THE Deputy Governor, for and on behalf of His Excellency the Governor, acting by and with the advice of the Executive Council, in pursuance of the provisions of "The Children's Services Act of 1965," has been pleased to make the following Regulations under and for the purposes of the said Act:
Provided that the making of these Regulations shall not-
(a) Affect the operation of the Regulations relating to the Westbrook Training Centre (previously known as "The Farm Home for Boys, Westbrook") made and published under
"The State Children Acts, 1911 to 1955," which said Regulations remain in force under and for the purposes of
"The Children's Services Act of 1965"; or
(b) Affect any previous operation of any other Regulation made under the provisions of any of the repealed Acts set out in Schedule I to "The Children's Services Act of 1965"·
or anything duly done or suffered thereunder; or
(c) Affect any right, privilege, obligation or liability acquired, accrued or incurred under any such Regulation as aforesaid;
or
(d) Affect any penalty, forfeiture or punishment incurred in respect of any offence committed against any such Regulation as aforesaid; or
(e) Affect any investigation, legal proceeding or remedy in respect of any such right, privilege, obligation, liability, penalty, forfeiture or punishment as aforesaid:
And provided further that any such investigation, legal proceeding or remedy may be instituted, continued or enforced and any such penalty, forfeiture or punishment may be imposed as if the said Regulation were still in force.
Except as is otherwise provided in paragraph (a) of the above proviso all Regulations made under the provisions of any of the repealed Acts set out in Schedule I to "The Children's Services Act of 1965" are repealed.

"THE CHILDREN'S SERVICES REGULATIONS of 1966"
PART I-PRELIMINARY
1. Short title. These Regulations may be cited as "The Children's Services Regulations of 1966."
2. Parts. These Regulations are divided into Parts, as follows:- PART I-PRELIMINARY (Regulations 1-4);
PART II-INSTITUTIONS. (Regulations 5-23);
PART Ill-CHILDREN IN NEED OF ASSISTANCE (Regulations 24-27) ;
PART IV-CHILDREN IN NEED OF CARE AND PROTECTION AND CARE AND CONTROL (Regulations 28-35);
PART V-REGISTRATION TO TAKE CHARGE OF A CHILD (Regula- tions 36-40);

3. Interpretation. In these Regulations, unless the context otherwise indicates or requires, the terms defined by section 8 of the Act shall have the same meaning 'as is assigned to them by such section and the following terms shall have the meanings respectively assigned to them, that is to say:-
"Court"-A Children's Court constituted under the Act.
"Delegated Officer"-An Officer to whom the Director has delegated all or any of the powers, authorities, duties and functions of the Director.
"The Act"-UThe Children's Services Act of 1965."
4. Forms. (1) The forms set forth in the Schedule hereto shall be used for the several purposes to which they are respectively applicable:
Provided that no form shall be deemed invalid if it is to the effect of the proper form in the said Schedule with such modification as the circum-
stances may require.
(2) A reference in these Regulations to a form by a number shall be read as a reference to the form so numbered in the said Schedule.
(3) A form prescribed by these Regulations shall be completed in accordance with such directions as are specified in the form as so prescribed.
PART II-INSTITUTIONS
S. Licence of an Institution. A licence of an institution shall be in Form 1.
6. (1) Whenever the governing authority of a licensed institution has notified the Director in writing of a change in the person in charge of such institution, he shall forward the relevant licence to the Director with such notification and the Director shall endorse such change thereon.
(2) Whenever there is a change in the governing authority of a licensed institution or whenever the purpose for which such institution was or was to be established at the time of the issue of such licence is varied, the governing authority named in the licence shall surrender such licence to the Director.
7. Register of children. The register of all children in an institution shall be in Form 2.
8. Notification of reception of a child not being a child in care. The notification to the Director of the identity and reception into an institution of a child, not being a child in care, shall be in Form 3.
9. Authority for licensed institution to receive children in care.
When the Director uses an institution established or licensed pursuant to Part IV of the Act, he shall issue an authority in Form 4 to the person in charge of such institution to receive the child in care.
