An Act to Provide for the Transfer to Brisbane City Council of the Somerset Dam and the Hydro-electric Works appurtenant thereto and for other purposes.

[Assented to 16 April, 1959]

BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:-

1. (1) Short title. This Act may be cited as "The City of Brisbane (Water Supply) Act of 1959. "

(2) Interpretation. This Act shall be read as one with "The City of Brisbane Acts, 1924 to 1959. "

Collective title conferred by Act of 1978, No. 88, s. 3 (2).

2. Meaniog of terms. In this Act, unless the context otherwise indicates or requires, the following terms shall have the meanings respectively assigned to them, that is to say:-

" Brisbane City Council "-Brisbane City Council under and within the meaning of" The City of Brisbane Acts, 1924 to 1959",

"Co-ordinator-General of Public Works "-The Co-ordinator- General of Public Works under and within the meaning of

"The State Development and Public Works Organisation Acts, 1938 to 1958 ";

"Hydro-electric Works " -The works for the production and generation of hydro-electric power at the Somerset Dam authorised by the Governor in Council, pursuant to "The Bureau of Industry Acts, 1932 to 1943, " by Order in Council published in the Gazette of the twentieth day of November, one thousand nine hundred and forty-eight, at page two thousand seven hundred and fifty-five;

" The Somerset Dam "-The dam on the Stanley River constructed pursuant to sections six and 6c of " The Bureau of Industry Acts, 1932 to 1943," the plan whereof, which is hereby approved, is held by the Co-ordinator-General of Public Works and numbered 3/H4/2000: The term includes all works, buildings, structures, plant, machinery, equipment, fittings and things constructed, installed or provided as necessary, or convenient for the purposes of, or connected with or appurtenant to such dam;

" Year " -The period of time from and including the first day of July in one calendar year to and including the thirtieth day of June in the next following calendar year.

3. Capital cost of the Somerset Dam. Subsection three of section 6c of" The Bureau of Industry Acts, 1932 to 1943," shall continue to apply with respect to the capital cost of the Somerset Dam incurred by the Treasurer of Queensland subject-

(a) In respect of the portion of such capital cost incurred by the said Treasurer up to and including the thirty-first day of December, one thousand nine hundred and forty-two, to "The Somerset Dam Financial (War Adjustment) Act of 1943 ";

(b) In respect of the portion of such capital cost incurred by the said Treasurer after the thirty-first day of December, one thousand nine hundred and forty-two, and up to and including the thirty-first day of December, one thousand nine hundred and fifty-four, to " The Somerset Dam (Finance) Act of 1954 ";

and

(c) In respect of the portion of such capital cost incurred by the said Treasurer after the thirty-first day of December, one thousand nine hundred and fifty-four, in completing the said dam, to section four .of this Act, it being hereby declared that, save section four of this Act, nothing in this Act shall pre- judice or affect in any way the .operati.on of the said subsection

three or of either of the Acts hereinbefore mentioned in this section.

4. Capital cost of completing the Somerset Dam. (1) For the purposes of this section the Somerset Dam shall be deemed to have been completed on the thirtieth day of June, one thousand nine hundred and fifty-nine.

(2) Notwithstanding the provisiDns .of sectiDn 6c of " The Bureau of Industry Acts, 1932 to 1943," it is hereby declared that Brisbane City Council and the C.ouncil .of the City .of Ipswich shall make tD the Treasurer .of Queensland payment under, subject tD and in accDrdance with this sectiDn in respect .of the capital CDst .of cDmpleting the Somerset Dam incurred by the Treasurer .of Queensland after the thirty-first day of December, .one thousand nine hundred and fifty-fDur.

(3) For the purposes of this section, the capital cost of the Somerset Dam incurred by the said Treasurer after the thirty-first day of December, one thousand nine hundred and fifty-four, in completing the said dam shall comprise the following:-

(a) All moneys expended or to be expended in defraying that capital cost; and

(b) All interest paid or payable by the said Treasurer up to and including the thirtieth day of June, one thousand nine hundred and fifty-nine, on any and every amount of money applied by him from the Loan Fund Account of Consolidated Revenue in defraying that capital cost,

and the amount of that capital cost shall be ascertained accordingly.

