THE CENTRAL QUEENSLAND EGG MARKETING BOARD REGULATIONS 1988

Department of Primary Industries Brisbane, 24th March, 1988 HIS Excellency the Governor, acting by and with the advice of the Executive Council and in pursuance of the provisions of the Primary Producers' Organisation and Marketing Act 1926-1987, has been pleased to make the following regulations.

N. J. HARPER 1. Short Title. These regulations may be cited as The Central Queensland Egg Marketing Board Regulations 1988.

2. Repeal. The regulations (untitled) made under The Primary Producers' Organisation and Marketing Act 1926 to 1946 being regulations numbered 716, 717 and 718 first published in the queensland Government Gazette on 8th March, 1947 at page 812, and In force (as amended) under the Primary Producers' Organisation and Marketing Act 1926-1987, are repealed.

3. Forms. (1) The forms set forth in the Schedule hereto shall be used for the purposes for which they are respectively applicable.

(2) A form prescribed in these regulations shall be completed in accordance with such directions as are specified in the prescribed form.

(3) In these regulations a reference to a form by number is a reference to a form in the Schedule hereto which bears that number.

4. Interpretation. In these regulations, unless the contrary intention appears-

"Board" means The Central Queensland Egg Marketing Board duly constituted under the Primary Proaucers' Organisation and Marketing Act 1926-1987.

5. Administrative Levy. (1) In respect of and during the currency of the Board, the Board is hereby empowered to make from time to

time upon the resolution of the Board a levy for administrative purposes on growers of the commodity eggs.

(2) The levy may be imposed either-

(a) at a rate not exceeding fifteen cents (15 cents) per dozen eggs delivered to the Board, its authorised agent or agents;

or

(b) at a weekly rate not exceeding two dollars and fifty cents ($2.50) per hen for·every hen included in a grower's egg producer's adjusted hen quota.

(3) Unless a grower shall nominate in Form 1 that he elects to pay the levy to the Board each week on the basis of his egg producer'S adjusted hen quota, the Board may impose the levy on the basis of the number of dozen eggs delivered to the Board, its authorised agent or agents.

(4) Where a grower elects to pay the levy based on his egg prodfuhcer's adjusted hen quota the levy shall be calculated on the number

ens included in his egg producer's adjusted hen quota as at the FIrst day of July in the year in which the levy is imposed.

(5) The amount of the levy shall be deducted by the Board from weekly payments due by the Board to the grower and the proceeds shall be used to provide for the administrative expenses of the Board.