10. Notification of reception of a child in care. When a child in care is received into an established or licensed institution, the person in charge of such institution shall notify the Director in Form 5 that the child has been received. The person in charge of the institution shall also notify the Director in Form 5 should any child in care cease to be resident in such institution.
11. Medical examination of a child in care. When a child is received in an established or licensed institution, such child shall undergo medical and dental examination and in addition to receiving and recording the result of such examinations, the governing authority or person in charge of such institution shaH notify the Director of such result.
12. Order for a child to be examined medically. The Director may order the medical or dental examination of any child in an established or licensed institution at any time that he or an officer of the Department considers it necessary, and the person in charge of any such institution shall have any child therein undergo medical or dental examination when he considers it necessary.
13. Treatment, and administration of medicaments. The governing authority of an established or licensed institution shall ensure that all medical and dental treatment received by and medicaments given to a child in such institution are in accordance with medical or dental instructions: Provided that if the governing authority considers ·such treatment or medicaments are not for the benefit of such child, it shall bring the matter under the notice of the Director who shall refer the matter to the Director-General of Health and Medical Services who may order the treatment or medicaments to be continued or altered or discontinued.
14. Illness and death of a child in care. The governing authority of an established or licensed institution shall report promptly to the Director any illness or injury suffered by a child in care resident in such institution and shall report the death of any child so resident to the Director without delay.
15. Filing. of medical reports. All medical reports on children in an established or licensed institution shall be filed in the records of the institution, and shall be produced to the Director or an Officer of the Department on request.
16. Attendance at school. (1) The governing authority of an established or licensed institution shall ensure that children who are required to attend school in accordance with "The Education Act of 1964" do so attend and' shall also' ensure that such other children as are required by the Director to attend school do so attend.
(2) The Dir.ector shall provide each child in care in an established or licensed institution and attending school with such school text-books and other requisites as he may consider essential for the education of the child.
17. Religious instruction. The governing authority shall ensure that children resident in an established or licensed institution receive religious instruction in accordance with the respective religious denomination of such children. Officiating ministers of religion shall give religious instruction and spiritual guidance to children of their respective denominations in the institution.
18. Rate' of payment to licensed institutions for maintenance of children in care. The Director shall pay to the governing authority of a licensed institution for the maintenance of a child in care resident in such institution, a sum calculated at the rate of $4.S0 per week:
Provided that if the child in care is attending a secondary school the Director shall pay such governing authority an additional $1.00 per week in respect of such child together with an amount of SOc per week for such child's use as pocket money.
19. Visiting times. Subject to the approval of the Director, the governing authority
of
an established or licensed institution shall specify times during which parents or persons approved by the Director or an Officer of the Department, authorised by him for such purpose, may visit children in the institution: Provided that the governing authority may authorise visits on such other occasions as may in its opinion, be reasonable and in the interests of a child.20. Custody of a child in an institution. A child in care in an established or licensed institution shall not be given into the custody of any person other than an officer of the.. Departme,nt or a person employed at such institution without the authority of the Director or an officer of the Department authorised by him for such purpose.
21. Director to be notified of absence of the person in charge of the institution.. The governing authority of a licensed institution shall give prior notification to the Director when it is necessary for the person in charge to be absent from such institution for a period longer than forty- eIght hours, and shall advise the Director the name of the person who will be accepting the responsibilities of the person in charge during the temporary absence of such person.
22. Clothing of children. When a child in care becomes a resident of an established or licensed institution, the Director shall arrange for adequate clothing to be provided for the needs of such child.
The governing authority shall maintain such clothing in good order and condition, and shall replace any worn garment ensuring that the child is at all times adequately and reasonably clad.
23. Punishment of children for misbehaviour. (1) The person in charge of an institution may punish any child for misconduct.
