median island to be installed along Commercial Road (which commences adjacent to the existing right turn bay just east of McCombe and terminates approx 20m east of NRP Road 01).

b) For Commercial Road/NRP Road 02 this is to utilise the existing concrete median along Commercial Road. However, to prevent the likelihood of movements from NRP Road 02 into McCombe Avenue this will also require the provision of a concrete island at the approach of NRP Road 02 to Commercial Road which channelizes vehicles to physically turn left into Commercial Road.

Note: The design of this intersection must accommodate the turn paths of a 9.8m Garbage Truck (rigid vehicle).

iii. Car parking provision to comply with Council's DCP.

iv. The layout of the proposed car parking areas associated with any Level 3 Development Application(s) (including, driveways, grades, turn paths, sight distance requirements, aisle widths, aisle lengths, and parking bay dimensions) should be in accordance with AS 2890.1-2004 and AS 2890.2 - 2002 for heavy vehicle usage.

v. All works/regulatory signposting associated with the proposal shall be at no cost to the Roads and Maritime.

In regard to part (ii) of the comments above, the applicant subsequently amended the plans to delete the second access point to Commercial Road and to revise the remaining vehicular access to limit access to left out only.

No objection is raised to the above requirements subject to amended wording to reflect the revised plans and a condition has been recommended to this effect (See Condition 14).

d. NSW Fisheries Comments

NSW Fisheries reviewed the proposal and raised no objection to the proposal. There are no conditions to be imposed.

e. Sydney Water Comments

Sydney Water advised that there is water, wastewater and recycled water connection available. Future Level 3 Development Applications for physical works will be required to be referred to Sydney Water for specific servicing arrangements. There are no conditions to be imposed.

f. NSW Heritage Council Comments

The NSW Heritage council have reviewed the proposal and raised no objection to the proposal on the basis that there are no State listed heritage items on or within the immediate vicinity of the site. There are no conditions to be imposed.

g. NSW Police Service Comments

Castle Hill Police advised that they had no concerns with the proposal and indicated that future applications will be required to comply with the provisions of Safer by Design.

There are no conditions to be imposed. It may be noted that future applications will be referred to NSW Police, where applicable, under the protocol between Police and Council.

ENGINEERING COMMENTS

No objection raised to the proposal subject to conditions.

TRAFFIC COMMENTS

Condition 13 requires the developer to undertake upgrade works along the Commercial Road frontage of the site. These works include localised road widening along the full frontage of the site to ensure that the existing road pavement is upgraded to the ultimate carriageway configuration and to ensure that the works tie into the existing widened carriageway and also make provision for the future planned traffic signals at the Commercial Road/ Caddies Boulevard/ Green Hills Drive intersection. A 2.5 metre wide cycleway is also required along the frontage of the site which will link with the existing cycleway constructed (in part) between Council’s playing fields to the east and the Town Centre. These conditions are typical conditions imposed upon development of land and will contribute to the necessary road upgrade works which are not funded by Section 94 contributions.

TREE MANAGEMENT COMMENTS

No objection raised to the proposal subject to conditions.

ENVIRONMENTAL HEALTH & SUSTAINABILITY COMMENTS No objection raised to the proposal subject to conditions.

RESOURCE RECOVERY COMMENTS

No objection raised to the proposal subject to conditions.

WATERWAYS COMMENTS

No objection raised to the proposal subject to conditions.

FORWARD PLANNING COMMENTS No objection raised to the proposal.

CONCLUSION

The proposal has been assessed having regard to the provisions of Local Environmental Plan 2005 and The Hills Development Control Plan and is satisfactory. The proposal was notified to adjoining property owners and no objection was raised to the proposal.

The Design Guidelines are recommended for endorsement and the Development Application is recommended for approval subject to conditions.

IMPACTS Financial

This matter has no direct financial impact upon Council's adopted budget or forward estimates.

The Hills Future Community Strategic Plan

The proposed development is consistent with the planning principles, vision and objectives outlined within the Hills 2026 – “Looking Towards the Future” as the social and environmental impacts have been considered satisfactory as detailed within the body of this report. The proposal is not considered to detrimentally impact upon the character of the locality or the shire as a whole.

RECOMMENDATION

1. The Design Guidelines as provided in Attachment 8 of this report be endorsed.

2. The Development Application be approved subject to the following conditions of consent.
