34;Member of the Court"-the person by whom the Court is provisionally constituted;. 34;Zone"-The divisions respectively into which the City is divided by the Plan for the purposes of the Plan. Such representations must be made within thirty days of the City Clerk giving the notice in terms of subsection (14) of this section.
Brisbane City Council is responsible for managing, implementing and enforcing the plan. Such order in Council shall describe any change to the plan notified so that it can be identified. In doing so, the council must obtain the consent of the minister (which the minister can give or refuse) before taking the decision to take the land.
The Council shall, to the satisfaction of the Minister, comply in all respects with an order or instruction issued to it by the Minister. An appeal to the Court by-. a) an applicant specified in this subsection against the decision of the Council member, his delegate on his application;. 6) (a) Subject to paragraph (b), where the Councilor proposes his delegate to grant an application to which subsection (1) applies, the City Clerk must give notice accordingly to each person who has done and filed as prescribed by subsection (1) 5) an objection to the granting of the application.
In the case of an appeal, in making its decision, the Council or its delegate is bound by the determination of the appeal. A person seeking an amendment of an application referred to in paragraph (a) shall make an application to the Council for that amendment and the application shall set out full particulars of the proposed amendment. The applicant who is dissatisfied with the decision of the advisor, his delegate, according to subsection (1), may appeal to the Court against that decision.
The provisions of section 6 shall apply to the drafting and adoption of planning ordinances by way of plan amendment. For the purposes of subsection (4), those ordinances which form part of the Plan prepared and approved as provided by the City of Brisbane City Plan Amendment Act 1976 shall be deemed to be planning ordinances.
