A consultation has been held with the Ministry of Agriculture and Food to determine whether there are known populations of declared plants or significant weeds in or adjacent to the project area, see Appendix I. As the project site receives >400 mm of annual rainfall and is located within for the vulnerable areas in the south-western parts of Western Australia, advice was obtained on the fallback status and management of the project area from the DEC Phytophthora Coordinator, see Appendix L. The decision to refer the project to the Commonwealth Division of SEWPC was based on whether the project would affect Commonwealth country or may have a significant impact on matters of national importance protected under the EPBC Act (1999).

The DSEWPC protected issues search tool was used to determine whether the project will affect any issues of national importance:. http://www.environment.gov.au/erin/ert/epbc/index.html) refer to Appendix H for the results of this research and Section 7 for a discussion of the findings. The decision whether to refer the project to the State EPA was based on whether the project would affect environmental factors significantly enough to require referral under section 38 of the Environmental Protection Act 1986 (refer to Appendix E of the Guidance for Environmental Assessment and Approval of Main Roads). A site visit was carried out by the GHD Senior Environmental Scientist in June 2010 (refer to Annex N) to examine the general features of the site.

The broad types of vegetation near the project area were defined as degraded medium forests; jarrah, marri & wandoo. The clearing along the east side of the road for the proposed expansion of the fill in Section 2 covers approximately 0.76 ha, almost all of this vegetation is non-local.

A survey by the Australian Heritage Places Inventory and Heritage Council of Western Australia indicated that there are no sites of historic interest in the vicinity of the project area. So essentially nothing changes in the function and operation of the drain. Provided that traffic management and signage are applied according to the standards of the major roads, none of the proposed works pose a significant threat to public safety.

Shark Bay National Heritage Sites Search the Australian Heritage Sites Census database located no. A search of the Ministry of Sustainability, Environment, Water, Population and Communities' Protected Matters Finder tool did not identify any Ramsar wetlands in the vicinity of the project. A search in the search tool of the Ministry of Sustainability, Environment, Water, Population and Protected Affairs found 13 endangered species.

Given the highly degraded nature of the sites (i.e. between degraded and fully degraded vegetation, surrounded by cleared farms), the project is not considered to have a significant impact on chuditch, western ring-tailed possum or quokka. A search by the Department of Sustainability, Environment, Water, Population and Communities Protected Affairs Search Tool found 7 migratory species near the project.
