty of Science and Eng1neenng at The Flinders Un1vers1ty of South Australia
• the Dean of the Faculty of Eng1neenng at the Un1vers1ty of South Australia
• the Dean of the School of Eng1neenng at The Fhnders Un1vers1ty of South Australia
the Heads of the Schools of Eng1neenng at the Un1vers1ty of South Australia
(e) representing the two Un1vers1t1es as Dean of the Joint Faculty of Eng1neenng at the National Committee of Eng1neenng Deans or at s1mtlar forums
(t) other achv1ttes as determined by the Vice Chancellors
9 The Dean shall submit an annual report on the operation of the Faculty to the Vice Chancellors or nominees
The Deputy Dean
10 There shall be a Deputy Dean of the Joint Faculty who shall be appointed by the Vice Chancellors The Deputy Dean shall be appointed from the eng1neenng academic staff of the university other than that from which the Dean ts appointed
11 The Deputy Dean shall act for the Dean 1f the Dean 1s not available or 1s unable to act 134
12 The Deputy Dean shall be appointed for a term of three years and shall be ehg1ble for reappointment for further terms
Joint Faculty Board
13 There shall be a Joint Faculty Board com pns1ng the Dean as Chatrperson and with add1t1onal membership of
(a) the Vice Chancellors of the Un1vers1ttes ex ofl1c10
(b) the Deputy Dean ex ofl1c10,
(c) five members appointed by the Faculty Board of the Faculty of Eng1neenng at the Un1vers1ty of South Austraha
(d) five members appointed by the Faculty Board of the Faculty of Science and Eng1neenng of The Flinders Un1vers1ty of South Australia
(e) two representatives of industry
(f) one postgraduate and one undergraduate student of the Joint Faculty from each Un1vers1ty
(g) such other persons as the Un1vers1t1es may determine
14 The )omt Faculty Board shall
(a) assist 1n the planning development 1mplementat1on and evaluation of academic poltctes and programmes 1n eng1neenng at both Un1vers1t1es by (1) rece1v1ng and considering advice
from the Faculty of Science and Eng1neenng at The Flinders Un1ver s1ty of South Australia and the Faculty of Eng1neenng at the Un1ver s1ty of South Australia
(11) prov1d1ng advice and making recommendations to the Academic Boards of each Un1vers1ty through the Faculty of Science and Eng1neenng at The Flinders Un1ver s1ty of South Australia and the Faculty of Eng1neenng at the Un1ver s1ty of South Australia and
(b) provide advice on the development and maintenance of relations with industry the community and the eng1neer1ng professions
(c) perform such other functions as the Councils may prescnbe
Joint Faculty Adm1n1strat1ve Budget and Staff 15 The Joint Faculty shall have an annual
adm1n1strahon budget agreed by the Un1ver s1hes and to which each of the Un1vers1hes will contnbute equally
16 The Budget of the Joint Faculty will make prov1s1on for the cost of the running of the Joint Faculty 1nclud1ng any agreed allowances for the Dean and Deputy Dean In recogn1tion of the effort associated with their duties for the Joint Faculty any costs 10 respect of adm1n1 strat1ve and support staff associated with the
Joint Faculty travel costs for the Dean while on Joint Faculty bus1ness1 and costs for other necessary consumable items
17 Any academic and general staff contnbuhng to the work of the Joint Faculty shall be employed by either of the Un1vers1t1es under the relevant tenns and cond1tions of employ ment of the Un1vers1ty concerned
18 Academic staff involved 1n the teaching and research programme of the Joint Faculty and staff employed pursuant to section 17 may be located on a campus of either Un1vers1ty and may be required to travel between campuses Courses and Awards
19 The courses of study deemed to belong to the )omt Faculty shall be selected by the )omt Faculty from those eng1neenng programmes of the Faculty of Eng1neenng of the Un1vers1ty of South Australia and Faculty of Science and Engineering at The Flinders Un1vers1ty of South Australia and shall be published 1n the handbook of the Joint Faculty
20 Each course of study of the Joint Faculty shall be approved by both Un1vers1tles
21 Each first year student shall enrol at the University to which he or she has been admitted 1n accordance with the requirements of that Un1vers1ty In subsequent years of study a student may only enrol 1n the specrnhsatton to which he or she has been admitted and which is offered by the Un1vers1ty 1n which he or she 1s seeking to enrol
22 Students shall be governed by the academic pohc1es and procedures of the Un1vers1ty 1n which they are enrolled
23 A student who successfully completes the requirements for a degree or other award of the Joint Faculty shall be admitted to the degree or other award as the case may be by the Un1vers1ty 1n which the student 1s enrolled 24 The testamur received by a student graduating
from either Un1vers1ty 1n courses of the Joint Faculty will include a statement to the effect that the award was made under the aegis of the Joint Faculty
25 Each student shall pay the Student Services Fee which is applicable to the Un1vers1ty 1n which he/she is enrolled and on payment of that fee shall have the same nghts of member ship of student organ1sat1ons as other students enrolled 1n either Un1vers1ty
26 Each student of the Joint Faculty shall have the same nghts to use student computing and library fac1ht1es as other students enrolled 1n either Un1vers1ty
Intellectual Property
27 Intellectual property developed by a staff member of the Un1vers1ty of South Austra!Ja shall be the property of the Un1vers1ty of South

28 Intellectual property developed by a staff member of The Flinders Un1vers1ty of South Australia shall be the property of The Fhnders Un1vers1ty of South Australia and sub1ect to its leg1slahon and pohc1es
29 Intellectual property ong1nated 101ntly by staff members of both Un1vers1t1es shall be 101ntly owned by the Universities and shall be exploited or disposed of by agreement between them
30 Intellectual property development by students of the Joint Faculty shall be sub1ect to the policies and procedures of the Un1vers1ty 1n which they are enrolled
Funding
31 There shall be an annual transfer of funds between the Un1vers1ttes for contnbut1ons to teaching 1n the courses of the Joint Faculty according to a resource allocation formula agreed by the Universities based on student load at 31 March
Committee Representation
32 The Dean of the joint Faculty shall be a member of the Academic Board of both Un1vers1t1es
33 The Head of the Faculty of Science and Eng1neenng at The Flinders Un1vers1ty of South Australia or nominee and the Dean of the Faculty of Eng1neenng at the Un1vers1ty of South Australia or nominee shall have reciprocal nghts 1n respect of the Boards of those ~acuities These nghts are to receive all papers and attend and speak at all meettngs but not vote at those meetings
Arbitration
34 Where a dispute anses between the Un1ver s1ties which cannot be resolved through the prov1s1ons of this Agreement, the Vtce Chancellors shall endeavour to resolve the above matter by negotiation
35 In any case where a dispute cannot be resolved w1th1n a reasonable time under the prov1s1ons of section 34 the Vice Chancellors shall refer the matter to an arbitrator who shall be acceptable to both Un1vers1ties
36 The Un1vers1t1es agree to accept any dec1s1on made by an arbitrator appointed pursuant to section 35
