200k for the construction of a shared path at Strangers Creek from Solent Circuit, Bella Vista to Fairway Drive, Kellyville, funded from RMS grants. The house has recently become vacant and the removal of the house and structures is necessary to develop the reserve. It is proposed to be funded from Art 7.11 CP13. e) $79,328 additional funds required for the design and construction of a pedestrian bridge from Balfour Ave to McMillian Circuit Reserve as approved by T18-37 Council Resolution on December 11, 2018, funded from Sec 7.11 CP13. f additional funds required for the construction of a pedestrian bridge crossing over Memorial Ave, Kellyville from Hodges Road Reserve to Thomas Boulton Circuit Reserve as approved by T19-07 Council Resolution on December 11, 2018, funded from Sec 7.11 CP12. g) $30,000 additional funds required for the construction of a single lane roundabout at the intersection of Arthur Street and Yattenden Crescent, Baulkham Hills as approved by October 2018 LTC Council Resolution on 13 November 2018, funded from Sec 7.12.

Deferred funding for Existing Jobs $36.1m

Once the train station is complete and the site leaves Sydney Metro Northwest, there will be a review of the city center master plan and costs to reassess the high street infrastructure. These projects have been delayed as RMS is awaiting the completion of various traffic studies due to Station Precincts, Showground Road, Memorial Avenue &. Annangrove Road upgrade, transport strategy for Norwest Business Park and finalizing third party funding arrangements.

Project has been delayed to enable assessment of traffic demand on Cecil Avenue following completion of the Showground Road upgrade. Project delayed due to delay in Samantha Riley Rd works related to relocation of power and water utilities. Design consultants are progressing with preliminary works, but have been called on Free Settlers Drive next to the new Bella Vista public school which has been completed to finalize the design of this playing field.

500,000 – Kellyville Park Drainage & Irrigation and Lighting (CP12) Project Phase 2 delayed to allow for completion of negotiations with third party interests.

Other Contra Variation

Based on this version of the plan, the total CP15 gap funding up to 31 December 2017 amounts to Council now awaits the Minister's advice in relation to IPART's recommendations as well as the final amount of gap funding receivable up to 31 December 2017, which will be at a minimum of $51.4m. Furthermore, the investments made in Appendix 1 page 11 are in accordance with the Act, the Regulations and the Council's actual Investment Policy.

Project deferred by RMS until completion of transport strategy for Norwest Business Park. The project was put on hold as further assessment was required due to concerns over the impact of the proposed works on overland flow and the stability of existing retaining walls, which have now been resolved. QUARTER TWO REVIEW

PLANNING APPEALS AS AT 14 FEBRUARY 2019

As this is a matter for the Panel, we are required to seek guidance from the Panel regarding any settlement agreement. PROPERTY: 17-19 Alan Street, Box Hill (Alan Development Pty Limited) SUBJECT: Class 1 Appellate application against purported refusal of. The amended plans provided for increased classroom landscaping and open common areas that met the requirements of SEPP 65 and DCP.

PROPERTY: 13 Edwards Road and 76 The Water Lane, Rouse Hill (Cauchi) SUBJECT: Class 1 application appealing against alleged refusal. 619/2017/ZA (proposed subdivision with 46 residential lots and two remaining lots, proposed deletion of condition 23(3)(b) of planning consent (partial carriageway width of proposed Outback Street)). The applicant is now objecting to the application to build Outback Street and is seeking to amend the building consent to delete a condition of the consent which requires the construction of part of the width of Outback Street.

The Applicant must provide amended architectural plans, engineering plans and owner's consent for work on adjacent land. This information is required to resolve access issues as the proposed public roads serving the development (Nova Street, Zaniah Street and Aurora Street) are located on adjoining properties (Hynds Road 25, Hynds Road 29 and Mason Road 25 respectively). The applicant lodged a Notice of Termination with the Court on 30 November 2018 and the Development Application was formally withdrawn.

PROPERTY: 8 – 10 Bellcast Road, Rouse Hill (Kaplan Investments Pty Ltd) SUBJECT: Class 1 application appealing against alleged refusal. 177/2019/HA (proposed split of dual occupancy to incorporate change to THLEP minimum lot size standards). The application is for the deletion of a section 34 payment on the basis of a reversal of the contribution plan.

PROPERTY: 155 Old Northern Road Baulkham Hills (Old Northern Investments Pty Limited formerly known as Crypto Property Pty Limited). SALE: Class 1 application appealing the deemed refusal of development application 106/2019/HA (proposal for demolition of existing structure and construction of 82 place childcare centre). There are a number of concerns with the proposed childcare center on the corner of Old Northern Road and Edwards Road, including parking, traffic, child safety and the scale of the development.

SCHEDULE OF OUTSTANDING RESOLUTIONS

A report in The Hills Shire Times on 28 November indicated that funding for the relocation of the SES headquarters may now be available from the State Government. SUBJECT: NOTICE OF DECISION - REVIEW OF THE HILLS LOCAL ENVIRONMENTAL PLAN 2012 LOT SIZE STANDARDS TO RETAIN EXISTING STREETSCAPE AND CHARACTER. The Executive Director is conducting a review of The Hills Local Environmental Plan 2012 lot size standards relating to streets with a dominant character established by lot sizes greater than the current minimum LEP lot size standard.

Council agrees to contribute a maximum capital contribution of $70,000 to the Hills District Athletic Club for the construction of additions/extensions under DA 1573/2015/LA without further modification or amendment. Payment of the $70,000 will be made pursuant to a progress claim agreement as approved by the General Manager after the Club has spent its contribution. Following the preparation of the draft Voluntary Planning Agreement, and prior to any public exposure of the planning proposal, a report on the draft Voluntary Planning Agreement is submitted to Council for consideration.