(2) Without in any way limiting the meaning thereof the term
"misconduct" for the purpose of this Regulation shall mean and include all or any of the following:-
(a) Failing to comply with the rules of the institution;
(b) Assaulting any person;
(c) Using insulting, obscene, indecent, or profane words;
(d) Using threatening words to any person;
(e) Behaving in an offensive, threatening, insolent, insulting, disorderly, obscene, or indecent manner or behaving irrever- ently at or during divine service or prayers;
(f) Being untruthful to an officer of the institution or a visitor;
(g) Being guilty of dishonesty;
(h) Wilfully destroying, damaging, or disfiguring any property at the institution;
(i) Inciting, counselling, or procuring any other child to commit any offence;
(j) Absconding or attempting to abscond;
(k) Making, concealing, or having in his possession without authority, any tool, weapon, knife, key, implement, or other thing intended to effect, or being capable of effecting, the escape of any child, or the carrying out of any unlawful purpose;
(I) Mutineering or taking part in any riot or tumult by children;
(m) Being idle, careless or negligent at work, refusing to work, or wilfully mismanaging his work;
(n) Inflicting injury upon himself or counselling or procuring another to do so, or preventing any injury or sore from healing; and
(0) Conducting himself in such manner as to prejudice the good order and discipline of the institution.
(3) The person in charge may punish any child guilty of misconduct by anyone ,or more 'Of the following methods:-
(a) Forfeiture of rewards or priviliges, forfeiture or reduction of status or temporary loss of recreation;
(b) Special duty for any period not exceeding seven days;
(c) Physical exercises, with proper rests under supeIVision for a period not exceeding thirty minutes on anyone day and not extending beyond a total period of seven days;
(d) Corporal punishment.
( 4) Every effort shall be made to enforce discipline without the use of corporal punishment.
(5) Corporal punishment shall be subject to the following conditions: -
(a) It shall not be inflicted on any female child;
(b) It shall be inflicted not otherwise than with a leather strap of a type approved by the Director or an Officer of the Department so authorised by him and shall be applied over the child's ordinary cloth trousers;
(c) It may only be administered by or under the direction and supervision of the person in charge or in his absence by. or under the direction and supervision of the person acceptmg the responsibilities of the person in charge in accordance with Regulation 21 of these Regulations and in every case the presence of another suitable witness. The person in charge or person accepting his responsibilities and the witness shall endorse the punishment book with details of the punishment and the reason therefor and shall sign such endorsement;
(d) It shall be administered as seldom as possible and only when absolutely necessary for discipline;
(e) It shall not be inflicted in the presence of other children in the institution;
(f) It shaH not be inflicted on any child if the Director or a medical practitioner has given any direction to the contrary in respect of such child.
(6) A child shall not be punished by-
(a) Being dosed with medicine or any other substance; or
(b) Being compelled to hold himself in a constrained or fatiguing position.
(7) A child shaH not be aHowed to administer any form of punish- ment to any other child.
(8) Any punishment inflicted under this Regulation may at any time be terminated or reduced by the person who ordered it, or by the Director.
(9) Every complaint received and punishment inflicted in respect of a child shaH be recorded in a punishment book and such book shall be produced t~ the Director or an officer of the Department on demand.
( 10) The person in charge or any other officer of the institution shall not strike or otherwise apply physical force to the person of a child otherwise than in accordance with· this Regulation. Provided that such force may be applied as is reasonably necessary for self defence and preservation or defence of a child or other person or property, and also such force as is reasonably necessary to subdue a recalcitrant or mutinous child or to prevent absconding or to retake an absconder.
( 11) For the purposes of this Regulation, the term "child" includes a "child in care".
PART III--CHILDREN IN NEED OF ASSISTANCE
24. Rate of assistance. (1) The weekly rate of payment for assistance in respect of a child shall be $2.50.
(2) The Director may supply each child attending school with such school text-books and other requisites as he considers necessary.
25. Form of application for family assistance. An application for assistance under Part V of the Act shall be in Form 6.
26. Form of report on application for family assistance. An officer of the Department, a police officer, or other person required or requested to report on any application for family assistance shall furnish such report in Form 7.
27. Form of report on circumstances of applicants in receipt of family assistance. A person in receipt of family assistance shall furnish to the Director a report on his circumstances in Form 8 at least once in every six months or at such other times as the Director may require.
PART IV-CHILDREN IN NEED OF CARE AND PROTECTION AND CARE AND CONTROL
28. Voluntary admission to care and protection. An application to admit a child to the care and protection of the Director shall be in Part I of Form 9.
