THE CAMPING GROUND REGULATIONS 1987

Department of Health Brisbane, 4th June, 1987 HIS Excellency the Governor, acting by and with the advice of the Executive Council and in pursuance of the provisions of the Health Act 1937-1987, has been pleased to approve of the following Regulations made by the Director-General of Health and Medical Services for the State of Queensland.

WHEREAS by the Health Act 1937-1987, it is amongst other things enacted that the Director-General may make Regulations: Now, therefore, the Director-General, with the approval of His Excellency the Governor, acting by and with the advice of the Executive Council, does hereby make the following regulations:-
!. These regulations may be cited as The Camping Ground Regulations 1987.
2. The Camp Regulations, 1949 as amended from time to time, are hereby repealed.
3. Forms. ( 1) The forms set forth in the Schedule hereto shall be used for the purposes for which they are respectively applicable.
(2) A form prescribed by these regulations shall be completed in accordance with such directions as are specified in the prescribed form.
(3) In these regulations a reference to a form by number is a reference to the form in the Schedule hereto which bears that number.
4. In these regulations, unless the contrary intention appears-
"Approved" means approved in writing by the Director-General;
"Cabin" means a relocatable home, building or fixed structure (other than a building or structure used exclusively as a manager's or caretaker's quarters and/or an office) in a camping ground and which is used either continuously or intermittently for human habitation;

"Bedding" includes mattresses, pillows, bed linen, blankets, bedclothes, and coverings;
"Camp" when used as a noun, includes any moveable dwelling, cabin, caravan, tent fly, awning and any structure or shelter used as a temporary abode;
"Camping Ground" means any land on which any camp is situated or erected but does not include a wayside camp for the use of drovers, teamsters or other persons whose occupation necessitates the use of such a camp;
"Caravan" means a dwelling place on wheels which can be immediately towed and which is or is required to be registered under the provisions of the Main Roads Act 1920-1984;
"Moveable dwelling" includes any tent, relocatable home, or any van or other conveyance whether on wheels or not, which is used either continuously or intermittently for human habitation;
"Potable water" means water that contains no pathogenic micro- organisms, micro-organisms of intestinal origin, or harmful chemical constituents;
"Proprietor" means, in relation to a camping ground, a person to whom an approval has been granted by the Local Authority pursuant to regulation 8 of these regulations;
"Relocatable home" means a structure (whether on wheels or not) in a camping ground which complies in all respects with the Building Act 1975-1984 for a class I or class III building and which is so designed and/or constructed that it is capable of being moved from place to place;
"Site" means that part of a camping ground marked and set aside for a single camp.
5. The Local Authority of an area shall superintend and see to the execution of these regulations, and shall do and .Provide all such acts, matters and things as may be necessary for supenntending or aiding in their execution.
6. A Local Authority may approve of the use of any land within its area as a camping ground: Provided that a Local Authority shall not approve of the use of any land as a camping ground-
( a) which is low lying or swampy or cannot be drained by natural gravitation;
(b) which is in such a position that any trade, business, manufacture, undertaking or other activity is liable to contaminate any water supply to or for such land or cause any conditions prejudicial to the health of the inhabitants of such land.
7. A person shall not use any land as a camping ground or suffer or permit any land to be used as a camping ground unless and until the Local Authority has approved of the use of such land as a camping ground.

8. ( 1) A person who desires the approval of a Local Authority to use any land as a camping ground shall make application to the Local Authority in Form 1.
(2) An application in Form 1 shall be accompanied by a plan of the proposed camping ground drawn to scale showing the following particulars:-
(a) the location and real property description of such land;
(b) the boundaries of such land;
(c) the proposed location, number, designation and type of sanitary conveniences to be provided;
(d) the proposed location, number and designation of ablutionary facilities to be provided;
(e) the proposed location and number of laundry facilities to be provided;
(f) details of the proposed water reticulation;
(g) the proposed drainage plan;
(h) details of each site clearly defined and bearing a distinguishing mark or number;
(i) any other particulars which the Local Authority may require.
(3) Every plan submitted to a Local Authority pursuant to this regulation shall be deemed to be part of the application for approval to use land as a camping ground and shall be retained by the Local Authority.
(4) The approval of an application made pursuant to this regulation shall be in Form 2.
9. (1) In any case where the proprietor of a camping ground has been convicted of an offence against the provisions of these regulations the Local Authority may revoke the approval granted pursuant to regulation 8.
(2) A Local Authority may at any time reinstate an approval revoked pursuant to this regulation.
10. The proprietor of a camping ground shall not make any alterations or additions or suffer or permit any alterations or additions to be made to such camping ground without the approval of the Local Authority.
11. (1) The proprietor of a camping ground who desires approval to make alterations or additions to a camping ground shall make application to the Local Authority in Form 3.
(2) An application in Form 3 shall be accompanied by a plan drawn to scale detailing proposed alterations or additions.
(3) Every plan submitted to a Local Authority pursuant to this regulation shall be deemed to be part of the application to make

alterations or additions to a camping ground and shall be retained by tlie Local Authority.
(4) The approval of an application made pursuant to this regulation shall be in Form 4.
12. The proprietor of a camping ground established, altered or added to in accordance with an approval granted by the Local Authority under the provisions of these regulations shall maintain such camping ground in accordance with the approval.
13. (1) The proprietor of a camping ground shall not transfer to another person an approval granted by the Local Authority pursuant to regulation 8 of these regulations without the approval in writing of the Local Authority.
(2) The proprietor of a camping ground who desires to transfer to another person an approval granted by the Local Authority pursuant to regulation 8 of these regulations shall make application to the Local Authority in Form 5.
(3) The approval of an application made pursuant to this regulation shall be in Form 6.
14. The proprietor of a camping ground shall-
(a) provide and maintain an adequate supply of water to the camping ground;
(b) supply potable water for drinking, cooking and ablutionary purposes;
(c) cause such potable water at all times to be protected from contamination;
(d) cause every outlet within a camping ground that receives non-potable water to display a permanent, prominent and legible sign: "UNSUITABLE FOR DRINKING";
(e) provide for the exclusive use of the occupants thereof separate sanitary conveniences for each sex in accordance with the following table:-

