TRAFFIC ACTS AMENDMENT ACT 1977, No. 26

[Reprinted as at 1 March, 1986]

An Act to amend the Traffic Act 1949-1975 and the Traffic Act Amend- ment Act 197 4 each in certain particulars and to construe certain evidentiary certificates

[ASSENTED TO 21 APRIL, 1977]

BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:-

1. Short title and citation. (1) This Act may be cited as the Traffic Acts Amendment Act 1977.

(2) In this Act the Traffic Act 1949-1975 is referred to as the Principal Act.

(3) The Principal Act as amended by this Act may be cited as the Traffic Act 1949-1977.

9. (1) Amended Act of 1974, No. 18.

(2) The Traffic Act Amendment Act 1974 as amended by this section may be cited as the Traffic Act Amendment Act 1974-1977.

Construction of evidentiary certificates. Where before the commencement of this Act there has been adduced in evidence in any proceeding (whether for the purposes of The Traffic Act of 1949 as subsequently amended to the time of such proceeding or for other purposes) a certificate purporting to be signed by a medical practitioner, an analyst within the meaning of that Act amended as aforesaid or an authorized member of the Police Force, which certificate contains a statement of the concentration of alcohol or drug in the blood of any person expressed by reference to the number of milligrams of alcohol or drug in the blood per 100 millilitres of blood, it shall be deemed that the statement of such concentration is and always was expressed by reference to the number of milligrams of alcohol or drug in the blood to 100 millilitres of blood and conforms and always conformed to the requirements of that Act amended as aforesaid relating to the statement of such concentration and the certificate shall be given evidentiary effect as prescribed by that Act amended as aforesaid.
