An Act to Amend the Local Government Act 1936-1968 in certain particuIars

[Assented to 18 December, 19691 BE IT ENACTED by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:-

I. Short title and citation. (1) This Act may be cited as the Local G o ~ e r n ~ e ~ ? t Act A ~ ~ ~ ~ ~ e r z t Act 1969.

(2) The Local G o v e r ~ ~ e n t Act 1936-1968 is in this Act refersed to as the Principal Act.

(3) The Principal Act as amended by this Act may be cited as the Local Go vernmerz t Act 1 9 3 6- 1 9 69,

6. (1) Amended Principal Act,

(2) The amount of any charge or fee fixed under and for the purposes of subsection (9) of section 21 of the principal Act by a Local Authority by resolution in respect of the year ending on the thirtieth day of June one thousand nine hundred and seventy and in force immed~at~ly before the cornmencement of this Act shall on and from that commencement be deemed to be the amount of that charge or fee fixed by the Local Authority by resolution without limitation in time for the purposes of subsection (9) o f section 21 of the Local G ~ v e ~ I ? ~ e ~ ~ Act 1936-1969 and shall continue to be the amount of that charge or fee under the said subsection until rescinded by the Local Authority by resolution or the Local Authority fixes that amount by resolution applying without limitation in time.

subsection (7) of section 26 of the Principal Act by a Local Authority by resolution in respect of the year ending on the thirtieth day of June one thousand nine hundred and seventy and in force immediately before the commencement of this Act shall on and from that commencement be deemed to be the amount of that fee fixed by the Local Authority by resolution without limitation in time for the purposes of subsection (7) of section 26 of the Local G Q ~ e ~ ~ ~ e ~ t Act 1936-1969 and shall continue to be the amount of that fee under the said subsection until rescinded by the Local Authority by resolution or the Local Authority fixes that amount by resolution applying without limitation in time.

(2) The amount of any sum fixed under and for the purposes of paragraph (iv) o f subsection (3) of section 29 of the Principal Act by a Local Authority by resolution in respect of the year ending on the thirtieth day o f June one thousand nine hundred and seventy and in force immediately before the commencement of this Act shall on and from that cornmencement be deemed to be the amount of that sum fixed by the Local Authority by resolution without limitation in time for the purposes

of paragraph (iv) of subsection (3) of section 29 of the Local G u ~ e ~ ~ ~ e ~ ~ Act 1936-1969 and shall continue to be the amount of that sum under

the said paragraph until rescinded by the Local Authority by resolution or the Local Authority fixes that amount by resolution applying without limitation in time.

(2) Where prior to the date of the commencemeiit of the LocaZ

~ o v e ~ ~ ~ e ~ t Act A ~ e n ~ ~ e ~ r Act 1969, a Local Authority had commenced to make a by-law under and pursuant to the provisions o f provision (27) of section 31 of the Principal Act as in force immediately before that commencement by the passing o f a resolution making such by-law, the Local Authority may continue and complete the confirmation and sealing of such by-law under and pursuant to such provisions which for that purpose shall be deemed to have force and effect.

(2) Where prior to the commencement of the Local ~ Q ~ e ~ n ~ e ~ t Act

~ ~ eAct ~1969, a Local Authority had commenced to proceed with ~ ~ e ~ t

LOCAL ~ ~ V ~ ACT ~ AMENDMENT ~ E N TACT 1969 3 may be of section 33 of the Local Government Act 19361968 as in force immediately before that commence~ent by passing a resolution to that effect, the Local Authority may continue and complete the prepara- tion, or amendment, of such scheme under and pursuant to such pro- visions which for that purpose shall be deemed to have force and effect.

15. (1) Amended Pri~G~pal Act.

(2) The annual fee fixed under and for the purposes of paragraph (iv) of subsection (22) of section 35 of the Principal Act by a Local Authority by resolution in respect of the year ending on the thirtieth day of June one thousand nine hundred and seventy and in force immediately before the commencement of this Act shall on and from that co~mencement be deemed to be that fee fixed by the Local Authority by resolution without limitation in time for the purpose^ of paragraph (iv) of subsection (22) of section 35 of the Lucal G u ~ ~ e ~ n ~ e n ~ Act 1936- 1969 and shall continue to be that fee under the said paragraph until rescinded by the Local ~ u t h o r ~ t y by resolution or the Local Authority fixes that fee by resolution applying without limitation in time.

16. (1) Amended Principal Act.

(2) Any charge, damages or fee fixed under and for the purposes of subsection (3) of section 42 of the Principal Act by a Local Authority by resolution in respect of the year ending on the thirtieth day of June one thousand nine hundred and seventy and in force im~ediately before the commencement of this Act shall on and from that commencement be deemed to be the charge, damages or fee fixed by the Local Authority by resolution without l i m i ~ t i o n in time for the purposes of subsection (3) of section 42 of the Local Governrnent Act 1936-1969 and shall continue to be the charge, damages or fee under the said subsection until rescinded by the Local Authority by resolution or the Local Authority fixes such charge, damages or fee by resolution applying without li~itation in time,

(2) The scale of damages and charges referred to in paragraph (i) of subsection (1) of section 4 2 ~ of the Principal Act prescribed in that behalf by a Local Authority by resolution in respect of the year ending on the thirtieth day of June one thousand nine hundred and seventy and in force immediately before the c o m m e ~ c e ~ e n t of this Act shall on and from that commencement be deemed to be that scale fixed by the Local Authority by resolution without limitation in time for the purposes

of paragraph (i) of subsection (1) of section 4 2 ~ of the Local G u y ~ ~ ~ ~ e ~ ~

Act 1936-1969 and shall continue to be that scale referred to in the said subparagraph until rescinded by the Local Authority by resolution or the Local Authority fixes that scale of damages and charges by resolution applying without limitation in time.

19, (1) Amended Principal Act.

(2) Fees or charges fixed by a by-law of a Local Authority made pursuant to subsection (1) of section 4 9 ~ of tlie Principal Act and in force immediately before the commence~ent of this Act shall on. and from that c o m ~ e n ~ e m ~ n t be deemed to be fees or charges fixed for the time being by resolution. of the Local Authority in question for the purposes of sub- section (1) of section 4917 of the Locat Government Act 1936-1969 and shall continue to be fees or charges so fixed until rescinded by the Local Authority by resolution or the Local Authority fixes the fees or charges by resolution.
