VALUERS REGISTRATION BOARD REGULATIONS OF 1966
MADE IN PURSUANCE OF THE PROVISIONS OF THE VALUERS REGISTRATION ACT OF 1965

HIS Excellency the Governor, acting by and with the advice of the Executive Council, in pursuance of the provisions of The Valuers Registration Act of 1965, has been pleased to make the following Regulations under and for the purposes of the abovementioned Act.
HAROLD RICHTER.
1. These Regulations may be cited as "The Valuers Registration Board Regulations of 1966 ."
2. These Regulations shall come into force on the date of publication thereof in the Gazette.
3. (1) The Forms set forth in the Schedule hereto, shall be used for the purposes for which they are respectively applicable:
Provided that no such Form shall be deemed invalid if it is to the effect of the respectively proper Form in the said Schedule with such modifications as the circumstances may require.
(2) Where a Form prescribed by these Regulations requires completion by the insertion of particulars or other matters referred to in the Form, those particulars or other matters are prescribed as the particulars or other matters required under the provisions of the Act for the purpose for which the Form is prescribed.
(3) A Form prescribed by these Regulations shall be completed in accordance with such directions as are specified in the Form as so prescribed.

In these Regulations unless the context otherwise indicates or requires, the tertns used shall have the meanings respectively assigned to them by section 3 of The Valuers Registration Act of 1965 and the following terms shall have and include the meanings set against them respectively, that is to say:-
" The Act" means The Valuers Registration Act of 1965 and any Act passed in amendment thereof or in substitution therefor.
"Member" means a member of the Board.

5. The Secretary shall-
(a) Keep the Register of Valuers of Queensland and the Register of Provisional Licensed Valuers of Queensland.
(b) Be responsible for the safety of all property of the Board and for the safe custody of all receipts, papers, cheques, cheque books, documents, certificates and other records of the Board and shall at all times make all or any of such records available to a member of the Board, on being given reasonable notice on that behalf;
(c) Receive all fees, payments, funds and other money which shall become due or payable to the Board and shall issue a receipt therefor upon an official receipt form provided for that purpose retaining a duplicate of each such receipt;
(d) Keep the minutes of all Board meetings and distribute a copy of such minutes to members prior to the next meeting;
(e) Deposit all money received by him on account of the Board forthwith to the credit of an appropriate account with the Commonwealth Savings Bank of Australia in Brisbane or such other Bank as may from time to time be determined by the Board. Such account shall be entitled "The Valuers Registration Board Account ". All accounts rendered to the Board and passed by it for payment shall be paid by cheque signed by the Chairman and the Secretary or in such other manner as the Board may from time to time by resolution direct;
(f) Present to the Board at each meeting a statement showing receipts and disbursements since the last preceding meeting of the Board and if req)-lested by the Board produce the Bank passport and any other Board record;
(g) As soon as practicable after the thirty-first day of December in each year prepare and present to the Board a statement of receipts and disbursements covering the activities of the Board for the preceding twelve months showing the exact financial position of the Board as at such date. The state- ment of receipts and disbursements shall be certified by the Auditor-General as fairly setting out the financial operations of the period.

APPLICATION FOR REGISTRATION AS VALUER
6. (1) A person who desires to be registered as a Valuer shall make application to the Board on Form 1 of the Schedule hereto and lodge it with the Secretary.
(lA) The form of advertising required in pursuance of section 14 (1A)
dfthis Act shall be in accordance with Form 14 of the Schedule to these
Regulations.

(2) Such application shall be accompanied by the application fee prescribed in Regulation 21 of these Regulations and the Annual Roll Fee as prescribed by section 15 of the Act.

OBJECTION TO APPLICATION FOR REGISTRATION AS VALUER
7. A person who desires to object to an application of a person for registration as a valuer shall lodge his objection with the Secretary on Form 2 of the Schedule hereto.
COMMUNICATION TO THE BOARD
8. All communications to the Board shall be addressed to the Secretary.
APPROVED INSTITUTES OF VALUERS
9. The following Institutions or Associations shall be the Approved Institutes of Valuers for the holding of a Certificate of Competence within the meaning of the Act:-
The Australian Institute of Valuers;
The Real Estate Institute of Queensland (Valuers Division);
Royal Institute of Chartered Surveyors (England);
Chartered Auctioneers and Estate Agents Institute (England);
New Zealand Institute of Valuers.

ISSUE OF CERTIFICATES
10. (I) The Secretary shall upon the application of a person registered as a Valuer under the Act issue to him a Certificate of his registration in Form 3 of the Schedule hereto on payment by the applicant of the fee prescribed in Regulation 21 of these Regulations.
(2) A Certificate of Registration issued by the Board shall bear the signatures of the Chairman and Secretary.

REGISTER OF VALUERS
11. The register shall be kept on the loose leaf or card index system and shall be in Form 4 of the Schedule hereto. The register shall be kept at the office of the Board and shall be open to inspection during the hours from 10 a.m. to 4 p.m. on the days that the office of the Board is open for the transaction of business upon payment of the fee prescribed in Regulation 21 of these Regulations.