Provided that:-
(i) a cabin which is fitted with a sanitary convenience shall be deemed not to be a site for the purpose of this subregulation;

(ii) a proprietor may provide sanitary conveniences in addi- tion to those required by this subregulation;
(f) in any case where 10 or more water closet fixtures are provided, cause as least one such water closet fixture and its compartment or cubicle to be constructed, equipped and provided with access in accordance with AS1428, Code of Practice for Design Rules for Access by the Disabled:
Provided that where only one such water closet fixture is provided, such shall be accessable to both sexes;
(g) cause all sanitary conveniences to be constructed so as to ensure privacy;
(h) provide for the exclusive use of the occupants thereof sep- arate ablutionary facilities for each sex in the ratio of one shower or bath and one hand basin to every 15 sites or part thereof:
Provided that a cabin which is fitted with ablutionary facilities shall be deemed not to be a site for the purpose of this subregulation;
(i) cause such shower or bath to be installed in a separate compartment or cubicle which is constructed so as to ensure privacy;
(j) cause hot and cold water to be reticulated to every shower, bath and hand basin;
(k) provide for the exclusive use of the occupants thereof laun- dry facilities in the ratio of one set of twin wash tubs and one clothes washing machine or washing boiler and one clothes hoist or an equivalent length of clothes line for every 20 sites or part thereof:
Provided that a cabin which is fitted with a set of twin wash tubs and a clothes washing machine or washing boiler shall be deemed not to be a site for the purpose of calculating the number of those items required to be provided;
(I) provide sewerage or a drainage system in conformity with the requirements of the Local Authority for the carrying off and disposal of all wastes from every water closet fixture, urinal, ablutionary facility, laundary facility and camp;
(m) provide, at a distance not more than 10 metres from any site, a waste water disposal point which is-
(i) provided with a water stand pipe;
(ii) provided with an impervious paved area measuring not less than 1 metre X 1 metre and graded to a central drainage inlet which is connected to sewerage or a drainage system;
(n) cause sanitary conveniences and ablutionary facilities to be located not more than 100 metres from and not closer than 6 metres to any site;

( o) cause each site to be clearly defined and legibly marked in accordance with the plan submitted to the Local Authority pursuant to regulation 8;
(p) not erect or locate a camp, or suffer or permit a camp to be erected or located, at any place other than on a site;
( q) not erect or locate more than one camp, or suffer or permit more than one camp, to be erected or located on ·a site at any one time;
(r) not erect or locate a camp, or suffer or permit a camp to be erected or located, closer than 3 metres to any other camp;
(s) not erect a camp, or suffer or permit a camp to be erected, unless and until such camp is weatherproof, in good repair, fit for human habitation and in a clean and sanitary condition;
(t) not cause or suffer or permit a camp to be occupied by more persons than such camp is designed to accommodate;
(u) at all times cause the camping ground, its buildings, sanitary conveniences and other facilities to be maintained in a clean, sanitary and safe condition.
15. In any case where the proprietor of a camping ground supplies bedding:-
(a) same shall be maintained at all times in a clean and sanitary condition and free from vermin;
(b) all bed linen in a camp shall be changed and replaced with clean bed linen when the camp is vacated and before the camp is again occupied by another person.
16. A person who occupies a camp in a camping ground shall- (a) at all times maintain such camp and its site in a clean, tidy
and sanitary condition;
(b) deposit all refuse generated at such camp in the refuse containers provided for that purpose;
(c) dispose of all liquid wastes in the disposal systems provided for that purpose;
(d) not cast or throw waste water on to the ground;
(e) not permit waste water to discharge on to the ground from such camp;
(f) use all sanitary conveniences, ablutionary facilities and laundry facilities in a clean and sanitary manner;
(g) except where bedding is supplied by the proprietor of the camping ground, provide clean bedding for each occupant of such camp;
(h) not permit such camp to be occupied by more persons than it is designed to accommodate.
17. Where a Local Authority sets aside as a camping ground any land vested in or under the control of such Local Authority, the

provisions of these regulations shall forthwith apply to such camping ground and to such Local Authority and to all persons concerned, and for the purposes of these regulations such Local Authority shall be deemed to be the proprietor of such camping ground.
18. An officer may serve a notice in writing, signed by him, upon any person whom he believes, on reasonable grounds, has contravened or failed to comply with any provision of these regulations, requiring that person to do such acts and things and perform such work, within a time specified in the notice, as the officer considers necessary to rectify the contravention of or the failure to comply with these regulations.
19. (1) A person who contravenes or fails to comply with any provision of these regulations commits an offence against these regulations.
Penalty: 8 penalty units.
(2) A person who-
(a) fails to do that which he is directed to do;
(b) does what he is forbidden to do, by a person acting under the authority of these regulations,
commits an offence against these regulations.
Penalty: 8 penalty units.