29. Declaration that a child shall be admitted to care and protection.
A declaration that a child be admitted to the care and protection of the Director shall be in Part II of Form 9.
30. Application by parent or guardian to undertake care and protection. An application by a parent or guardian to undertake care and protection of a child shall be in Form 10.
31. Taking a child to institution. Whenever-
(a) The Director has declared a child to be admitted to his care and protection; or
(b) A Court has ordered that-
(i) a child be admitted to the care and protection of the Director; or
(ii) a child be admitted to the care and control of the Director;
such declaration or order shall be sufficient authority to any police officer or officer of the Department to take such child to such institution as the Director or a District Officer of the Department or a delegated officer may request. Such request shall be in Form 11.
32. General conditions in relation to a child in need of care and protection placed under the protective supervision of the. Director •.
A.
child in need of care and protection placed under the protective supervISIon of the Director shall-(a) Be of good behaviour during the period of supervision;
(b) Obey the lawful instructions of the Child Welfare or Supervision Officer assigned to him;
(c) Report and receive visits as directed by the Child Welfare or Supervision Officer;
(d) Attend school regularly and punctually each school day if of compulsory school age in accordance with "The Education A ct of 1964," or if otherwise required;
(e) Secure regular employment if not required to attend school
33. Duties of persons with whom a child who is in need of care and protection is placed under the protective supervision of th~ Director: . A person having the care of a child placed under the protectIve supervlSlon of the Director shall-
(a) Provide him with adequate food, clothing, lodging and care;
(b) Arrange for his regular and punctual attendance at school if of compulsory school age, in accordance with "The Education Act of 1964," or if otherwise required;
(c) If he is over school age and is not required to attend school, secure regular employment for him of a nature approved by the Director, and in the event of failure to obtain employment or loss of employment, report immediately such fact in writing to the Director;
(d) Notify the Director in writing immediately of every change of address, change of school or employment;
(e) Notify the Director immediately he leaves his home or place of abode without the approval of his parent or guardian or where necessary the Child Welfare or Supervision Officer;
(f) Permit any officer of the Department to visit the child at the place at which he resides and to make such enquiries as may be necessary to ascertain whether the conditions of the order and the requirements of the Act and Regulations are being complied with.
34. General conditions in relation to a child in need of care and control or other person placed under supervision. A child or other person placed under the supervision of the Director or, as the case may be, the Chief Probation Officer, shall-
(a) Be of good behaviour;
(b) Abstain from violation of the law;
(c) Obey the lawful instructions of the Chief Probation Officer, a Probation Officer or, as the case may be, the Child Welfare or Supervision Officer assigned to him;
(d) Report and receive visits as directed by the Chief Probation Officer, a Probation Officer or, as the case may be, a Child Welfare or Supervision Officer;
(e) Attend school regularly and punctually each school day if of oompulsory school age, in accordance with "The Education Act of 1964" or if otherwise required;
(f) Notify the Chief Probation Officer, a Probation Officer or, as the case may be, the Child Welfare or Supervision Officer immediately of any change of address, change of employment or change of school;
(g) Not be absent from his place of abode without the permission of the person or persons with whom he has been placed and if absence overnight is involved, not without the prior approval of the Chief Probation Officer, a Probation Officer or, as the case may be, a Child Welfare or Supervision Officer.
35. Duties of persons with whom a child in need of care and control, or other person who is subject to a supervision order is jllaced. A person having the care of a child or other person placed under the :supervision of the Director or, as the case may be, the Chief Probation01ticer shall-
(a) Provide him with adequate food, clothing, l04ging and care;
(b) Arrange for his regular and punctual attendance 'at school each school day if of compulsory school age :in accordance with "The Education Act of 1964" or if tltherwise required;

38. Record of sickness or remcmaL A r.egistered person shall endorse on the back of Form 14 retained by him in respect of any child, a record of any sickness or injury suffered by such child whilst in the care of such registered person, and shall also endorse thereon the date on which a child is removed from the care of such registered person at his registered premises together with the full name and address of the person removing such child.
