HIS Excellency the Governor, acting by and with the advice of the Executive Council and in pursuance of the provisions of the Medical Act 1939-1987, has been pleased to approve the following by-laws made by the Medical Board of Queensland.

MIKE AHERN PART I-PRELIMINARY

1. Short Title. These by-laws may be cited as the Medical Board of Queensland By-laws 1987.

2. Commencement. These by-laws shall come into operation on 1st July, 1987.

3. Arrangement of by-laws. These by-laws are arranged as follows:- PART I-PRELIMINARY (by-laws 1-5);

PART II-CONDUCT OF BUSINESS OF BOARD (by-laws 6- 9);

PART III-CUSTODY OF AND USE OF SEAL OF BOARD (by-law 1 0);

PART IV-SERVICE AS -AN INTERN (by-law 11);

FIRST SCHEDULE;

SECOND SCHEDULE.

4. Forms. ( 1) The forms set forth in the First Schedule to these by-laws shall be used for the purposes for which they are respectively applicable.

(2) A form prescribed by these by-laws shall be completed in accordance with such directions as are specified in the prescribed form.

5. Fees. The fees set out in the Second Schedule to these by-laws shall be the fees payable to the Medical Board of Queensland in respect of the matters specified therein.

PART II-CONDUCT OF BUSINESS OF BOARD

6. Notice of meeting. The registrar shall complete and thereafter shall, in accordance with the requirements of section 11 (9) of the Act, deliver notice of any meeting or adjourned meeting of the Board other than a special meetmg and shall include in that notice-

(a) details of all motions or resolutions intended to be proposed at the meeting as given to him in writing at least seven clear days prior to the date of the meeting; and

(b) only to the extent which it is practicable so to do, any other motions . or resolutions intended to be proposed at the meeting as given to him in writing less than seven clear days prior to the date of the meeting.

7. General functions and duties of registrar. The registrar shall act as secretary to the Board, and shall bring before the Board all matters and things necessary to ensure that the requirements of the Act are complied with. He shall write up the minutes of all meetings of the Board, conduct all correspondence as directed by the Board, keep a correct record in the proper books of all accounts, receipts, payments, vouchers, reports, documents, papers, correspondence and proceedings connected with the business of the Board, and generally do all the clerical work of the Board and superintend all business and affairs of the Board, subject to the Board's direction. He shall consult the President of the Board with regard to any business requiring urgent attention between one meeting and the next. He shall be responsible for and shall control the safe keeping of all receipts, papers, cheques, cheque-books, books, documents and property belonging to the Board but he shall make any such material available to the Board or any member thereof for examination.

8. Receipts of moneys. (l) The registrar shall receive all fees, fines, and other moneys which shall become due and payable to the Board, and shall give a printed receipt for any moneys received, and shall retain a counterpart of any receipt given.

(2) All moneys received by the registrar on account of the Board shall be lodged by him at the Commonwealth Bank or such other bank in Brisbane as may from time to time be determined by the Board.

9. Honorary treasurer. (l) Where the Board appoints a member of the Board to be honorary treasurer the registrar shall provide the honorary treasurer with an account of all moneys received. All accounts of the Board shall be paid by cheque and, subject to instructions of the Board to the contrary, be signed by the president or honorary treasurer, and the registrar.

(2) The honorary treasurer shall, in the month of July in each year, present to the Board an annual balance sheet showing the exact financial position of the affairs of the Board.

PART III-CUSTODY OF AND USE OF SEAL OF BOARD 10. Custody and use of seal. (1) The registrar shall have the custody of the seal ofthe Board, which shall be used only as hereinafter provided.

(2) The registrar shall cause the seal of the Board to be affixed- ( a) to Certificates of Registration; and

(b) to any other instruments or documents where the affixing is authorised by a resolution passed for that purpose and entered upon the minutes of the proceedings of the Board.

(3) Whenever the seal of the Board is affixed as provided in paragraph (b) of clause (2) the registrar shall append thereto a certificate as follows:-

PART IV-SERVICE AS AN INTERN

11. Service as an intern. For the purposes of section 19 (1) (d) of the Act the aggregate amount of the period or periods that a person shall serve as an intern shall be twelve months which shall include-

(a) a minimum of twenty-two weeks experience in medicine;

and

(b) a minimum of twenty-two weeks experience in surgery:

Provided that experience in obstetrics shall constitute experience in either medicine or surgery but shall not exceed eight weeks of the aggregate amount of twelve months.

Provisos:-

A. The annual licence fee shall be waived in respect of the year in which a medical practitioner first obtains registration, and where registered on or after the first day of October, in respect also of the ensuing year.

B. An annual licence fee shall not be payable by a medical practitioner who satisfies the Board, not later than 30th April of the first year in respect of which waiver is sought, that he has attained the age of seventy years, and thereafter makes application for waiver each year not later than that date.
