The Development Application has been assessed against the relevant heads of consideration under Section 4.15 of the Environmental Planning and Assessment Act, 1979, The Hills Local Environmental Plan 2019 and The Hills Development Control Plan 2012 and is considered satisfactory.
The issues raised in the submissions have been addressed in the report and do not warrant refusal of the application.
The issues raised in the conditions have been addressed in the report and the amended conditions of consent including;
Structural limitation on the size of the home industry use, through the deletion of the internal roller shutter and replacement with an acoustic wall.
Provision of air conditioning to ensure acoustic requirements will be met.
Relocation of the waste storage area to within the home industry workshop.
Requirement to maintain and retain the existing screen planting to the southern boundary.
Limitation of employees within the proposed home industry.
Prohibit truck access associated with the home industry use into the residential storage component of the shed.
HOW COMMUNITY VIEWS WERE TAKEN INTO ACCOUNT IN MAKING THE DECISION The application was notified to adjoining property owners and submissions from a total of ten (10) property owners were received. The issues raised primarily related to permissibility of the home industry, acoustic impacts, stormwater runoff and traffic generation. The issues are addressed in the report and do not warrant refusal of the application.
The application is recommended for approval subject to conditions of consent.

The Development Application be approved subject to the conditions contained in the council officers report.
REASONS
The development application has been assessed against the relevant heads of consideration under Section 4.15 and 4.46 of the Environmental Planning and Assessment Act 1979, Growth Centres SEPP and DCP and is considered satisfactory. The variation from the DCP relating to fencing and the concerns raised in the single submission received have been addressed in the report and do not warrant further amendment or refusal of the development application.
Approval is recommended subject to the conditions.
HOW COMMUNITY VIEWS WERE TAKEN INTO ACCOUNT IN MAKING THE DECISION The development application was notified to five (5) adjoining properties between 28 May and 22 June 2020. One (1) submission was received in response to the notification raising concern with respect to solar access and privacy impacts, and is addressed later in this report.
The development application is classified as Integrated Development pursuant to Section 4.46 of the Environmental Planning and Assessment Act 1979 as it seeks consent for works on and proposes a residential subdivision of mapped bushfire prone land. The Rural Fire Service has reviewed the proposal and has issued General Terms of Approval and a Bushfire Safety Authority for the development.
The development application is recommended for approval subject to conditions.