39. Notification of relllO\'al of a child from registered premises. A registered person shall notify tbe Director in writing within twenty-four hours of tbe removal of a child from his charge at his registered premises
and such notification shall contain the name and address of the person removing the child, and the location of the place to which the child has been removed. If the person removing the child is not the person who will provide such child with care and protection, the registered person must ascertain the full name and address of the person who will provide such care and protection and advise the Director of the name and address of such person.
40. Amount received by registered person for maintenance of a child. The amount of payment received by a registered person for the maintenance of a child under ten years, shall not exceed $16.00 per week.
PART VI-FoSTER PARENTS
41. Form of application to ad as foster -parent. An application for approval to act as a foster parent or foster parents shall be in Form 15.
42. Form of medical certificate on applicants to act as foster parent.
The certificate of a legally qualified medical practitioner to be furnished to the Director by a person applying to act as foster parent shall be in Form 16.
43. Form of report on applicant to ad as foster parent. An Officer of the Department or a person authorised by the Director shall make a report to the Director on a person who has applied to act as a foster parent.
44. Certificate of approval of persons to ad as a foster parent. The Director, on being satisfied that an applicant is a fit and proper person to act as a foster parent, shall certify his approval in Form 17 and shaH forward his certificate of approval to such applicant.
45. Form of authority for foster parent to receive a child. When the Director places a child in care in tin: charge of a foster parent, he shaH issue an authority in Form 4 to such foster parent to receive such child.
46. Notification of the reception of a child by foster parent. When the Director places a child in care in the charge of a foster parent, such foster parent shall notify the Director in Form 5 that the child has been received. The foster parent shall also notify the Director in Form 5 should any child in care cease to be resident in the foster home.
47. Medical examination of children placed in foster care. Before a child is placed in the charge of a foster parent, the Director shall ensure that such child has undergone medical and dental examination and the Director shall inform the foster parent of any medication or medical or dental treatment that is considered necessary.
48. Children to receive treatment prescribed by medical practitioner.
A foster parent shall ensure that all medical and dental treatment is received by and medicaments are given to a child in accordance with the advice of the medical or dental practitioner examining the child:
Provided that if the foster parent considers such medicaments or mc.dical or dental treatment is not for the benefit of the child, he shall bring the matter under the notice of the Director who shall refer such matter to the Director-General of Health and Medical Services who may order such treatment or medication to be continued, altered or discontinued.
49. Foster parent to notify Director of illness or injury suffered by a child. A foster parent shall report promptly to the Director any illness or injury suffered by a child in his charge and shall report the death of any child in his charge to the Director without delay.
50. Foster parent to ensure attendance at school. A foster parent shall ensure that a child in his charge who is required to attend school in accordance with "The Education Act of 1964" does so attend and shall also ensure that any other child who is required by the Director to attend school does so attend.
51. Foster parent to ensure religious instruction. A foster parent shall ensure that a child in his charge receives religious instruction in accordance with the religious denomination of such child.
52. Visiting of a child in foster home. (1) A foster parent may and shall when so required by the Director, permit parents, relatives and friends of a child in care in his charge, to visit such child. If,· in the opinion of the Director or a delegated officer, it is in the interest of a child that it be visited by its parents or relatives but that such visits do not take place at the foster home, a foster parent shall make the child available to an officer of the Department to allow such visits at such places as the Director or such officer may arrange.
(2) A foster parent shall keep an accurate record of all visits by parents, relatives or other persons to a child in care in his charge, showing the name of the visitor and the date of the visit, and shall produce such record to the Director or an officer so authorised by him when so required.
53. Placement of children with person other than a foster parent.
(1) A foster parent shall not permit a child in care in his charge to be placed in the custody of another person without the authority of the Director.
(2) If a child in care absconds from the charge of a foster parent, such foster parent shall advise an officer of the Department immediately and such officer shall place such action in train as he considers necessary for the recovery of the child.
54.. Rate of payment to foster parent for maintenance of a child in care. (1) The weekly rate at which the Director shall pay a foster parent or other person approved by the Director for the care and maintenance of a child in care in his charge shall be $4.50:
Provided that if such child is attending a secondary school, the Director shall pay such foster parent or other person approved by the Director, an additional $1.00 per week in respect of such child, together with an amount of SOc per week for such child's use as pocket money.