(4) The amounts of the payments to be made under this section by Brisbane City Council and the Council of the City of Ipswich in respect of the capital cost of the Somerset Dam incurred by the Treasurer of Queensland after the thirty-first day of December, one thousand nine hundred and fifty-four, in completing the said dam shall be-

(a) Brisbane City Council-one thousand, one hundred and thirty-two dollars; and

(b) The Council of the City of Ipswich-sixty-eight dollars,

or each and every two thousand dollars of the amount, ascertained as prescribed by subsection three of this section, of that capital cost.

(5) The amounts as prescribed by subsection four of this section of the payments to be made under this section by Brisbane City Council and the Council of the City of Ipswich shall be deemed to be loans duly made to them respectively by the Treasurer of Queensland under " The Local Government Acts, 1936 to 1958," "The Local Works Loans Acts, 1880 to 1918," and in the case of the City of Brisbane, "The City of Brisbane Acts, 1924 to 1959."

(6) Each such loan-

(a) Shall have a currency of thirty years commencing on the first day of July, one thousand nine hundred and fifty-nine;

(b) Shall bear interest at the rate of four dollars seventy-five cents per centum per annum which interest shall commence to run on the first day of July, one thousand nine hundred and fifty-nine; and

(c) Shall be liquidated by the payment to the said Treasurer by Brisbane City Councilor, as the case requires, the Council of the City of Ipswich on the first days of July (save the first day of July, one thousand nine hundred and fifty-nine) and January respectively in every year, beginning with the year commencing on the first day of July, one thousand nine hundred and fifty-nine, of one moiety of the annual payment required to redeem the loan within the currency thereof by equal annual instalments compounded of principal and interest.

5. Payment for Hydro-electric Works. (1) It is hereby declared that Brisbane City Council shall make to the Treasurer of Queensland payment under, subject to and in accordance with this section of two hundred and ninety-four thousand three hundred and thirty-six dollars in respect of the capital cost of the Hydro-electric Works.

(2) The amount as prescribed by subsection one of this section of the payments to be made to the Treasurer of Queensland by Brisbane City Council shall be deemed to be a loan duly made to that Council by the Treasurer of Queensland under" The City of Brisbane Acts, 1924 to

1959," and" The Local Works Loans Acts, 1880 to 1918."

(3) Such loan-

(a) Shall have a currency of twenty-one years commencing on the first day of July, one thousand nine hundred and fifty-nine;

(b) Shall bear interest at the rate of five dollars fifty cents per centum per annum which interest shall commence to run on the first day of July, one thousand nine hundred and fifty- nine; and

(c) Shall be liquidated by the payment to the said Treasurer by the said Council on the first days of July (save the first day of July, one thousand nine hundred and fifty-nine) and January respectively in every year beginning with the year commencing on the first day of July, one thousand nine hundred and fifty- nine, of one moiety of the annual payment required to redeem the loan within the currency thereof by equal annual instalments compounded of principal and interest.

Decimal currency reference substituted pursuant to section 7 of Decimal Currency Act of 1965.

6. Remedies of the Treasurer. For the purposes of the recovery of all moneys payable to him under section four or section five of this Act which shall not have been duly paid to him, the Treasurer of Queensland shall have and may exercise all of the powers and authorities had by him under" The Local Government Acts, 1936 to 1958," and in the case of Brisbane City Council" The City of Brisbane Acts, 1924 to 1959," with respect to the recovery by him of repayments overdue and in arrears of loans made by him.

7. Power to levy rates. For the purposes of raising any moneys payable under this Act, Brisbane City Council or the Council of the City of Ipswich may make, levy and recover all such rates as could be made or levied for the purpose of repaying any loan borrowed from the Treasurer of Queensland under the authority of " The Local Government Acts, 1936 to 1958," or, in the case of Brisbane City Council, that Act and" The City of Brisbane Acts, 1924 to 1959."

