Development in Accordance with Submitted Plans

MINUTES of the duly convened Ordinary Meeting of The Hills Shire Council held in the Council Chambers on 14 February 2017. A MOTION WAS MOVED BY COUNCIL DR LOWE AND SECOND BY COUNCIL PRESTON THAT the Recommendation contained in the report be accepted.

Clause 94 Considerations

A certificate of structural adequacy must be submitted to the Principal Certifying Authority (PCA), which certifies that the structural strength and load-bearing capacity of the existing balcony will be suitable for its new use. As the existing balcony is to be enclosed, the existing outdoor air intake should be relocated to an appropriate location in accordance with AS.

Subdivision Plan Amendments

A review of the automatic fire detection and alarm system (refer to fire engineering report no. S070185-rp01 Revision E dated 29/5/09 by RAW Fire Safety Engineering) should be undertaken to determine if additional detection is required to provide the proposed meeting room.

Hours of Work

Rezone land at 7 Maitland Place, Baulkham Hills from B7 Business Park to part R4 High Density Residential and part B7 Business Park;. Increase the maximum floor area ratio from 1:1 to 1.5:1 for the proposed B7 Business Park portion of land at 7 Maitland Place, Baulkham Hills;.

SUMMARY OF THE PLANNING PROPOSAL

Having regard to the above and notwithstanding changed circumstances regarding the ownership of the site, Council's original position of applying an overall FSR of 3:1 across the residential portion of the site is considered appropriate and reasonable. It is expected that as the two (2) sites are likely to no longer develop as one (1) combined development site, each site will now be required to comply with the applicable FSR control as it relates to that portion of land.

SUMMARY OF THE DRAFT VPA

A building envelope is defined by meeting checks such as setback, constructed area and height. Its purpose is to provide a shell within which development can take place, but not one that development must necessarily fill; . iii) Where maximum FSR results in a building smaller than the building envelope, it produces a building of smaller size and allows for building articulation through building envelope setbacks and variation in building heights.

GATEWAY DETERMINATION

Court planning principle in relation to FSR and building envelope [Investments No 8 Pty Ltd v Manly Council [2004] NSWLEC 355] which states that: .. i) FSR and building envelope controls must work together and both controls and/or their objectives must be met;.

EXHIBITION DETAILS AND SUBMISSION SUMMARY

PUBLIC AUTHORITY SUBMISSIONS

Sydney Water made no formal objection to the planning proposal and advised that a Sydney Water Service and Building Plan Approval will be a requirement for any future development application for the development. It would be appropriate to complete the preparation of a traffic study for the wider Norwest Precinct in conjunction with the strategic studies for the Sydney Metro Northwest.

PUBLIC SUBMISSIONS

Furthermore, it is considered that the new road to be built through the site will increase the permeability and efficiency of the local road network. Given the location of the site within the North West station area at the interface of land zoned R4 High Density Residential (to the west) and B7 Business Park (to the east), it is considered that the mixed use outcome, as proposed, is appropriate.

The main purpose of the draft amendments to the Environmental Planning and Assessment Act of 1979 is to build community confidence in the state's planning system. A draft district plan report must be submitted to council before the end of the exhibition period. As part of the proposed changes to the law, the compliant building would be expanded to include larger buildings (draft code for medium-density housing).

The exhibition of draft amendments to the Environmental Planning and Assessment Act 1979 represents the next stage in the review of the planning system for NSW. Other counter variations. a) The RMS grant component for the Road Stabilization and Embankment Project for River Rd, Lower Portland covered one of the two damaged sections along River Road.

In addition, the investments shown in Annex 1 page 10 have been made in accordance with the law, the regulations and the effective investment policy of the Council.

IN THE HILLS SHIRE FOR QUARTER

These volunteers have worked with the Council for ten years to ensure the restoration of the historic Bella Vista Farm. The extensive $30,000 works at Barker Street Reserve, Beaumont Hills, are providing exciting new recreational opportunities for families in The Hills Shire and surrounding suburbs and continue the Council's commitment to providing high quality facilities. In the new space, there are swings and games with a slide, and the original equipment has been preserved in a state-of-the-art design.

Second Quarter: An edition of The Hills Focus Magazine was produced and sent to all households. First quarter: The communications and marketing team disseminated information about council decisions and activities, including mayoral election results, what's on information, including the Orange Blossom Festival, civic ceremonies, information about libraries and capital works projects through print sites and social media . The QIC lease is expected to be completed in early 2017 and final details of the proposed storefront space will be provided to decide how the space will be used for Council activities.

ACHIEVEMENTS TO DATE

The Council's external auditors, Pricewaterhouse Coopers, presented the 2015-2016 accounts at the Council meeting on 23 August 2016. The Council's website continues to be an extremely popular source of information for residents along with social media.

In total, 474 development applications were determined with a cost of works estimated at over $600M. Quarter Two - continued to see significant construction progress from the Box Hill and Box Hill North Release Areas. Construction of the first subdivisions in both the Box Hill and Box Hill North release areas is nearing completion with the finalization expected in the next quarter.

QUICK FACTS JUNE 2016 WASTE GENERATED

Local primary schools took part in the Waste 2 art competition to mark National Recycling Week which took place in November 2016. The winning artwork and a selection of other artwork were displayed at the Resource Recovery stand at the Hawkesbury Harvest Farmer's Markets. They work mainly in the Bernie Mullane Reserve and Fullers Road along the Cattai Creek catchment.

Mayor of The Hills Shire, Councilor Yvonne Keane, welcomed more than 88 new citizens to the community in a special Australian citizenship ceremony held as part of the Orange Blossom Festival on Saturday, September 17 – National Australian Citizenship Day. A special ceremony was held during the Orange Blossom Festival to recognize 11 individuals and groups for their valuable contributions to The Hills community. The Sydney Hills Awards for Community Contribution are designed to encourage, recognize and reward valuable contributions and outstanding achievements by individuals and services.

Sackville North Cemetery is located on the north side of Sackville Ferry Road and is mostly vacant land sparsely covered by native vegetation, including many mature trees. GEE understands that with Castle Hill Cemetery reaching capacity, Sackville North Cemetery is being reviewed for further development as a more substantial cemetery. Castle Hill Cemetery is located on the west side of Gilbert Street and is a much more established cemetery with facilities such as toilets and car parking.

An ecological study identified threatened communities on the site and limited the potential for burial to 0.5Ha as indicated on the site plan provided in Appendix A. GEE understands that the Council wishes to expand the burial areas in the areas marked purple on the site plan as indicated. in Appendix A.

A summary of the subsurface conditions encountered is provided in Section 4.1, while a summary of borehole information, including total depth and depth to bedrock, is provided in Table 1 for the Sackville North Cemetery and Table 2 for the Castle Hill Cemetery. Detailed descriptions of the subsurface site conditions can be found in the borehole logs in Appendix B, while the soil profile is also summarized in Table 3. The only possibility is if the backhoe or backhoe used to excavate the burial sites has the capacity to penetrate the upper part of the sandstone rock formation, which is typically estimated to be extremely low to very low in strength.