(2) The Director shall provide each child in care in ·the charge of a foster parent or other person approved by the Director who is attending school with such school text-books and other requisites as he may consider essential for the education of the child.
55. Clothing of children placed with a foster parent. When a child in care is placed in the charge of a foster parent or other person approved by the Director, the Director shall arrange for adequate clothing to be
provided for the needs of the child. Such foster parent or approved person shall maintain such clothing in good order and condition, and shall replace any worn garments ensuring that the child is at all times adequately and reasonably clad.
56. Notification of change of address by a foster parent. (1) A foster parent shall give to the Director at least two weeks' notice of his intention to change his place of residence and shall specify the address to which he intends tarmove.
He shall ensuretthat all the accommodation available at such new residence for any child in care in his charge shall be adequate and satisfactory to the Director.
(2) If the Director is of the opinion that such accommodation is not adequate and satisfactory, he may take such action in the interest of such child as he deems necessary.
PART VII-EMPLOYMENT OF CHILDREN IN CARE
57. Agreement for employment of a child in care. The Director when arranging for and placing a child in care in employment, shall ascertain whether such employment is governed by an industrial award or agreement. Should such employment not be governed by an industrial award or agreement, an agreement shall be completed between the Director and the employer, prescribing the rates of payment and other conditions of employment of such child, in Form 18.
PART VIII-EMPLOYMENT OF CHILDREN GENERALLY
I-Street trading
58. Form of application for licence to engage in street trading. A parent, guardian or other person having custody of a child desirous of obtaining a licence to engage in street trading shall make application to the Director in Form 19.
59. Hours of street trading. The Director may issue a licence in Form 20 for a child to engage in street trading between the hours of 7'.00 a.m. and 7.00 p.m. only, but not during ordinary school hours, on any day except Sunday, Christmas Day and Good Friday.
60. Children licensed to engage in street trading not to enter licensed premises. A child licensed to engage in street trading shall not for the purpose of such' trading enter any premises occupied by or on behalf of the Totalisator Administration Board of Queensland or any premises licensed under "The Liquor Acts, 1912 to 1965."
.6.1. Renewal of licence. Application fo: the renewal of a licence to engage in street trading shall be made in Form 19 and shall be made at least seven days before the date of expiry of the licence.
62. Return of cancelled or expired licence. When a licence to engage in street trading expires or is cancelled, the child in respect of whom such licence was issued or a parent or guardian of such child shall return the licence immediately to the Director.
II-Public entertainment
63. For the purposes of this Section II of Part VIII of these Regulations, the term "public entertainment" shall mean and include all or any of the purposes, places and premises set forth in paragraph
(d) of Section 115 of the Act.
64. Form of application for a child to be employed or used in public entertainment. A parent, guardian or other person having custody of a child desirous of obtaining a permit for such child to be employed or used in public entertainment shall make application to the Director in Form 21.
65. Form of permit for a child to be employed or used in public entertainment. A permit for a child to be employed or used in public entertainment shall be issued by the Director in Form 22.
66. Children not to be employed or used in public entertainment during school hours. Except in circumstances considered exceptional by the Director, a permit shall not be issued for a child to be employed or used in public entertainment during school hours if such child is required to attend school pursuant to the provisions of "The Education Act of 1964." Before determining whether the circumstances are exceptional the Director shall consult with the Principal or Head Teacher of the School attended by the child.
67. Children not to be employed or used in public entertainment in licensed premises. A child shall not be permitted to be employed or used in public entertainment if the place of such public entertainment is on premises licensed under "The Liquor Acts, 1912 to 1965," or any premises which are deemed by the Director to be undesirable for such employment or use of a child.
PART IX-GENERAL
68. Undertaking to pay maintenance. The form of undertaking by a person to pay maintenance shall be in Form 23.
69. Oath of fidelity and secrecy. The prescribed oath of fidelity and secrecy required in pursuance of the provisions of Section 144 of the Act shall be in Form 24.