8. Certificate by Treasurer. A certificate under the hand of the Treasurer of Queensland certifying all or any of the following, namely:-

(a) The amounts of the payment to be made under section four or section five of this Act by Brisbane City Council or the

(b) The amounts of the annual payments by which any amounts payable under section four or section five of this Act by Brisbane City Council or under section four of this Act by the Council of the City of Ipswich are to be liquidated; and

(c) An amount as being overdue and in arrears upon a day specified in the certificate in respect of any such payment to be made by either of the said Councils,

shall, upon its production in evidence in any proceeding in which proof of the matter or matters certified to therein is relevant, be evidence thereof and, in the absence of evidence in rebuttal, shall be conclusive evidence thereof.

9. The Somerset Dam transferred to Brisbane City Council. On and from the first day of July, one thousand nine hundred and fifty-nine, by virtue of this Act, and without any transfer, conveyance, or assignment-

(a) The Somerset Dam and the Hydro-electric Works shall be divested from the Corporation of the Co-ordinator-General of Public Works constituted by .. The State Development and

Public Works Organisation Acts, 1938 to 1958" (herein referred to as the .. said Corporation to) and shall be vested in and shall thereupon and thereafter be maintained, operated, protected, managed and controlled by Brisbane City Council;

and

(b) [First Schedule] The estate in fee-simple in all lands described in the First Schedule to this Act shall be divested from the said Corporation and shall vest in Brisbane City Council.

10. Powers of Brisbane City Council. (1) Subject to this Act, on and from the first day of July, one thousand nine hundred and fifty-nine, Brisbane City Council shall, and is hereby empowered to, maintain, manage, control, operate and safeguard the Somerset Dam and the Hydro-electric Works and all lands, works and things appurtenant to the Somerset Dam or the Hydro-electric Works.

(2) The Council may, pursuant to its powers under this section, from time to time renew any of the existing works or things, or construct such fresh works and things as it deems necessary or convenient, appurtenant to the Somerset Dam or the Hydro-electric Works and shall and is hereby empowered to maintain, manage, control, operate and safeguard any such renewed or new works and things.

(3) For the purpose of taking any land granted in fee-simple, either within or without the Area of the City of Brisbane, required by it for the purpose of any work or thing to which this section relates Brisbane City Council shall be a constructing authority under .. The Acquisition 0/ Land Act 0/1967 f t .

11. Roads and railways. Brisbane City Council shall-

(a) Construct or reconstruct, or arrange with the Local Authority concerned to construct or reconstruct at its expense, any deviation of a road, or of any part or portion of a road, or any bridge or other work appertaining to a road; and

(b) Pay to the Commissioner for Railways the cost of the construction of any deviation of a railway, or of any part or portion of a railway, constructed under" The Railways Acts, 1914 to 1958,"

where the construction or reconstruction of the deviation of a road, or part or portion of a road or bridge or other work appertaining to a road, or the construction of a deviation of such a railway, or of any part or portion of such a railway, is necessary by reason of inundation resulting from the storage of water in the Somerset Dam.

12. Liability to rates. [First Schedule] (1) Any land described in the First Schedule to this Act shall be rateable land under and within the meaning of "The Local Government Acts, 1936 to 1958," and additionally Brisbane City Council shall be liable to pay and discharge all charges and assessments in respect of any such land duly made by any person or authority other than the Local Authority at all times on and after the first day of July, one thousand nine hundred and fifty-nine, during which any person other than Brisbane City Council occupies that land under any lease, agreement to lease, license, or other contract, agreement, or arrangement entered into by him with Brisbane City Council or the Co-ordinator-General of Public Works.

(2) Notwithstanding the provisions of the Valuation of Land Act 1944-1977 or any rule of practice, in ascertaining the unimproved value of any land described in the First Schedule to this Act the Valuer-General shall not have regard to the fact or extent of inundation of such land by the waters of Somerset Dam, but otherwise the provisions of that Act shall apply.

