2 s. 1 GOVERNOR’S SALARY ACT 1872-1984 S. 4 A

An Act to Regulate the Salary of Officers Administering the Government of Queensland and for other Purposes.

[ASSENTED TO 2 AUGUST, 18721 BE IT ENACTED by the Queen’s Most Excellent Majesty by and with the advice and consent of the Legislative Council and Legislative Assembly of Queensland in Parliament assembled and by the authority of the same as follows:-

1. Governors shall receive half salary from embarkation. An officer appointed to be Governor of Queensland shall receive half salary from the date at which he embarks to assume the Government whether the port of embarkation be in England or in another colony or elsewhere.

2. Unlless the former Governor continues in office until the arrival of his successor. If however a Governor continues in the tenure of his office until the arrival of his successor the latter officer shall not be entitled to any portion of the salary until he has assumed the duties of his office.

3. If the office is vacated after ernbarkation the Governor shall salary from date of the vacancy. If the office of Governor is vacated after the incoming Governor has embarked to assume the Government he shall receive half salary from the date of such vacancy.

4 ~ . Amount of salary. (1) The salary of the Governor of Queensland (a) on and from l January 1984 and until another rate is declared pursuant to paragraph (b), at the rate of $70 000 per annum; and

(b) from time to time, at a rate per annum declared by Order in Council.

(2) An Order in Council made for the purposes of subsection (1) shall operate on and from the date of its publication in the Gazette or where a date is specified therein from which it is to operate, which date may be before or after the date of such publication, on and from that date and shall be tabled in the Legislative Assembly within 14 sitting days from the date of such publication.

(3) The salary of the Governor shall be charged upon and be payable out of the Consolidated Revenue Fund, which is hereby appropriated accordingly.

5. Salary of officer administering the Government. An officer provisionally administering the Government of Queensland during the absence or incapacity of the Governor or during a vacancy of the office shall, subject to this section, receive salary at the rate payable under this Act to the Governor.

If he is the holder of any other office in respect whereof sala payable he shall receive the salary of that office and, additionally, sa ary at a rate based on the excess of the salary payable to the Governor under this Act over that payable in respect of the other office held by him.

Any moneys in excess of the appropriation made by section 4~

hereof, required for the purposes of this section shall be charged upon and payable out of the Consolidated Revenue Fund, which is hereby appropriated accordingly.

6. Such officers may appoint staff on full salary. An officer so administering the Government may appoint the same staff as a Governor and the persons so appointed shall receive the full salary of their respective offices.

7, Such officers are entitled to the full allowances of a Governor.

An officer so administering the Government shall be entitled to the full allowances o f a Governor if there is money available but he shall only receive so much of the vote as is proportioned to the time he is in office.

8. (Repealed).

Repealed by Act of 1949, 13 Geo. 6, No. 20.

9. Short title. This act shall come into force on the first day of October next and may be cited for all purposes as “The Governor’s Salary Act of 1872.”