REMOVAL OF NAME FROM REGISTER
12. A Registered Valuer who gives notice in writing to the Board requesting that his name be removed from the register or that he does not desire his name retained on the register shall surrender the Certificate of Registration issued to him by the Board and shall pay all fees owing by him to the Board at the date of such notice.
RESTORATION OF NAME TO REGISTER
13. (1) A Valuer whose name has been removed from the register under the provisions of the Act and who desires his name to be restored thereto shall make application to the Board in Form 5 of the Schedule hereto.
(2) Such application shall be accompanied by:-
(a) The fee prescribed by Regulation 21 of these Regulations;
(b) All fees owing by the applicant to the Board at the date of removal of his name from the register; and
(c) Annual Roll Fee as prescribed by section 15 of the Act.

14. Notice of Appeal by any person under Part III of the Act who desires to appeal against a refusal or direction of the Board shall be in Form 6 of the Schedule hereto.

APPLICATION FOR A LICENCE OR THE RENEWAL OF A LICENCE AS A PROVISIONAL LICENSED VALUER
15. (1) A person who desires to be licensed as a Provisional Licensed Valuer or who desires to make application for the renewal of his provisional licensed valuer's licence shall make such application to the Board in Form 7 or 12 whichever is applicable of the Schedule hereto and lodge it with the Secretary.
(lA) The form of advertising required in pursuance of section 24A (3) of this Act shall be in accordance with Form 15 of the Schedule to these regulations.
(2) Such application shall be accompanied by the fee prescribed by Regulation 21 of these Regulations.

OBJECTION TO APPLICATION FOR THE RENEWAL OF A LICENCE AS A PROVISIONAL LICENSED VALUER
16. An objector to an application of a person for the granting of a licence as a Provisional Licensed Valuer or an application for the renewal by a person of his provisional licensed valuer's licence shall lodge his objection with the Secretary in Form 8 of the Schedule hereto.

17. (1)
Upon the determination of the Board that the application of a person to be licensed as a Provisional Licensed Valuer or to have his provisional licensed valuer's licence renewed be approved the Secretary shall issue to him a licence: on

REGISTER OF PROVISIONAL LICENSED VALUERS
18. The Register of Provisional Licensed Valuers shall be kept on the loose leaf or card index. system and shall be in Form 11 of the Schedule hereto. Such register shaH be kept at the office of· tile' Board and shall be open to inspection during the hours of 10 a.m. to 4 p.m. on the days that the office of the Board is open for the transaction of business upon payment of the fee prescribed by Regulation 21 of these Regulations.

22. 1. (i) The fee payable to the Chairman of the Board for his attendance at a meeting of the Board shall be:-
(a) For a meeting up to two hours inclusive-$33. 50;
(b) For a meeting of more than two hours and up to four hours inclusive-$50; and
(c) For a meeting of more than four hours-$67.
(ii) The fee payable to each other member of the Board for his attendance at a meeting of the Board shall be:-
(a) For a meeting up to two hours inclusive-$23;
(b) For a meeting of more than two hours and up to four hours inclusive-$33. 50; and
(c) For a meeting of more than four hours-$44. 50.
(iii) The allowance payable to the Secretary of the Board shall be
$1,200 per annum.
2. (i) The travelling and sustenance allowance payable to members of the Board shall be at the rates prescribed (from time to time) by the
Public Service Act1922-1978 for an officer of the Public Service classified I-26 and higher.
(ii) The travelling and sustenance allowance payable to the Secretary of the Board shall be at rate prescribed (from time to time) by the
Public Service Act1922-1978 in accordance with his Public Service classification.

HIS Excellency the Governor, acting by and with the advice of the Executive Council and in pursuance of the provisions of the Valuers Registration Act 1965-1983, has been pleased to make the following amendment to "The Valuers Registration Board Regulations of 1966".

Regulation 22 is deleted and the following Regulation is inserted in its stead:-
"22.
I.(i) The fee payable to the Chairman of the Board for his attendance at a meeting of the Board shall be:-
(a) For a meeting up to two hours inclusive-$51.50;
(b) For a meeting of more than two hours and up to four hours inclusive-$77; and
(c) For a meeting of more than four hours-$103.
(ii) The fee payable to each other member of the Board for his attendance at a meeting of the Board shall be:-
(a) For a meeting up to two hours inclusive-$35.50;
(b) For a meeting of more than two hours and up to four hours inclusive $51.50; and
(c) For a meeting of more than four hours-$68.50.
(iii) The allowance payable to the Secretary of the Board shaH be
$2,000 per annum, as from 1st March, 1984.
2. (i) The travelling and sustenance allowance payable to members of the Board shall be at the rates prescribed (from time to time) by the Public Service Act 1922-1978 for an officer of the Public Service classified 1-26 and higher.
(ii) The travelling and sustenance allowance payable to the Secretary of the Board shall be at the rate prescribed (from time to time) by the Public Service Act 1922-1978 in accordance with his Public Service classification."