This subsection shall be deemed to have been enacted on 31 March 1963.

13. Ordinances. The power of Brisbane City Council to make ordinances shall include power to make with respect to-

(a) [First Schedule] The Somerset Dam and the lands described in the First Schedule to this Act and any other lands for the time being vested in the said Council in relation to the Somerset Dam;

(b) [Second Schedule] The works at Mount Crosby within the meaning of and constructed pursuant to "The Metropolitan Water Supply and Sewerage Acts, 1909 to 1959," and in relation to those works, the lands described in the Second

Schedule to this Act;

Manchester within the meaning of and constructed pursuant to

"The Metropolitan Water Supply and Sewerage Acts, 1909 to 1959," and in relation to those works the lands described in the Third Schedule to this Act,

ordinances-

(i) Safeguarding, and in particular securing against trespass, injury, misuse, or use for or in connection with any purpose not authorised by the Acts hereinbefore mentioned in this section the Somerset Dam or any works or lands hereinbefore specified in this section; and

(ii) Providing for, regulating and controlling (which power to regulate and control shall include power to prohibit either generally or in respect of any specified purpose) the use by the public of any of the lands hereinbefore mentioned in this section.

14. Repeals. (1) This section shall come into operation on the first day of July, one thousand nine hundred and fifty-nine.

(2) Subsections one, two and four of section 6c and subsections one, two, three and five of section 6D of" The Bureau of Industry Acts, 1932 to 1943," are repealed.

(3) The Stanley River Works Board constituted pursuant to subsection two of section 6c of" The Bureau of Industry Acts, 1932 to 1943," is abolished and the offices of the members thereof terminated.

(4) Save section eleven of this Act, nothing in this Act shall prejudice or affect in any way the operation with respect to Brisbane City Council of subsection four of section 6D of" The Bureau of Industry Acts, 1932 to 1943."

15. (1) Savings. This Act shall not prejudice or affect the Agreement made on the twenty-eighth day of September, one thousand nine hundred and forty-nine, between City Electric Light Company Limited and the Co-ordinator-General of Public Works, save that on and from the first day of July, one thousand nine hundred and fifty-nine, Brisbane City Council shall become and be a party thereto as the successor to the Co-ordinator-General of Public Works and accordingly every reference in that Agreement to the Co-ordinator-General of Public Works shall be

read as referring to Brisbane City Council.

(2) First Schedule. This Act shall not affect any lease, agreement to lease, easement, license, or other contract or agreement in respect of any land described in the First Schedule to this Act, or any estate or interest in any such land, or any improvements on any such land, made, granted or entered into by the Co-ordinator-General of Public Works and in force on the first day of July, one thousand nine hundred and fifty-nine, save that, on and from that date, Brisbane City Council shall

become and be a party to every such lease, agreement to lease, easement, license, or other contract or agreement as the successor to the Co-ordinator-General of Public Works and accordingly every reference in any such document or in any writing appertaining thereto shall be read

as referring to Brisbane City Council.

(3) This Act shall not prejudice or affect the arrangements entered into by the Stanely River Works Board in relation to the supply of water to the township at the Somerset Dam, the bridge over the Stanely River immediately downstream from the Somerset Dam, and to the Bridge over the Brisbane River at Murrumba save that, on and from the first day of July, one thousand nine hundred and fifty-nine, Brisbane City Council shall become and be a party to those arrangements in succession to the aforesaid Board and may and is hereby authorised to carry out those arrangements.

(4) The regulations made under "The State Development and Public Works Organisation Acts, 1938 to 1958," entitled" The Somerset Dam Regulations, 1949," and published in the Gazette of the fifth day of November, one thousand nine hundred and forty-nine, shall continue in force on and after the first day of July, one thousand nine hundred and fifty-nine, until the same or any of them are repealed, amended or otherwise modified by ordinances made by Brisbane City Council, and the purpose of the continuance in force as aforesaid of those regulations references therein to the Co-ordinator-General of Public Works shall be read as referring to Brisbane City Council.
