Proposed Land Acquisition - Fingal Head SUMMARY OF REPORT:
At its meeting held 12 December 2001, the Trust considered a request from Hickey Lawyers on behalf of several property owners at Fingal Head, to acquire a portion of Crown Reserve 1001008.
The Trust resolved:
“…that the Trust considers it desirable to sell or lease the portion of Crown Reserve 1001008 as indicated on Figure 1 in the report and this matter be referred to the Minister for Land and Water Conservation.”
The matter was referred to the Minister on 28 December 2001 and a reply has subsequently been received.
RECOMMENDATION:
That the Trust notifies the proponents of the Minister's advice on this matter.

REPORT:

Whilst the Trust resolution states that “the Trust considers it desirable to sell or lease . . .”, the response from the Minister does not make reference to the lease option.

However, it should be noted that:
1. The correspondence from Hickey Lawyers only requested consideration to the sale of the land, not leasing, and;
2. Several objections were received by Fingal residents to the Trust resolution.
Under the provisions of the Crown land Act, 1989, the provision of a lease over a Crown reserve not only requires the consent of the Minister and may include any terms and conditions as the Minister thinks desirable, the lease needs to be consistent with the reserve purpose. Reserve 1001008 is reserved for public recreation and coastal environmental protection. Therefore, it appears unlikely the proponents would benefit from leasing the land under these circumstances.
Subsequently, it is recommended the Trust notifies the proponents of the Minister’s advice on this matter.

FILE REF: Fingal Beach; Licences - Temporary Crown Reserve REPORT TITLE:
Corporate Event - Fingal Beach SUMMARY OF REPORT:
The Trust has received a request for permission to stage an event on Fingal Beach related to a planned corporate conference on the afternoons of 3 and 6 April 2003.
RECOMMENDATION:
That the Trust issues a temporary licence under the provisions of Section 108 of the Crown Lands Act, 1989 to "Designtroupe" for the use of a section of South Fingal Beach on 3 and 6 April 2003 for the event as detailed in the attached report. The licence to include the following conditions:-
• A fee of $165.40 per day.
• Licence does not provide for exclusive use of the beach
• Minimum public liability insurance cover of $10,000,000 with copy of policy to be provided to Trust.

REPORT:
The Trust has received a request for permission to stage an event on South Fingal Beach related to a planned corporate conference on the afternoons of 3 and 6 April 2003.
The details of the proposal are as follows:
Approximately 400 people divided into 20 groups of 20. Each group will work on sand castle building requiring around 4 square metres of beach.
The set up on the beach will include a basic marquee for each group (20 marquees total) and 1 larger marquee for drinks, sunblock, information and organisation.
It is not anticipated any vehicles will be used on the beach. The event will be set up in the morning and packed down in the afternoon. The total area of beach required will be approximately 120m long. The organisers wish to utilise an isolated section of South Fingal Beach to minimise disturbance to both the public and their event.
Under the provisions of Section 108 of the Crown Lands Act, 1989 the Trust may grant a temporary licence for any prescribed purpose. The purposes for which a temporary licence may be granted include: catering; entertainments; functions; meetings and organised recreational activities.
Council’s fees and charges for park rents equate to $165.40 (for the first night).
Therefore, it is recommended the Trust issues a temporary licence under the provisions of Section 108 of the Crown Lands Act, 1989 to ‘Designtroupe’ for the use of a section of South Fingal beach for the above event.

Lot 490 DP 47021 Reserve 1002202 (Former Tourism NSW Site), South Kingscliff Gateway SUMMARY OF REPORT:
At the Council meeting of 6 March 2002 it was resolved “that a letter be forwarded to the Minister asking him to confirm that 100% of income raised from the rental of Lot 490 will be used for the maintenance of the single coastal reserve.”
The attached letter was sent requesting that the Minister clarify this matter. The Minister has responded through the Regional Director of the Land & Water Conservation. His advice is also attached.
RECOMMENDATION:
That this report be received and noted.

REPORT:
The development of Lot 490 DP 47021 Reserve 1002202 (former Tourism NSW site), South Kingscliff Gateway is expected to generate income for expenditure on the Single Coast Reserve Trust for maintenance of the land and its ongoing development.
At the Council meeting of 6 March 2002 it was resolved “that a letter be forwarded to the Minister asking him to confirm that 100% of income raised from the rental of Lot 490 will be used for the maintenance of the single coastal reserve.”
The Executive Officer, Dr John Griffin, wrote to the Hon. John Aquilina, Minister for Land &
Water Conservation, requesting clarification of his expectations in relation to their interest in relation to this matter, refer below:
